HomeMy WebLinkAboutOrdinance 1529ORDINANCE N0. 1529 AN ORDINANCE AMENDING CHAPTER 17.16 OF THE CENTRAL. POINT MUNICIPAL CODE AND DECLARING AN EMERGENCY WHEREAS, the State Department of Land Conservation and Development has reviewed the Central Point Comprehensive Land Use Plan and related implementing measures for compliance with statewide planning. goals; and WHEREAS, D.L.C.D. has determined that the City°s existing Residential-Farm zoning district is more appropriately a rural district and not suitable for the urbanizable areas within the City°s urban growth boundary; and WHEREAS, by Resolution No. 425, the Central Point City Council declared its intent to amend the Comprehensive Plan Text and Map, Zoning Ordinance anal Zoning Map, and by Ordinance No. 1521, established hearing dates therefor; and WHEREAS, the City of Central Point has developed an alternative zoning district known as the R-L, Residential Low-Density district, that is intended to replace the Residential-Farm district and be consistent with statewide plan- ning goals and the City°s Comprehensive Plan; and WHEREAS, public hearings reviewing the proposed amendments were duly ad- vertised in the Medford Mail Tribune as required by ordinance and held before the Citizens Advisory Committee on August 14, 1984, the Planning Commission on September 4, 1984, and the City Council on September 20, 1984; and WHEREAS, at said public hearings opportunity was provided for testimony to be heard from proponents and opponents of the amendments; now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. Municipal Code Chapter 17..16 is hereby amended to read as follows: ORDINANCE N0. 157_9 -Page 1 Chapter 17.16 R-L, RESIDENTIAL LOW-DENSITY DISTRICT 17.16.-010 Purpose. The purpose of the R-L district is to provide for a semi-rural residential environment along the periphery of the Urban Growth Boundary which will act as an effective transitional area or buffer between urban and rural land uses and. also provide for a development alternative in areas having unusual characteristics that make them less suitable for higher- density residential development. 17.16.020 Permitted Uses. The following uses and their accessory uses are permitted in the R-L district: A, Single-family dwelling; B. Single-family mobile or manufactured home; C. Accessory uses are permitted as follows: 1. Guesthouse, not rented or otherwise conducted as a business. 2. Greenhouse for domestic non-commercial gardening. 3. Personal hobby or work shop. 4. Garage and other storage buildings for personal, non-commercial use. 17.16.030 Conditional Uses. The following uses and their accessory uses are permitted in the R-L district when authorized in accordance with Chapter 17.760 A. Home occupations subject to the provisions of Section 17.60.1809 B. Rest, nursing and convalescent homes; C. Cemeteries, mausoleums, columbariums, crematoriums; D. Churches and similar religious institutions9 E. Public and parochial schools9 F. Public and governmental uses including parks and recreational facili- ties, fire stations, museums, but not including storage or repair yards, ware- houses or similar uses; G. The keeping of small animals other than pets as defined in Chapter 17.08 H. Planned unit developments subject to the provisions of Chapter 17.68. 17.16.040 Height regulations. A maximum height of two and one-half stories or thirty-five feet, whichever is the lesser, is allowed in the R-L district.. 17.16.050 Area, width and yard requirements.. The following lot require- ments shall be observed in the R-L district: A. Lot Area: The lot area shall be a minimum of fifteen thousand (15,000) square feet. B. Lot Width: The lot width shall be a minimum of seventy-five (75) feet. C. Front Yard: The front yard shall be a minimum of twenty (20) feet but not more than fifty (50) feet. D. Side Yard: Side yards shall be a minimum of ten (10) feet; however, side yards abutting. a street or a proposed or planned future street shall be a minimum of twenty (20) feet. E. Rear Yardc The rear yard shall be a minimum of ten feet. ORDINANCE N0. 1.529 -Page 2 17.16,060 Lot Coverage. The maximum permitted aggregate building coverage shall be thirty percent (30%) of the total lot area in the R-L district. Section 2. This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, due to the necessity for L.C.D.C, acknowledgement of the City's Comprehensive Plan and related implementing measures, second reading is waived and an emer- gency is hereby declared to exist..
