AN ORDINANCE. DECLARING THE ASSESSMENT OF PROPERTY BENEFITTED
WITHIN THE LOCAL IMPROVEMENT DISTRICT ON SOUTH FIRST STREET BETWEEN
BUSH STREET AND CUPP DRIVE, AND DECLARING AN EMERGENCY
WHEREAS, the City Council authorized and ordered the construction of
curbs, gutters, storm sewers, and paving on South First Street between Bush
Street and Cupp Drive by Ordinance No. 1514, and
WHEREAS, by Ordinance No. 1515, the City Council proposed to make assess-
ments for the costs of construction of curbs, gutters, storm sewers, and
paving on South First Street between Bush Street and Cupp Drive and directed
the City Administrator to serve notice of the proposed assessments by mailing
notices to the owners of each parcel of property proposed to be assessed, and
set July 19, 1984 as the date before which objections to such proposed assess-
ments should be filed with the City Administrator, and
WHEREAS, the City Administrator did provide notices in the manner set
forth in said ordinance to each of the owners of parcels of property proposed
to be assessed, and the public hearing was held thereafter in accordance with
such notice, and after hearing all testimony, whether for or against such
improvements or proposed assessments of the cost thereof to the adjacent bene-
fitted properties, the City Council deems that such improvement is of material
benefit to the City and that all property to be assessed will be benefitted to
the extent of the probable value of the respective assessments to be levied
for the costs thereof, now, therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS:
Section 1. The estimated cost of the curbs, gutters, storm sewers, and
paving on South First Street from Bush Street to Cupp Drive within the City of
Central Point, Oregon, is hereby determined. to be the sum of $161,000.00

including interest, inspection costs and administrative costs in the sum of
$11,600.00. Said total sum of $161,000.00 is to be paid as followso

Amount to paid by Jackson County $ 30,000.00
Amount to be assessed against benefitted
property owners $116,000.00
Section 2. The following described parcels of real property designated
by Jackson County Tax Assessor`s tax lot numbers are benefitted by the con-
struction of said improvements in the full amount indicated for each parcel as
a proportionate share of the total amount to be assessed against all benefit-
ted property, and the Council hereby makes assessments for the cost thereof
and any amounts set opposite each description for the cost of such improvements
in the City of Central Point as follows:

Section 3. These assessments are hereby declared due and payable and the.
o~,mers of the parcels of the property herein assessed are required to pay said
assessments to the City or file a Bancroft application within ten days after
notice of such assessments is published. The City Administrator is hereby

directed to enter a statement of said assessments in the docket of the City
liens of said City, Property owners electing to file Bancroft applications
shall pay assessments in 20 equal semiannual installments including interest
thereon at a rate per annum equal to the net effective rate of interest to be
paid by the City on the sale of its improvement bonds rounded to the next
highest one-tenth (1/10th) percent on all of said assessments which have not
been paid, said interest to be payable semiannually at the time each install-
ment is paid.
Section 4. The City Administrator is hereby directed to serve notice of
the foregoing assessments by publishing a Notice of Assessment in a newspaper
of general circulation within the City of Central Point.
Section 5. This ordinance being necessary for the immediate preservation
of the public peace, health and safety of the City of Central Point, Oregon,
based upon the need for completion. of construction in a timely manner and the
need for payment to the City in order to finance the improvements, second
reading is waived and an emergency is hereby declared to exist and this ordi-
nance shall be in full force and effect immediately upon its passage by the
Council and approval by the Mayor.
