AN ORDINANCE AMENDING MUNICIPAL CODE TITLE 17 TO ADD CHAPTER 17.54
RELATING TO B.C.G., BEAR CREEK GREENWAY, AND DECLARING AN EMERGENCY
WHEREAS, the City of Central Point has adopted a Comprehensive Plan and
Urban Growth Boundary that includes portions of the natural corridor of Bear
Creeks and
WHEREAS, the State Department of Land Conservation. and Development has
reviewed the City's plan for compliance with the statewide goals and has
directed the City to develop appropriate measures for the protection of the
greenway corridor within the U.G.B.9 and
WHEREAS, the City of Central Point, in .order to comply with the statewide
planning goals as they pertain to protection of the natural environment, has
developed a zoning. district that is consistent with the Comprehensive Plan and
with the master plan for the Bear Creek Greenwayq and
WHEREAS, by Resolution No. 425, the Central Point City Council declared
its intent to amend the Comprehensive Plan Text and Map, Zoning Ordinance and
Zoning Map, and by Ordinance No. 1521, established hearing dates therefor; and
WHEREAS, public hearings reviewing the proposed amendments were duly ad-
vertised in the Medford Mail Tribune as required by ordinance and held before
the Citizens Advisory Committee on August 14, 1984, the Planning Commission on
September 4, 19849 and the City Council on September 20, 19849 and
WHEREAS, at said public hearings opportunity was. provided for testimony to
be heard from proponents and opponents. of the amendments9 now, therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWSa
Section 1. There is hereby added to the Municipal Code of the City of
Central Point Chapter 17.54 which is to read as follows:

B,C.G „ BEAR CREEK GREENWAY
17.54.010 Purpose, The B.C.G, district is intended to provide for en-
vironmental preservation and limited development within the portion of the Bear
Greek Greenway that lies within the City limits and Urban Growth Boundary of
Central Point. This district is intended to protect the public health and
safety, preserve the natural environment of the Bear Creek corridor, encourage
the implementation of the Greenway Plan, provide for limited recreational uses,
and ensure the continued preservation of fish and wildlife habitat within the
riparian environment of the creek.
17.54.020 Permitted Uses.
The following uses are permitted in the B.C.G,
district:
A. Public parks and nature study areas.
B, Public recreational or stream-oriented facilities or activities other
than parks and nature study areas that are consistent with the Greeway Plan and
with the City°s Comprehensive Plan,
C. Paths and trail systems for the use of pedestrians, bicyclists and
equestrians but not including. motorized vehicles.
D, Uses or structures that are customarily appurtenant to a permitted use
such as off-street parking, maintenance buildings, signs, and public
improvements.
17.54.030 Conditional Uses, The following uses are permitted in the
B,C.G, district when authorized in accordance with Chapter 17.76:
A, Privately developed or operated recreational or stream-oriented facil-
ities or activities that the Planning Commission may find to be compatible with
the purpose of this section and consistent with the City°s Comprehensive Plan
and the Bear Creek Greenway Plan.
B. Public or municipally-owned facilities or utilities that the Planning
Commission determines to be compatible with the purpose of this section and
with area plans.
C. Agricultural uses other than livestock.
D. Mining or aggregate removal,.
17.54.040 Height regulations< All buildings and structures shall be
designed to be as inconspicuous as possible and any such structure proposed to
exceed fifteen (15) feet in height shall be subject to Planning Commission
review and approval,
17.54,050 Area, width and yard requirements. All areas within the
Greenway are in public ownership or proposed for public acquisition, No mini-
mum lot requirements are necessary for the types of development that might
occur within this district,
17.54.060 General requirements. The area designated on the Comprehensive
Plan Map and Zoning Map of the City of Central Point as Bear Creek. Greenway
shall be preserved to the maximum extent practicable in its natural condition,
No person, firm, or corporation, whether public or private, shall cause or
permit any excavation, fill, stream diversion, removal of vegetation, or other
alteration of the natural environment of the Greenway, nor encroach upon any
part thereof eaith buildings, footings, retaining walls, bridges, piers,

abutments, dams, diversion weirs., riprap, or any other physical feature without
first. securing the express written consent of the Central Point Planning
Commission. Application for such consent shall be made in writing and any con-
ditions of approval shall be based on the purposes of this section.
17.54.070 Signs. Signs shall be permitted for identification information
or direction only. In no case shall a sign be permitted that advertises pro-
ducts or services of any kind.. All signs shall be designed for maximum visual
and aesthetic compatibility with the Greenway environment and are subject to
Planning Commission review and approval.
17.54.080 Fences, walls, hedges, and screen .plantings. Physical improve-
ments that are obviously man-made and would impair the free movement of people
or wildlife within the Greenway are discouraged, but may be permitted when
required to solve a specific problem or serve a special purpose, and when de-
signed to be visually and aesthetically compatible with the Greenway environ-
ment. Any fence, wall, hedge, or screen planting is subject to review and
approval by the Planning Commission.
17.54.090 Off-street parking. Off-street parking shall be required as a
part of any recreational or other facility that could reasonably be expected to
generate automobile trips or require automobile access. The number of parking
spaces will be determined by the Planning Commission on a case-by-case basis
and on the basis of statistical or other evidence of parking needs as provided
by City staff or the applicant.
Section 2. This ordinance being. necessary for the immediate preservation
of the public peace, health and safety of the City of Central Point, Oregon,
due to the necessity for L.C.D.C. acknowledgement of the City®s Comprehensive
Plan, second reading is waived and an emergency is hereby declared to exist.
