HomeMy WebLinkAboutOrdinance 1782ORDINANCE NO. ~-1,~3 ~ AN ORDINANCE WITHDRAWING 39.93 ACRES OF LAND BETWEEN RIDDLE AND HAMRICK ROADS FROM JACKSON COUNTY FIRE PROTECTION DISTRICT NO. 3 (Tax Map Location: 37 2W 01 C Tax Lot 800) Recitals 1. By Resolution No. 821 dated March 23, 1998, the City of Central Point uurexed a 39.9- acre parcel of land located between Biddle and 1larnrick Roads into the City. Such parcel is within the boundaries of Jackson County Fire Protection District No. 3. 2. On April 7, 1998, the Central Point Planning Commission, pursuant to CPMC 1.414.020, conducted a public hearing to consider withdrawal of such pazcel from Fire District No. 3, and whether such withdrawal would be in the best interest of the City. 3. On April 16, 1998, the City Council held a duly noticed hearing, pursuant to CPMC 1.24.020 and ORS 222.524, to consider the withdrawal, and whether such withdrawal would be in the best interests of the City. Now, therefore; THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS: Section 1. Pursuant to ORS 222-520, the City of Central Point hereby withdraws the parcel of real property described below from Jackson County Fire Protection District No. 3. Commencing at the Northeast corner of Donation Land Claim (D.L.C.) No. 56 in Township 37 South, Range 2 West of the Willamette Meridian in Jackson County, Oregon; thence South 00~ 01' 44" West (Record South OOo 01' 30" West) along the Easterly boundary of said Claim, a distance of 104.22 feet to a point on the centerline of Biddle Road, said point being the POINT OF BEGINNING of the tract to be described; thence continue South 00~ 01' 44" West (Record South OOo 01' 30" West) a distance of 60.16 feet to a point on the Southerly right-of-way line of said Biddle Road; thence continue South 00~ 01' 44" West (Record South OOo 01' 30" West) a distance of 1047.84 feet to a point on the Northerly right-of-way line of Hamrick Road; thence continue South 00~ 01' 44" West (Record South OOo 01' 30" West), leaving said right-of-way line, a distance of 30.00 feet to a point on the centerline of said Hamrick Road; thence leaving said Easterly boundary, said D.L.C. No. 56, South 89~ 50' 34" West (Record South 890 50' 30" West) along said centerline and its prolongation, a distance of 1456.75 feet to a point on the Westerly right- of-way line of said Hamrick Road, said point being on the city limits boundary of the City of Central Point as it now exists; thence North OOo 50' 06" West (Record North 00~ 50' 20" West) along said Westerly right- of-way line and said City Limits Boundary and its Northerly prolongation, 854.60 feet to a point on said Westerly right-of-way line as described in Instrument No. 94-25180, Jackson County Deed Records; thence North 120 02' 22" West along said Westerly right-of-way line, as described in said Instrument No. 94-25180, a distance of 52.98 feet; thence North fl0o 43' 46" West distance of 145.00 feet; thence North 110 41' 01" West a distance of 92.94 feet to a point on the Southerly right-of-way .line of Biddle Road as described in Instrument. No. 76-22042, said Deed Records; thence leaving said right-of-way line, North OOo 05' 17" West a distance of 62.48 feet to a point on the centerline of Biddle Road; thence North 890 54'43" East along said centerline, a distance of 205.29 feet; thence along the arc of a 11459.16 foot radius curve to the right (the long chord to which bears South 870 56' 17" East a distance of 859.80 feet) an arc distance of 860.00 feet; thence South 850 47' 17" East a distance of 438.24 feet to the Point of Beginning. 1 - ordinance No. \'~~ (041698) The City hereby assumes and agrees to pay the amount of taxes which otherwise would be extended each year against the property hereby withdrawn for the retirement of bonded debt, subject to the right of the City to obtain reimbursement therefor from the owner of said property. Section 2 The City Administrator is directed to forthwith file certified copies of the within ordinance with the Jackson County Assessor, the Jackson County Department of Public Works, and with the governing body of Jackson County Fire Protection District No. 3. Section 3. The property previously annexed and hereby withdrawn is hereby zoned in accordance with its respective zoning designation on the City's current zoning map. Section 4. This withdrawal being necessary for the immediate preservation of the public health, safety and welfare of the City of Central Point, Oregon, and based upon the need to conclude annexation procedures, second reading of this ordinance is hereby waived and an emergency is declared to exist, and this ordinance shall be in full force and effect immediately upon its passage by the Council and approval by the Mayor.
