HomeMy WebLinkAboutOrdinance 1839ORDINANCE NO. ~~ <~~ AN ORDINANCE AMENDING THE CENTRAL POINT ZONING CODE TEXT TO CREATE TWO NEW ZONING DESIGNATIONS FOR PARKS ?3< OPEN SPACE AND CIVIC USES RECITALS: 1. The City of Central Point ("City") is authorized under Oregon Revised Statute (ORS) Chapter 197 to prepare and adopt comprehensive plans and implementing ordinances consistent with the Statewide Land Use Planning Goals. 2. The City has coordinated its planning efforts with the State in accordance with ORS 197.040 (e) and OAR660-030-0060 to assure compliance with goals and compatibility with City and County Comprehensive Plans. 3. Pursuant to authority granted by the City charter and the Oregon Revised Statutes, the City has determined to amend the Centra! Point Zoning Text which was originally adopted on August 29, 1980, and has been amended at various times since then. 4. Pursuant to the requirements set fort in CPMC Chapter 1.24 and Chapter 17.96, the City has conducted the following du{y advertised public hearings to consider the proposed amendments: (a) Citizen's Advisory Committee hearing on July 15, 2003. (b) Planning commission hearings on August 19, 2003. (c) City Council hearings on October 9, 2003 and October 23, 2003. Now, therefore; THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS: Section 1. At its public hearing on October 9, 2003, the City Council received the findings of the Citizen's Advisory Committee and the Planning Commission, received the City Staff Report, and received public testimony from all interested persons. Based upon all the information received, the Cify Council adopts the findings and conclusions set forth in the Civic Zoning Designation and Parks and Open Space Designation proposal, Applicable Review Criteria, and based upon the same, the City Council.finds that there is sufficient public need and justification for the proposed changes, and the proposed changes are hereby adopted entirely. Section 2. The City Zoning Code is hereby amended asset forth on Exhibit "A" the Civic ,Parks and Open Space Zoning Code Text and the Use Categories Table, with changes through October 23, 2003, including all attachment to said exhibit, which are attached hereto and by this reference incorporated herein. Section 3. The City Administrator is directed to conduct post acknowledgment procedures defined in ORS 197.610 et seq. Upon adoption of the changes to the zoning text. Mayor Hank Williams 2 -Ordinance No. l ~ ~ _ ~ippg2pp3~ Exhibit"A" CIVIC ZONING PURPOSE "The purpose of the Civic District is to have a corresponding zone for the public and quasi-public land use categories in the Comprehensive Plan, A specific zoning district ensures future development locations for civic uses; such as public schools, public (federal, state, and local) buildings, hospitals, cemeteries, churches and fraternal organizations: LOCATION Civic zones aze located throughout the City including the Transit-Oriented Development (TOD) District. New sites for civic uses will be designated as sub-azea master plans aze prepared and adopted by the City or as municipal buildings and uses aze identified and developed. LAND USES AND BUILDING TYPES The intent of this zoning category is to allow for necessary civic uses in the community, such as schools, post offices, city and county ofE~ religious institutions, public utility yards and similaz uses. The uses allowed aze considered to be compatible with the residential neighborhoods that generally surround them. Institutions such as colleges, hospitals, rehabilitation centers, churches and fraternal meeting halls, which can have a wider range of potential impacts, aze subject to conditional use review. CIVIC USE TYPES Community services. Uses that aze of a public, non-profit, or charitable nature and which provide a local service to people of the community aze considered to be community services. Generally, they have employees at the site on a regulaz basis. The service is ongoing, not just for special events. Community centers or facilities aze open to the general public or have membership provisions that are open to the general public to join at any time (for instance, any senior citizen could join a senior center). The use may also provide special counseling, education, or training of a public, nonprofit, oc charitable nature. Examples include libraries, museums, senior centers, community centers, publicly owned swimming pools, youth club facilities, hospices, drug and alcohol centers, social service facilities, vocational training for the physically or mentally disabled, cemeteries, crematoriums, and mausoleums. 3 - Ordinance No. ___ (10092003) I3ospital. A use that provides medical or surgical cart to patients and offers overnight care. Public facilities. Public uses that provide support, transportation, safety, and emergency services to the general public. Examples include police stations, fire stations, ambulance stations, public utility offices, operations centers, transit stations, and park-and-ride facilities for transit. This definition excludes streets. Religious assembly. Institutions that are intended to primarily provide meeting azeas for religious activities, Examples include churches, temples, synagogues, and mosques. Schools. Public and private kindergarten, primary, elementary, middle, junior high, or high schools that provide state mandated basic education and colleges and trade schools. Utilities. Infrastructure service centers aze civic uses that need to be located in or near the azea where the service is provided. Basic utility uses generally do not have regular employees at the site but could. Services may be publicly or privately provided. Examples include water and sewer pump stations; electrical substations; water towers and reservoirs; storm water retention and detention facilities; state and city maintenance yards; telephone exchanges; and recycling drop-off. This definition excludes wireless communication facilities and structures as defined in this chapter. 4 - Ordinance No. ~_ ~10092pp3~ PAItI~,S AND OPEN SPACE ZONING rURPOSE The purpose of the Parks and Open Space District is to provide necessary open space for the community and to protect environmentally sensitive azeas that have a corresponding designation for their public land use category in the Comprehensive Plan. LOCATION Parks and Open Space zones aze located throughout the City including llrc Transit-Oriented Development (TOD) District. New sites for Parks and Open Space uses will be designatod as sub-azea master plans are prepared and adopted by the City. LAND USES AND BUILDING TYPES The intent of this zoning category is to allow for needed park and/or riparian uses in the community, such as active and passive recreation areas, bike and pedestrian paths, dual purpose flood detention azeas, and similaz uses. Structures such as tennis and basketball courts, play equipment, gazebos and restrooms are envisioned. The uses allowed are proposed to be compatible with the residential neighborhoods that generally surround them There maybe instances where parks aze integrated into commercial and industrial azeas as well. Any uses that can have a wider range of potential impact are subject to coadiGonal use review. PARK AND OPEN SPACE USE TYPES Parks and Open Space. Public or private land Drat is primarily left in a natural state or that is landscaped and has few structures. Examples include parks, playgrounds, golf courses, public squazes or plazas, recreational trails, botanical gazdens, and nature preserves. Bear Creek Greenway A regionally significant azea extending from Central Point to Ashland.
