HomeMy WebLinkAboutOrdinance 1556oa \~ aa~ ~,~~''R ORDINANCE NO . 15 5 6 AN ORDINANCE PROCLAIMING THE ANNEXATION TO THE CITY OF CENTRAL 13ti~ POINT OF CONTIGUOUS PARCELS OF PROPERTY GENERALLY NORTH OF BEALL LANE, EAST OF BURSELL ROAD, SOUTH OF HOPKINS ROAD AATD WEST OF_. INTERSTATE HIGHWAY 5, MORE PARTICULARLY DESCRIBED HEREIN, AND WITHDRAWING THE SAME FROM JACKSON COUNTY RURAL FIRE PROTECTION DISTRICT N0. 3, ROGUE VALLEY TRANSPORTATION DISTRICT AND BEAR CREEK VALLEY SANITARY AUTHORITY WHEREAS, the Planning Commission of the City of Central Point has recommended that the contiguous territory described in Section '1 of this Ordinance be annexed to the City, and more than half of the owners of land in the territory, owning more than half of the real property therein, representing more than half of the assessed valuation thereof have consented in writing to the annexation, said consents having heretofore been filed with the City in the manner prescribed by law, and WHEREAS, the territory is contiguous to the City of Central Point and is situated within the Bear Creek Valley Sanitary Authority, Jackson County Rural Fire Protection District No. 3 and Rogue Valley Transporta- tion District, and WHEREAS, the City Council by Ordinance No. 1545 has dispensed with an election submitting to the registered voters of the City the question of annexing said territory and set 7:00 p.m. on July 18, 1985 in the Council Chambers of the City Hall in said City as the time, date and place of hearing thereon, and upon the special district withdrawal of said territory, at which time and place all interested persons were given an opportunity to be heard on said questions, and WHEREAS, notices of said public hearings were published and posted in the manner and for the time prescribed by law and the public hearing was duly held by and before the City Council as provided by law and by Ordinance No. 15 56 - 1 "v".. . L~ the terms of said ordinances and the published and posted notices, and WHEREAS, Municipal Code Section 17.12.060 provides that the compre- hensive plan of the City of Central Point shall determine the district into which a newly annexed area is placed, and Ordinance No. 1493 adopted on May 19, 1983, adopting said comprehensive plan, adopted as Exhibit "C" thereof a zoning map specifying the zone for the areas to be annexed herein as R-1 and R-2, .and WHEREAS, following said public hearing and after having considered all of the evidence, the City Council found that said .annexation would be in the best interest of the City, now, therefore, THE PEOPLE OF THE CITY .OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. The following described parcels of real property situated in Jackson County, Oregon: Commencing at the southwest corner of Donation Land Claim No. 58, Township 37 South, Range 2 West, Willamette Meridian, Jackson County, Oregon, thence along the centerline of Bursell Road, North 0° 04' 40" West, 75.00 feet, thence North 89° 55' 20" East 30.00 feet to the easterly right of way of said road, and the true point of beginning; thence along the southwesterly boundary of parcel described in Instrument No. 78-05208 of the official records of Jackson County,. Oregon, record South 45° 00' 20" East, 63.83 feet; thence along the north right of way of Old Pacific Highway (now known as Beall Lane) record South 89° 54' East, 2435.20 feet to a point 30.00 feet northerly when measured at right angles from engineers station 91 + 00.8 P.T.; thence continue along said right of way on the arc of a 234.63 foot radius curve to the right a distance of 237.65 feet to a point 30.00 feet northeasterly when measured at right angles from engineers station 88 + 93.5 P.C.; thence continue along said right of way (now known as Merriman Road) record South 31° 52' East, 208.78 feet to the most westerly corner of parcel described in Instrument No. 74-04788 of the official records of Jackson County, Oregon; thence North 58° 08' East, 85.35 feet to the most northerly corner thereof; thence South 31° 52' East, 86.27 feet to the most easterly corner thereof; thence North 58° 08' East, 243.00 feet to the southwest corner of Lot 16, Block 2, MORNINGSIDE SUBDIVISION UNIT N0. 