ORDINANCE N0. 1565 AN ORDINANCE PROPOSING ASSESSMENT AGAINST PROPERTY BENEFITTED, FOR THE COST OF A WATER AND SEWER SANITARY SYSTEM ALONG UPTON ROAD, OLD UPTON ROAD, RAYMOND WAY, BOES AVENUE AND TERESA WAY WITHIN THE CITY OF CENTRAL POINT, OREGON ASSESSING THE COST AGAINST THE PROPERTIES WHEREAS, the City Council heretofore by Ordinance No. 1549 has authorized and ordered construction of a water and sanitary sewer system along Upton Road, O1d.Upton Road, Raymond Way, Boes Avenue and Teresa Way within the City of Central Point, Oregon, and to assess each lot, or portion thereof, adjacent to and benefitted by such improvements, its proportionate share of the cost thereof, and WHEREAS, said ordinance was duly posted and published as required by law, and a public hearing was held at the time and place set by said Ordinance for the purpose of considering any protest to the proposed improvements and assessments therefor, and after consideration the Council deemed the same to be of material benefit to the City and adjacent property and did order the improvement work to be done, now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. The estimated cost of the water and sanitary sewer system along Upton Road, Old Upton Road, Raymond Way, Boes Avenue and Teresa Way within the City of Central Point, Oregon is hereby determined to be the sum of $320,786.37. Ordinance No. 1565 -1 Section 2. The City Administrator is directed to serve notice of the proposed assessments set forth herein by mailing or personally delivering notices to the owners of each of the properties to be assessed as set forth in Section 2 of this Ordinance, setting forth the amount of the proposed assessment and setting the 19th day of June, 1986, as the date before which objections to such proposed assessments shall be filed. Section 4. This Ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, based upon the need for securing Bancroft Bonding at a time when interest rates are low, second reading is waived and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage by the Council and approval by the Mayor.
