AN ORDINANCE PROVIDING FOR IMPROVEMENTS OF
' STREETS AT TIME OF PROPERTY DEVELOPMENT
AND PROVISIONS FOR DEFERRAL
~, WHEREAS, Section 16.32....020 of the Central Point Municipal
Code provides for street improvements in subdivisions, but no
other provisions exist requiring improvement of streets upon
development of non-subdivision properties adjacent thereto, and
~~the.City Council deems it to be in the best interests of the City
. ~ to require the same, now, therefore,
THE-PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS
' ,; -FOLLOWS: .
.~:.~~ There' is • hereby. added to the Municipal .Code of the City of
~Ceritral• Point Chapter' 1 2:°02 which is to read as follows:

STREET IMPROVEMENTS
`J 2.02:010 .Required... A. Any person building a building or
otherwise developing property within the City which is adjacent
to a public street, highway or alley shall, as a condition of
,~ issuance of a certificate of occupancy for said construction or
_ development; cause improvement of said street, highway or alley '
in accordance with the..same standards and requirements as are in
effect for .the creation and improvement of streets within
subdivisions, including, but not limited to, the design .standards
- il se t. forth in .Chapter 16.12 of this Code. The City building
. official is authorized to withhold issuance of a certificate of
occupancy until such improvements are complete.
°~~ B. In the event that construction occurs which is otherwise
~- . ~ subject _to Paragraph A hereinabove buts there is no street,
_ hghway~:~or-alley improvements within the same block on the same
~side~of the street, or, in the event the construction occurs
_ou=tside.an area of ordinary city blocks, in the event there are
,:.'no street,'highway or alley improvements within a distance of 100
feet of the. construction site, the city building official may
.. refer the-matter to the Planning Commission pursuant to Municipal
Cgde Section 17.72.020, and the Planning Commission may waive the

- r.e`quirement set forth in Paragraph A hereinabove, provided that

said owner shall be required to execute, as a condition of said
waiver, an irrevocable consent to the inclusion in a local
improvement district for the construction of street, highway or
alley improvements, which consent shall be recorded and run with
the land, to be binding upon any future owner of said property.
Additionally, if the adjacent street or highway is a state or
county maintained highway or road, the Planning Commission may
likewise waive the construction requirement set forth in
Paragraph A hereinabove provided said irrevocable consent is
obtained in any such case, the owner of the subject property
shall pay all costs of recording said irrevocable consent documents.