1 in Ordinance No. 1 556 _ 2 ', ;, the City of Medford, Jackson County, Oregon; thence North 0° O1' 30" West 136.86 feet to the northwest corner of said lot; thence North 82° 00' East, 49.00 feet to the northeast corner of said lot; thence North, 27.45 feet to. the northwest corner of Lot 17, said Block; thence along the north line of said Subdivision and north line of MEADOWCREST VIEW SUBDIVISION, said City, North 89° 51' East, 132.3.52 feet to the northeast corner of said MEADOWCREST VIEW SUBDIVISION; thence North 0° 03' East, 175.55 feet, more or less, to intersect the southwesterly right of way line of Inter- state Highway, No. 5; thence northwesterly along said southwesterly right of way line, 2550 feet, more or less, to the westerly projection of the most northerly boundary of parcel described in Volume 382, page 250 of the Deed Records of Jackson County, Oregon; thence East, along said northerly boundary and the westerly projection thereof, 933.37 feet, more or less to the southerly projection of the southwesterly boundary of parcel described in Volume 229, page 159, said Deed Records; thence along said south- westerly boundary and the southerly projection thereof, record North 39° 21' West, 448.84 feet to the southeasterly corner of parcel described in Instrument No. 67-07010, said official records; thence record South 80° 58' 02" West, 532.50 feet to the south- westerly corner thereof; thence record North 42° 02' 38" West, 238.50 feet to the northwesterly corner thereof; thence record North 80° 58' 02" East, 545.41 feet to intersect the southwesterly boundary of parcel described in Volume 229, page 159, said deed records; thence record North 39° 21' West, 118.47 feet to the northwesterly corner thereof; thence East, 42.26 feet; thence record North 38° 00` West, 906.00 feet to the north line of Donation Land Claim No. 58, said Township and Range; thence along the north line of said claim, South 89° 57' 03" West, 1481.05 feet to the northeast corner of PITTVIEW SUBDIVISION; thence along the east boundary of said subdivision South 0° 02' 39" East, 1228.64 feet (record 1223.10 feet) to the southeast corner of Lot 24 of the AMENDED PLAT OF LOTS 3 TO 10 INCLUSIVE, PITTVIEW SUBDIVISION; thence along the south line of Lots 24 and 21, said AMENDED PLAT, West, 610.2 feet to the northeast corner of Lot 17, said AMENDED PLAT; thence South 416.70 feet to the southeast corner thereof, thence West 608.60 feet to the easterly right of way of Bursell Road; thence along said easterly right of way South 0° 04' 40" East, 1696.04 feet to the true point of beginning. be, and the same are hereby, proclaimed to be annexed to the City of Central Point, Oregon. Section 2. That the City of Central Point shall submit to the Secretary of the State of Oregon a copy of this ordinance, a copy of Ordinance No. 1 556 - 3 Ordinance No. 1545, and a copy of the complete consent documents signed by the property owners within ten (10) days of the effective day of this annexation,' report this annexation to the County Clerk, County Assessor and County Engineer of Jackson County, Oregon, and the Department of Revenue of the State of Oregon, all in the manner required by law. Section 3. The above described territory annexed to the City of Central Point is hereby withdrawn from Rogue Valley Transportation District, Bear Creek Valley Sanitary Authority and Jackson County Rural Fire Protection District No. 3, and pursuant to ORS 222.250, the City of Central Point assumes and agrees to pay the amount of indebtedness which could otherwise be extended each year against said withdrawn property, which sums shall be paid to the City by the owners of said property. The City Administrator shall forthwith file certified copies of the within ordinance with the Jackson County Assessor and with the governing bodies of Bear Creek Valley Sanitary Authority, Jackson County Rural Fire Protection District No. 3 and Rogue Valley Transportation District. Section 4. The city zoning for the above described territory annexed to the City of Central Point is hereby established as R-1 and R-2, as designated in the city zoning map adopted by Ordinance No. 1493 as Exhibit "C". Passed by the Council and signed by me in authentication of its passage this 17th day of October 1985.
