ORDINANCE NO. 1655
AN ORDINANCE VACATING AN EAST-WEST ALLEY BETWEEN SOUTH
FIRST AND SOUTH FRONT STREETS, APPROXIMATELY 100 FEET
IN LENGTH AND RUNNING PARALLEL TO ASH AND CEDAR STREETS
WITHIN THE CITY OF CENTRAL POINT
WHEREAS, Grange Cooperative Supply Association, Inc., through
Jim Hudson, Agent, has requested the vacation of the remainder of
the alley between South First and South Front Streets parallel to
Ash and Cedar Streets within the City, and pursuant to said
request, the City Council initiated vacation proceedings on its own
motion pursuant to ORS 271.130, and
WHEREAS, the Planning Commission has reviewed the proposed
vacation and recommended approval of the same, and, following
requisite notice of said proposed vacation by publication and
posting, certifications of which appear in the record hereof, and
the Council having on November 15, 1990, held a public hearing on
the proposed vacation, and
WHEREAS, the Council finding that owners of a majority of the
area affected, computed pursuant to ORS 271.080, have not objected
in writing to said vacation, and the Council further finding that
said vacation will not substantially affect the market value of
said property, and that said area is not necessary or a useful part
of the public street and alley system of the City of Central Point,
and
WHEREAS, the City Administrator, being the City recording
officer, has filed in the official City records a certificate that
all City liens and all taxes have been paid on the lands to be
vacated, now, therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS:
Section 1. That the alley between South First and South Front
Streets, approximately 100 feet in length and running parallel to
Ash and Cedar Streets within the City of Central Point, described
as follows:
Beginning at the southeasterly corner of Lot 1, Block 18 of
the Central Point Town Plat, as recorded in Volume 13, Pages
582-585 of the Deed Records of Jackson County, Oregon; thence
Southwesterly along the southerly line of Lots 1 and 2 of said

Block 100 feet to the Southwesterly corner of said Lot 2;
thence Southeasterly 20 feet to the Northwesterly corner of
Lot 8 of said Block; thence Northeasterly along the northerly
line of Lots 8 and 9 of said Block 100 feet to the
Northeasterly corner of said Lot 9; thence Northwesterly 20
feet to the point of beginning
Is hereby vacated pursuant to ORS 271.130 and the ownership of said
land within said described alley in the City of Central Point
hereby vacated shall become vested as provided by law.
Section 2. That a public utility easement within the area
occupied by the above-described alley is necessary for the
continued existence, maintenance and replacement of the facilities
of public utilities and the facility of TCI Cablevision of Oregon,
Inc. lying within said area.
The City Administrator shall not cause any record of the vacation
to be filed or recorded with the county clerk or county assessor,
unless at the time of such recording there are available for
concurrent recording appropriate easement documents signed by all
parties in whom vacation areas shall vest.
Section 3. That subject to Section 2 above, the City
Administrator is directed to file a certified copy of the within
ordinance with the Jackson County Clerk, the Jackson County
Assessor and Jackson County Surveyor, together with any maps, plats
or other records required or provided for by law.
