AN ORDINANCE AML;NDING CHAP"fERS 2.52 AND 13.04
OF THE CL;NTRAL POINT MUNICIPAL CODE
REGARDING ADMINISTRATIVE AND UTILITY FEES
THE PEOPLE OP THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS:
Section 1. Chapter 2.52 of the Central Point Municipal Code is amended as follows:
2.52.010 Dishonored checks. When any fee, fine or other payment is made to the city by any
person by check, and such check is dishonored by the bank upon which-rs it was written for insufficient
funds having been on account, a processing fee of €cve twenty dollars shall be added to the fee, fine or
other sum due the city for each check thus returned, and the processing fee shall be subject to
collection in the same manner as the underlying fee, fine or other sum due.
Section 2. Chapter 13.04 of the Central Point Municipal Code is amended as follows:
13.04.030 Utility service deposit. No prepayment ors for utility service shall be
required of any applicant who is the owner ofthe property to be served, but a deposit in the amount of
twentyth~dollarsforeachdweHingpremisesservedshallberequiredofallotherapplicants. Should
utilityservicebeterminatedfornon-~aymentofutilit~ges the utility customerwillberequiredtopay
an additional thirty dollar deposit nrior to resumption ofutility service This additional deposit will be
charged for each termination for non-payment ofutility charges until the deuosit balance at aminimum
equals the balanceoftheunpaidutilityaccount Thisdeposittnaywillbeappliedtoeithertheunpaidwater
ersevaer balance ofthe utility accouirts when the customer terminates utility service Any remainder from
the application of the utility service deposit will be returned to the customer
13.04.060 Payment due date-Delinquent charges and Rreconnection fees. All ~+atet~ utility
charges and connection fees shall become due on the first day ofthe month following the meter reading date
and, if unpaid, shall become delinquent on the tenth day of the month thereafter and subject to both a
delinquent charge and disconnection ofservice. A delinquent charge offive dollars shall be added to any
cdatcrvil utility account which is delinquent more than sixty ten days and has abalance due oftwenty
dollars or more. Accounts delinquent more than thirtydays shall be notified ofthe city's intention to
terminate service in accordance with Section 13 04 110 ofthis chapter A ten dollar processing fee shall
be added to the utility account in this event. If vaatet~ utili service is actually discontinued then a
reconnection eharge fee offtve twen dollars shall be paid charged for reconnection of a service which has
been disconnected fornon-payment of•~d~roill utility charges ifthe reconnectioneeenrs work order is
issued between eight a.m. and f~rve four p.m. on weekdays, and aeharge fee often forty dollars shall be
paid charged forreconnection ofaservice which has been disconnected for nonpayment of~vater-Hill utili
charges if the reconnection eeenrs work order is issued between €tve four p.m. and eight a.m. or on
weekends or holidays.
13.04.110 Unpaid accounts. In the event oflmpaid charges for water utility service, connecting
service or reconnecting service, the city may terminate service

A. Termination of Service. In the event the city intends to-empty-rt
to terminate service because ofarr unpaid account, the following procedure
shall be followed:
1. A notice shall be sent to the owner of the property, at the address on record with the
county tax assessor, and to the customer at the address to which billings have been mailed and at tlae
address ofthe premises where the service is provided; provided, however, that ifthey any ofthe addresses
are the same, only one notice need be sent to that address .
2. The notice shall state the city's intention to terminate service
a~~~ ten days after the date of the mailing of the notice, and shall also contain the following
language: "Ifyoufeelthatthereisamistakeonthebillorifyouwishtodisputetheamountofthebill,or
you wish to dispute the termination of service, you may do so by appearing at the customer counter at
Central Point City Hall during designated office hours prior to the expiration of3810 days from the date
of the mailing of this notice."
3. In the event a customer remonstrates against the intended
termination of service, the city administrator orhis/her designee shall provide an opportunity to the customer
to be heard in a conference prior to the termination of service.
4. The city administratororhis/herdesigneeshall,followingthepassageoftendaysfromthe
date ofthe mailing ofsaid notice, or following the conference referred to hereinabove ifone is requested
and attended, or following the date scheduled for the conference if one is requested and the customer fails
to attend, have the authority to terminate service upon a finding
that the charges have been accurately stated and have remained unpaid for a period of more than thirty
days after the earliest of the charges was billed.
