HomeMy WebLinkAboutOrdinance 1507ORDINANCE N0. 1507 AN ORDINANCE ALLOWING RATE INCREASE TO McCAW COMMUNICATIONS OF SOUTHERN OREGON PURSUANT TO FRANCHISE AGREEMENT, AND DECLARING AST EMERGENCY WHEREAS, McCaw Communications of Southern Oregon, doing business as McCaw Cablevision, has applied to the City to increase its rates charged to its subscribers within the City of Central Point, and Ordinance No. 1221 granting the franchise requires public proceed- ings prior to any rate increases, which ordinance has been modified by supplemental Ordinance Numbers 1261, 1446, and 1481 and by Council Minute action on March 22, 1979, and WHEREAS, notices of a public hearing held on February 16, 1984 to receive testimony requesting a proposed rate increase were published in the Medford Mail Tribune on February 12, 1984 and Febru- ary 14, 1984, and. said public hearing having been held and the City Council having fully and completely reviewed said rate increase request and public testimony thereon, and WHEREAS, the City Council deems it to be in the best interest of the City to make certain rate revisions to said franchise, now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS: Section 1. McCaw Communications of Southern Oregon, doing business as McCaw Cablevision is hereby authorized to charge its sub- scribers within the City of Central Point, Oregon, in accordance with Ordinance No. ~ ~n~ - 1 the rate schedule attached hereto, marked Exhibit "A", and by this reference incorporated into the within ordinance. Section 2. The rate schedule authorized by this ordinance shall be effective on the 1st day of March, 1984. Section 3. This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, based upon a need to provide sufficient funds for continued operation of McCaw Cablevision service to the community, second reading is waived and an emergency is hereby declared to .exist. Same shall also apply to increases in cost to Licensee for service contact charges by Pacific Northwest Bell and Pacific Power 4 Light and government legislated fees, including copyright... The excess of costs of underground extension over costs of an equivalent overhead extension yielding 40 subscribers per mile are shared by the customers.) McCaw Cablevision reserves the right to waive fees or to discount charges for promotional purposes.
