HomeMy WebLinkAboutOrdinance 1804ORDINANCE NO. ~ 8O`1 AN ORDINANCE WITHDRAWING 8.23 ACRES OF LAND FROM THE SOUTHEAST CORNER OF TAYLOR AND GRANT ROADS FROM JACKSON COUNTY FIRE PROTECTION DISTRICT N0.3 (Tax Map Location: 37 2W IOBB Tax Lot 300) Recitals 1. By Resolution No. 848 dated April 8, 1999, the City of Central Point annexed an 8.23 acre parcel of land located on the southeast corner of Taylor and Grant Roads into the City. Such parcel is within the boundaries of Jackson County Fire Protection District No. 3. 2. On May 4, 1999, the Central Point Planning Commission, pursuant to CPMC 1.414.020, considered the withdrawal of such parcel from Fire District No. 3, and whether such withdrawal would be in the best interest of the City. 3. On May 13, 1999, the City Council held a duly noticed hearing, pursuant to CPMC 1.24.020 and ORS 222.524, to consider the withdrawal, and whether such withdrawal would be in the best interests of the City. Now, therefore; THE PEOPLE OF THE CITY CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS; Section 1. Pursuant to ORS 222-520, the City of Central Point hereby withdraws the parcel of real property described below from Jackson County Fire Protection District No.3. Commencing at the norUnvest corner of Donation Land Claim No. S3 in'iownship 37 South, Range 2 West of the Willamette Meridian in Jackson County, Oregon, thence South Oo04'20" West 495.80 feet (record South 495.72 feet) to the true point of beginning; thence continue South 004'20" West t 53.00 feet to a point (from which the brass disc found set in concrete for the initial point of WEST PINE VILLA SUBDIVISION (Recorded) beazs South 004'20" West 268.93 feet); thence West along the north boundary of tract described indeed recorded as No. 75-17558 of the Official Records of said County, 691.16 feet to the easterly right-of--way of Grant (County) Road; thence West 30 feet to the centerline of Grant Road; thence along said centerline, North 208' I O" East 647.14 feet to the centerline of Taylor (County) Road; thence along said centerline, North 8949' I S" East 467.70 feet; thence South 30 feet to a 5/8" iron pin found set for the northwest corner of tract described in Volume 570 Page 482 of the Deed Records of said County, thence South 0~ 10'45" East 40.00 feet to the southwest comer of said tract; thence North 8949' 15" East 22.00 feet to the southeast corner of said tract; thence North 0~ t 0'45" West 40.00 feet to the northeast comer of said tract; thence North 30.00 feet; thence along the said centerline of Taylor (County) Road, North 8949' I S" East 33.61 feet; thence South 30 feet to a 3/4" iron bolt found set for the northwest comer of tract described in Volume 427 Deeds page 130; thence along the west boundary of said tract, South 80.00 feet; thence along the northwesterly boundary of said tract, South 2445' West 80.00 feet; thence along the southwesterly boundary of said tract, South 33°42'30" East 375.78 feet (Record 376.90 feet) to the true point of beginning. The City hereby assumes and agrees to pay the amount of taxes which otherwise would be extended each year against the property hereby withdrawn for the retirement of bonded debt, subject to the right of the City to obtain reimbursement therefor from the owner of said property. Section 2. The City Administrator is directed to forthwith file certified copies of the within ordinance with the Jackson County Assessor, the Jackson County Department of Public Works, and with the governing body of Jackson County Fire Protection District No. 3. Section 3. The property previously annexed and hereby withdrawn is hereby zoned in accordance with its respective zoning designation on the City's current zoning map.
