A RESOLUTION GRANTING APPROVAL OF A TENTATIVE. PLAN
FOR UNIT N0. 4 OF JACKSON CREEK ESTATES SUBDIVISION
(Applicant: Tom Malot Construction Co.)

Recitals
1. On May 8, 1992, Tom Malot, on behalf of Tom Malot
Construction Co. submitted a Tentative Plan Application for Unit
No. 4 of Jackson Creek Estates Subdivision, located in the
southwest quadrant of the City.
2. On June 2, 1992, the Central Point Planning Commission
reviewed the application and. by Resolution No. 239 recommended
approval.
3. On June 1$, 1992, the Central Point City Council
conducted a public hearing on the application, reviewed the
planning commission. recommendation and City Staff Report, and
heard testimony and argument on the application.
Now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. Auproval Criteria. The criteria for approval of
this application are found in CPMC Chapter 16, relating to
tentative plans and subdivisions, and in Chapter 17 relating to
lot sizes.
Section 2. Findings and Conclusions. The City Council
finds and determines as follows:
A. Tentative Plan Requirements. The application and
tentative plan herein are in the correct form and contain all of
the information required for the same under CPMC Chapter 16.10.
B. Area and Width of Lots. The application is for approval
of a 27-lot subdivision in an R-1-8 zone, with lots ranging in
area from 8,000 to 13,084 square feet, which area sizes satisfy
the R-1-8 lot size requirements of 8,000 square feet for interior
lots and 8,000 square feet for corner lots found in CPMC
17.20.050. The minimum width requirements of CPMC 17.20.050 are
also met, with interior lots at least 60 feet wide and corner
lots at least 70 feet wide.

C. Blocks and Streets. The tentative plan proposal for the
layout and dimensions of streets and blocks is in compliance with
the requirements of CPMC Chapter 16.20 regarding streets and CPMC
Chapter 16.24 regarding blocks.
D. off-Site Improvements. The Council makes the following
findings and determinations:
1. This subdivision development will add substantial
traffic to Beall Lane, and it is therefore reasonable to require
Developer to make certain off-site improvements to Beall Lane, as
set forth in Section 3 below.
2. The off-site improvements required are reasonably
related to the development and will serve the public purpose of
mitigating increased traffic on Beall Lane. as a result of the
development.
Section 3. Conditional Approval. The application for
tentative plan approval for Unit No. 4 of Jackson Creek Estates
Subdivision is hereby approved, subject to the following
conditions imposed under authority of CPMC 16.10.090:
Conditions
1. Developer shall dedicate an additional 10 feet
of right-of-way on the north side of Beall Lane adjacent to the
project site. In addition, Developer shall improve Beall Lane in
that area so that the existing 16 foot half street section
between center line and edge of pavement is widened to 24 feet as
measured from center line to the new curb face. Said improvement
shall include the installation of curbs and gutters., storm
drainage, utility crossings, street improvements, street lights
and connecting sidewalks.
2. All roof drains, area drains, and crawl spaces
shall have positive drainage away from the structure, and shall
be connected to a curb drain or an approved storm sewer.
Developer shall provide a finished floor elevation and property
topographic information for each lot as part of the construction
drawings for this subdivision.
3. Developer shall provide, at Developer's
expense, a "right turn only" refuge lane to the entry of the
subdivision from westbound traffic on Beall Lane.
4. The driveway accesses to Lots 148 and 149
shall be from Brandon Street at the farthest point away from the
intersection of Beall Lane and Brandon Street.

5. According to the 1979 Water Master Plan
completed by CH2M Hill, a 12" waterline is to be constructed as
part of the Water Systems Improvements. Developer shall
construct a 12" waterline along the Beall Lane portion of this
subdivision.
6. This property is located in the Griffin Creek
Discharge Basin. Developer shall design the Storm Drainage
System so as to meet the Total Maximum Daily Loadings (TMDL's)
established by DEQ for the Bear Creek Water Quality Area.
Developer's Engineer shall submit the requested data for review
at the time construction plans are submitted for permits.
Developer shall be responsible for the cost of the improvements
required as a part of this condition.
7. A Traffic Control Signing Plan shall be
included as a part of the final construction plans, and will be
installed by the City and all costs associated with Traffic
Control Sign installation shall be paid for by the Developer.
8. A Street Lighting Plan shall be included in
the construction documents according to all the requirements of
the Central. Point Public Works Department. All intersections
shall be illuminated and all local streets shall have a minimum
street lighting spacing of 200'. Developer is to install all
pads and conduits for street lights as part of the construction
of the Subdivision. Developer shall also pay for street lights
and for the installation thereof in the subdivision.
9. A soils engineer must evaluate the strength of
the soil (R-Value) to determine the street section design. The
City's Engineer shall be used., and Developer shall pay for the
costs of these services. Beall Lane shall be designed for a
minimum 20 year life, given a daily traffic volume of 10,000
vehicle trips per day and 10~ truck traffic.. Brandon Street
shall be designed for a minimum 20 year life, given a daily
traffic volume of 2,000 vehicle trips per day, and 2$ truck
traffic. The remaining streets in this phase of the subdivision
shall be designed for a 20 year life, 1,000 vehicle trips per
day, and 20 truck traffic.
10. Developer shall construct on the north side
of Beall Lane an extension of the box culvert carrying Griffin
Creek under Beall Lane, so as to accommodate the widening of
Beall Lane. Such extension shall be constructed as part of the
subdivision improvements, according to specifications set forth
by the City.
