AN ORDINANCE AMENDING MUNICIPAL CODE SECTION 15..16.011
TO DELETE A $5.00 INCINERATOR AND BURN BARREL PERMIT FEE
AND DECLARING AN EMERGENCY
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS:
Section 1. Section 15.16.011 of the Central Point Municipal
Code is hereby amended to read as follows:
15.16.011 Amendments. Section 27.20 of the Fire Prevention
Code is amended to read as followsa
"Section. 27.20 BURNING TRASH IN INCINERATORS AND BURN BARRELS.
The burning of trash and other materials in barrels and incin-
erators shall be permitted only upon first obtaining a permit from the
Division of Fire Prevention. Permits shall be granted annually for
the period beginning May 15 of each year. Upon application for permit,
the Division of Fire Prevention shall inspect the incinerator for
which application is made and shall issue as permit upon finding the
requirements of this section are met as follows:
(a) Incinerator to be of heavy metal. A 14 gauge screen. of
not more than one-quarter inch mesh shall be on top of the incinerator
chimney at all times during burning.
(b) All ground within ten feet of burn barrel or incinerator
must be cleared of combustible material.
A11 burning in any barrel or incinerator for the period between
May 15 and November 1 of each year shall be conducted only between day-
light and 10;00 o'clock a.m. of each day; provided,. however, that based
upon considerations of reasonable safety to life and. property, the
Division of Fire Prevention may suspend all permits for incinerators
for such period of time as unreasonable fire danger exists."
Section 2. This ordinance being necessary for the immediate
preservation of the public peace, health and safety of the City of
Central. Point, Oregon, based upon a need to implement this. ordinance
prior to the beginning of burn. season on May 15, second reading is
hereby waived, and an emergency is declared to exist and this ordinance
shall be in full force and effect immediately upon its .passage by the
Council and approval by the Mayor.
