HomeMy WebLinkAboutOrdinance 1429ORDINANCE NO. 1429 AN ORDINANCE DECLARING THE ASSESSMENT OF PROPERTY BENEFITTED FOR THE COSTS OF CONSTRUCTION OF CURBS, SIDEWALKS, GUTTERS, STORM SEWER, SANITARY SEWER AND STREET IMPROVEMENTS ON HOPKINS ROAD FROM A POINT APPROXIMATELY 162 FEET WEST OF BURSELL ROAD AND EXTENDING EASTERLY APPROXIMATELY FOR 1410 FEET TO THE END OF HOPKINS ROAD WITHIN THE CITY OF CENTRAL POINT, AND DIRECTING THE RECORDER TO ENTER A STATEMENT THEREOF IN THE DOCKET OF CITY LIENS WHEREAS, by Ordinance No. 1423, the City Council proposed to make assessments for the casts of construction of curbs, sidewalks, gutters, storm sewer, sanitary sewer and. street improvements on Hopkins Road from a point. approximately 162 feet west of Burnell Road and extending easterly approximately 1410 feet to the end of Hopkins. Road in the City of Central Point, and directed the City Recorder to serve notice of the proposed assessments by mailing notices to the owners of each parcel of property proposed to be assessed, and setting March 12, 1981 as the date before which objections to such proposed assessments should be filed with the Recorder, and WHEREAS, the City Recorder did mail notices in the manner set forth in said ordinance to each of the owners of the parcels of property proposed to be assessed, and the City Council has reviewed all objections relating to said proposed assessments, including consideration of the fact that the owners of the pro- perties described in assessments 7 and 8 have by contract. agreed to assume responsibility for benefit to properties not within the assessment district, and has made adjustments on said assessments as deemed necessary and appropriate, now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS Page 1 - Ordinance No. 1429 FOLLOWSc Section 1. The total. actual cost of construction of curbs, sidewalks, gutters, storm sewer, sanitary sewer and street improvements on Hopkins Road from a point approximately 162 feet west of Bursell Road and extending easterly approximately for 1410 feet to the end of Hopkins Road, within. the city, is $186,059.86, including interest, inspection costs and admin- strative cos s in the sum of $14,869.83 computed to April 24, 1981, which is the last date to make payment or apply for Bancroft bonding pursuant to ORS 223.210. Section 2. Parcels of .property below described by tax lot numbers based upon the tax assessor°s public records of Jackson County, Oregon are benefitted. by the construction of curbs, sidewalks, gutters, storm sewer, sanitary sewer and street improvements on Hopkins Road from a point approximately .162.. feet west of Bursell Road and extending easterly approxi- mately 1410 feet. to the end of Hopkins Road, in the City of Central Point, in the full amount set opposite the description of each parcel as a proportionate share of the total amount to be assessed against all benefitted property for the improvements indicated, and the Council hereby makes assessments for the costs thereof in the amount set opposite each description: ASSESSMENT NO. 1 Janet I. The Recorder of the City of Central Point is hereby directed to enter a statement of said several assessments in the docket of the city liens of said city, and said assess- ments are hereby declared due and payable, and the owners of the parcels of property herein assessed are required to pay said assessments to the Recorder (or to apply for 20 ,installment pay- ments of assessments pursuant to ORS 223.210) within ten days after notice of such assessments is published. Section 4. The Recorder is hereby directed to serve notice of the foregoing assessments by publishing the within Page 3 - Ordinance No. 1429 ordinance in a newspaper of general circulation within the City of Central Point on the 13th day of April, 1981. Section 5. This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, in order to establish a date which interest is computed as April 24, 1981 and thereby incorporate interest as an included cost of the assessment district, second reading is waived pursuant to Municipal Code Section 2.04.020, and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage..
