ORDINANCE N0. 1549
AN ORDINANCE AUTHORIZING AND ORDERING THE
CONSTRUCTION OF A WATER AND SEWER SYSTEM .ALONG
LIPTON ROAD, OLD LIPTON ROAD, RAYMOND WAY, BOES AVENUE
AND TERESA WAY WITxIN THE CITY OF CENTRAL POINT,
OREGON, ASSESSING. THE COST AGAINST THE PROPERTIES
BENEFITTED 8Y SUCH IMPROVEMENTS,
AND DECLARING AN EMERGENCY
WHEREAS, the City Council heretofore by Ordinance No. 1544 has
declared its intention to authorize the improvements herein described in
accordance with plans and specifications now on file with the office of the City
Administrator, and to assess each lot adjacent to and benefitted by such improve-
ments for its.proportio`nate share of the cost thereof as provided by the Charter
of the City of Central Point, and
WHEREAS, notice of such intention has been given and published as
provided by the Charter of the City of Central Point and the laws of the State
of Oregon, and the public hearing was held thereafter in accordance with such
notice, and after hearing all testimony, whether for or against such improvements
or the assessment of the cost thereof to the adjacent benefitted properties, it
appearing to the City Council that such improvements are of a material benefit
to the City .and that all property to be assessed will be benefitted to the extent
of the probable value of the respective assessments to be levied for the cost
thereof, now, therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS:.
Section 1. It is hereby ordered that a water and sanitary sewer
system be constructed along Upton Road, Old Upton Road, Raymond Way, Boes
Avenue, and Teresa Way within the City of Central Point, Oregon, in accordance

with the plans and specifications now on file in the office of the City
Administrator and that the cost thereof be assessed against each lot adjacent
• to and benefitted by such improvements, in proportionate share, as provided by
the Charter of the City of Central Point and the laws of the State of Oregon.

Section 2. This ordinance being necessary for the immediate preserva-
tion of the public peace, health and safety of the City of Central Point, Oregon,
due to the immediate need for the use of said improvements to alleviate a health
hazard and to begin construction prior to inclement weather, second reading is
hereby waived pursuant to Municipal Code Section 2.04.020 and an emergency is
hereby declared to exist and this ordinance shall be in full force and effect
immediately upon its passage.
Passed by the Council and signed by me in authentication of its
passage this 18th day of July 1985.
