HomeMy WebLinkAboutOrdinance 1781ORDINANCE N0. 1781 AN ORDINANCE AMENDING PARTS OF TITLE 15 OF THE CENTRAL POINT MUNICIPAL CODE RELATING TO BUILDINGS AND CONSTRUCTION THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS: Section 1. Central Point Municipal Code Chapter 15.04 is hereby amended to read as follows: CHAPTER 15.04 BUILDING CODE SECTIONS: 15.04.010 Standards applicable to building. A. All construction, building and related activities within the city shall comply with all ordinances of the city and with the following specialty codes, which by this reference are hereby expressly adopted and incorporated into this code: 1. State of Oregon 1996 Edition, Structural Specialty Code, Volumes 1, 2 and 3; based on the Uniform Building Code 1994 Edition as published by the International Conference of Building Officials; specifically adopting and including sections 102 (Unsafe Building/Structures); 104.2.6 (liability), 104.2.10 (Cooperation of Other officials and officers); A~~sndx Oha~ter 2. State of Oregon 1996 Edition, Mechanical Specialty Code; based on the Uniform Mechanical Code, 1994 Edition, as published by the International Conference of Building Officials; specifically adopting and including Appendix A (The Uniform Mechanical Standards, Uniform Fire Code Standards and the Uniform Building Code Standards contained in Appendix A); Appendix B (Chapters 10 and 15 only); Appendix C (Appendix C contains gas- venting tables and is intended to serve only as a guide); and Appendix D; 1 - ORDINANCE NO. 1781 (121997) 3. No person shall conduct building or related activities without complyir_g with the standards set forth in the codes described hereinabove in this ordinance; any violation of any provision of any of said codes shall be a violation of this code, punishable under the general penalty ordinance of the city. 15.04.020 City code administration. A. The city shall provide for the administration of a plan checking, building permit and inspection program for structural and mechanical, and for plumbing (ems) and electrical work ~f authorisec~Jay the State` Build~,ng Codes I'ia.v~.sion. This city program"is applicable to public buildings, including state buildings as well as private buildings. B. The city shall perform fire and life safety plans examinations in such cases where a partial exemption for such purposes has been granted to the city by the State Fire Marshall's office. 15.04.030 Local interpretation. In addition to the provisions of Section (3-8s) 7.t~4 2, 8I of the Structural Specialty Code and similar provisions of other specialty codes, the building official may approve a material or a method of construction not specifically prescribed by the ordinance codified herein, provided he finds that the proposed design is satisfactory and that the material, method or work offered is for the purpose intended at least the equivalent of that specifically prescribed by the ordinance codified herein, in quality, effectiveness, fire resistance, durability, safety and energy conservation, and that the Director of the Department of Commerce has not issued a report disapproving the material or method for the purpose. The building official may refer the proposed design to the city board of appeals as provided in Section (~64{-~}) 10~ of the Structural Specialty Code and a person affected by a ruling of the building official may appeal said ruling to the board of appeals within thirty days of the date of the ruling. The provisions of this section shall not be interpreted to 2 - ORDINANCE NO. 1781 (121997) preclude a person from requesting a ruling from the Director of the Department of Commerce prior to submitting an application to the city for a permit or withdrawing a previously submitted application. 15.04.040 Board of appeals. The building official shall be an ex officio non-voting member and shall act as secretary of the board. The board shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the building official with a duplicate copy to the appellant. The administrator of the State Building Codes Division shall be furnished copies of decisions interpreting state building code requirements." 15.04.050 Violations and penalties. It is unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, convert or demolish, equip, use, occupy or maintain any building or structure in the city, or cause the same to be done, contrary to or in violation of any of the provisions of the ordinance codified in this chapter. It is unlawful to construct or maintain within the city of Central Point a swimming pool, as herein defined, in violation of the terms of this chapter. 15.22.020 Swimmino pool defined. For the purposes of this chapter a "swimming pool" is defined as any structure designed and constructed to contain eighteen inches or more in depth of water. 15.22.030 Setback requirements. indicate the minimum setback reauiren The following measurements is for a swimmina pool: 5 - ORDINANCE NO. 1781 (121997) Section 4. Central Point Municipal Code Chapter 15.22 is hereby amended to read as follows: (A-) P,. Front: No less than twenty feet from edge of water to property line contiguous with street right-of-way; (~) C Side: No less than five feet from edge of water to property line or twenty feet from edge of water to property line contiguous with street right-of-way; (~-) I?.: Rear: No less than five feet from edge of water to property line or twenty feet from edge of water to property line contiguous with street right-of-way; (~) E. Building: No less than ten feet from edge of water to foundation line. The foregoing setbacks shall be in addition to any easements; any swimming pool decks shall not encroach into any easements. 15.22.040 Fence requirements. A fence shall be required completely surrounding a swimming pool no less than (tl~r~ee~ ......................................... ~) £xxrt~r-eight inches in height above the surrounding ground with openings, `holes and gaps no larger than four inches in any dimension. A dwelling or accessory building may be used as a part of such enclosure. All gates thereto shall be self-closing and shall be equipped with a self-latching device to secure the 15.22.060 Fees. The City of Central Point Building Department Building Valuation Data and Fee Schedule, attached hereto as Exhibit ~~A~', is hereby adopted as this jurisdiction's fee schedule Such fee schedule shall be effective on July 1, 1998. Section 9. An emergency is hereby declared to exist, and this ordinance shall take effect immediately upon passage; provided that, all provisions of this ordinance that constitute revisions to existing fees shall not take effect until July 1, 1998.
