HomeMy WebLinkAboutOrdinance 1651ORDINANCE NO. 1651 AN ORDINANCE VACATING TWO SECTIONS OF STREET RIGHT-OF-WAY ON OAK STREET BETWEEN SOUTH FIRST AND SOUTH FRONT STREETS ADJACENT TO TAX LOTS 1900 AND 2000 OF JACKSON COUNTY TAX ASSESSOR'S MAP PAGE 37 2W lOAA WHEREAS, Warren Cooper has requested the vacation of the two sections of street right-of-way which run east and west on Oak Street between South First Street and South Front Street within the City, and pursuant to said request, the City Council initiated vacation proceedings on its own motion pursuant to ORS 271.130, and, WHEREAS, Warren Cooper, owner of record of Tax Lot 2000, and, John E. Ousterhout, owner of record of Tax Lot 1900, both of Jackson County Tax Assessor's Map Page 37 2W 10AA, have consented in writing to said vacation, and, WHEREAS, on November 6, 1990 the Planning Commission reviewed the proposed vacation and recommended approval of the same, and, on November 20, 1990, the City Council fixed December 20, 1990 at 7:00 p.m. as the time for a public hearing on said vacation request and elected to initiate said vacation on the Council's own motion, and, WHEREAS, following requisite notice of said proposed vacation by publication and posting, certifications of which appear in the record hereof, and the Council having on December 20, 1990, held a public hearing on the proposed vacation, and WHEREAS, no written objections to said vacation were received on or before December 14, 1990 as specified in the Public Notice, and, WHEREAS, the Council finding that owners of a majority of the area affected, computed pursuant to ORS 271.080, have not objected in writing to said vacation, and the Council further finding that said vacation will not substantially affect the market value of said property, and, WHEREAS, the City Administrator, being the City recording officer, has filed in the official City records a certificate that all City liens, all taxes, and all costs associated to this vacation application have been paid by the applicant have been paid on the lands to be vacated, now, therefore, ORDINANCE NO. 1651 COOPER.VAC/RESO (02/121390) THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. The two sections of street right-of-way on Oak Street between South First Street and South Front Street within the City, a more particular description of which is attached hereto, marked Exhibit A, and which is by this reference incorporated into the within ordinance, is hereby vacated pursuant to ORS 271.130. The title of said area vacated shall attach to the lands bordering on such area in equal portions; except that where the area has been originally dedicated by different persons and the fee title to such area has not been otherwise disposed of, original boundary lines shall be adhered to and the street area which lies on each side of such boundary line shall attach to the abutting property on such sides. Section 2. The City Administrator is directed to file a certified copy of the within ordinance with the Jackson County Clerk, the Jackson County Assessor and Jackson County Surveyor, together with any maps, plats or other records required or provided for by law. Section 3. The City Administrator shall cause a certified copy of ordinance vacating said street right-of-way and any other records in regard thereto, to be recorded at the office of the office of the Jackson County Clerk. EXCEPTING THEREFROM any portion that may lie within the right-of-way of Pacific Highway No. 99 (State Highway).
