AN ORDINANCE AMENDING CPMC CHAP"fER 8.24
RELATING TO VARIANCE PROCEDURES
THE PEOPLE OF THE CITY OF CEN'T'RAL POINT' HEREBY ORDAIN AS F'OI,I:.OWS:
Section 1. CPMC Section 8.24.160 is amended to read as follows:
8.24.160 Variance procedure. A. Requests for Vaziances and Appeals -I~ea~i.
1. The City Administrator shall act as apl~l
~- hear and decide appealrequests for variances from the requirements
of this chapter.
2. The City Council cer~a~ea-sau~cil~shall heaz and decide appeals when it is alleged
there is an error in any requirement, decision or deterntination made by the cCity
aAdministrator or his/her designee in the enforcement or admurislraUon of this chapter.
3. In passing upon such applications, the City Administrator and/or the City Council
hall consider all technical evaluations, all relevant factors and
standazds specified in other sections of this chapter, and:
a. The danger that materials may be swept onto other lands to the injury of others;
b. The danger to life and property due to flooding or erosion damage;
c. The susceptibility of the proposed facility and its contents to flood damage and
effect of such damage on the individual owner;
d. The importance of the services provided by the proposed facility to the
community;
e. The necessity to the facility of a waterfront location, where applicable;
f The availability of alternative locations for the proposed use which are not subject
to flooding or erosion damage;
g. The compatibility of the proposed use with existing and anticipated development;
h. The relationship of the proposed use to the comprehensive plan and floodplain
management program for that azea;
i. The safety of access to the property in times of flood for ordinary and emergency
vehicles;
j. The expected heights, velocity, duration, rate of rise, and sediment transport of the
floodwaters and the effects of wave action, if applicable, expected at the site; and
k. The costs of providing governmental services during and after flood conditions,
including emergency services and preservation, maintenance, restoration,
replacement, and repair of public utilities and facilities.
4. Upon consideration of the factors of Section 8.24.150(A)(3), and the purposes of this
chapter, the City Administrator ca~trt~ea~eu~cil-may attach such conditions to the
granting of variances as it are deemeds necessary to further the purposes of this
chapter.
5. The cCity aAdministrator or his/her designee shall maintain the records of all appeal
actions and report any variances to FEMA upon request.
Section 2. An emergency is hereby declared to exist and tlus ordinance shall be effective
immediately.
