HomeMy WebLinkAboutOrdinance 1528ORDINANCE N0, 1528 AN ORDINANCE AMENDING CENTRAL POINT MUNICIPAL CODE TITLE 16 TO ADD CHAPTER 16.38 RELATING TO CONVERSION PLAN REGULATIONS, AND DECLARING AN EMERGENCY WHEREAS, the City of Central Point has adopted an Urban Growth Boundary that contains a wide variety of land uses and potential for land divisions that are consistent with the existing Jackson County zoning districts but not necessarily in the best interests of future urban level development as the City grows, and WHEREAS, the Department of Land Conservation and Development directed the City to work with Jackson County to establish appropriate procedures for dealing with land. divisions in the urbanizable areas9 and WHEREAS, the City of Central Point has worked with Jackson County to develop a procedure requiring City review and approval prior to the County`s approval of a land division and this procedure has been approved by Jackson County; and WHEREAS, by Resolution No. 425, the Central Point City Council declared its intent to amend the Comprehensive Plan Text and Map, Zoning Ordinance, and Zoning Map, and by Ordinance No. 1521, established hearing dates therefor; and ti~IEREAS, public hearings reviewing the proposed amendments were duly advertised in the Medford Mail Tribune as required by ordinance and held before the Citizens Advisory Committee on August 14, 1984, the Planning Com- mission on September 4, 1984, and the City Council on September 20, 19849 and WHEREAS, at said public hearings opportunity was provided for testimony to be heard from proponents and opponents of the amendments; now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1, There is hereby added to the Municipal Code of the City of Central Point Chapter 16.38 which is to read as follows: ORDINANCE N0. 1528 -Page 1 Chanter 16.38 CONVERSION PLAN REGULATIONS 16.38.010 Purpose and requirements. A. All lands within the Urban Growth Boundary of the City of Central Point are intended for future annexa- tion and development to urban standards. and densities.. In some cases, land divisions and limited development will occur prior to annexation pursuant to county requirements. It is the intent of this chapter to assure that any such land divisions will be designed to maximize the long-range urban development potential of the parcel and general area and will not preclude further divi- sions, development or urban use of adjacent properties. Further, it is the purpose of this chapter to provide a process for timely City review of an applicant°s conversion plan and to provide for the City°s comments to the county. The conversion plan required herein will assure that the future development of streets or utilities will be easily integrated into the urban system when the property is eventually annexed to the City. B. The applicant for any land division within the Urban Growth Boundary of the City of Central Point that. will result in a lot or parcel smaller than ten acres shall submit a conversion plan for City approval prior to applica- tion to Jackson County for the actual division of the property. The City will notify Jackson County of the City°s approval of the conversion plan so that the county may accept and process the application for the subdivision, land partition or other division in accordance with its land development ordi- nance requirements. It is understoood that Jackson County, in consideration of the City°s recommendations, may require standards or other conditions of approval that will assure that future development and subsequent partitioning are in accordance with the City°s Comprehensive Plan and other specific development plans that may be in effect for the subject area. 16.38.020 Procedure for approval. A. The City°s recommendation shall be to the county and if not included, the application will be considered incomplete and will not be processed. The City's written recommendation shall be provided the applicant for the purpose of the applicant°s submittal of a conversion plan to the county. B. The following process shall be completed by the City of Central Point in order that the City may provide comments to Jackson County for a land divi- sion within Central Point°s U.G.B.: 1. Conversion plan. In order for the City of Central Point to review and provide comments to the county on a conversion plan, there shall be submitted to the City three (3) copies. of a map drawn to scale at a size no smaller than 11B° x 17" and in a clear black and white reproducible format. This map may be accompanied by a narrative or other documentation that cannot be easily shown on the map.. The map and related documentation shall contain the following information: a. The date, north point, scale, and Assessor°s tax lot identification. b. The boundaries and dimensions of the parcel to be divided. c. Name and address of the owner of record, person representing the owner (if applicable), and person who prepared the map. d. An indication of the total acreage or square footage of the parcel to be divided. ORDINANCE N0. 1528 -Page 2 e. The county zoning district in which the property is located and the City°s Comprehensive Plan designation and future. zoning district. as shown on the official City Zoning Map. f. Show the locations, names, pavement widths, and right.-of-way widths of all public streets in the vicinity of the subject property. Also show the lcoations, widths and purposes of any other easements on or near the property. g. Show the locations and sizes of any utilities including water lines, sewer lines, storm drains, utility poles, etc., that are on or within ZOO feet of the subject property. h. Show the outline, dimensions and specific locations of all existing structures and indicate which, if any, will be removed. i. In cases where the slope on any portion of the subject pro- perty exceeds ten (10) percent, show topographical details (contour lines). j. Show the proposed lots that would result from the proposed land division and clearly indicate those lot boundaries and dimensions. k. Using dashed lines show a proposal for the future subdivision or partitioning of the entire property to urban levels in accordance with the City°s future zoning of that property or the density levels projected by the City°s Comprehensive Plan. Those future lots shall be no smaller than allowed by the applicable zoning district, nor shall they exceed the minimum lot size requirement by more than fifty (50) percent. 1. Show proposed building locations if known or planned. m. Show the lcoations of future streets, utility lines and other features of the plan that will serve the future parcels and future development. n. The following statement shall be included on the conversion plan map or in the related and attached agreement between the county and the applicant: "Dashed lines represent future conversion plans to urban densities for lots and streets. All development will conform to setback and other lot development requirements of the City of Central Point, This plan shall be binding on the property until the property is annexed to the City of Central Point or until this plan is amended.t° o. If a subsurface sewage disposal system is planned or may be needed to serve the anticipated development prior to annexation, the applicant shall submit documentation to show those locations that are most and least suitable for such a system. Any proposed subsurface system shall be shotm on the conversion plan. 16.38..030 City review and action. A. Upon receipt of the maps and related documentation from the applicant, the City Planner shall review the proposal for consistency with the City°s adopted Comprehensive Plan and Zoning Ordinance requirements and any other applicable City codes and standards. The proposal may be referred to the City Planning Commission when any unusual features or circumstances of the site or of the proposal could result in ob- stacles to future partitioning or development. B. Within sixty (60) days of acceptance of the completed conversion plan application, the City shall provide the applicant with comments, recommenda- tions or other statement of consistency with local plans and the future zoning of the subject area. These comments shall include a written recommendation for county approval or denial of an application for the subject land division. A copy of the City Planner°s report will then be sent to Jackson County. C. Upon approval of the conversion plan, the applicant will be in- structed to proceed with the appropriate application to Jackson County in accordance with the county's land development ordinance requirements. The ORDINANCE N0. 1528 - Page 3 City°s written approval of the conversion plan and any related documents or recommended conditions of approval shall be included in that application, Section 2. This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, due to the necessity for L.C.D.C. acknowledgement of the City's Comprehensive Plan,. second reading is waived and an emergency is hereby declared to exist.
