Also present were Jim Bennett, Planning Director, Ken Gerschler, Planning Technician, Paul Worth, Public Works Technician, and Arlene LaRosa, Public Works Technician. III. CORRESPONDENCE There was no correspondence IV. MINUTES Commissioner Gilkey made a motion to approve the Minutes of August 5, 1997 as written. Commissioner Curtis seconded the motion. ROLL CALL: Curtis, yes; Dunlap, yes; Gilkey, yes. V. PUBLIC APPEARANCES There were no public appearances. VI. BUSINESS A. Paul Worth reviewed the Public Works Staff Report. Paul stated that there were some discussions with the applicant after this staff report was written. He stated that on page 13, first paragraph, the "additional 14-foot dedication for right-of-way" along Haskell Street has been changed to "additional 10- foot dedication for right-of-way' along Haskell as a result of the discussions. Also, on page 12, last sentence should read: "Additional right-of-way dedication will be needed for the development and improvement of the southeast comer radius of the intersection of Haskell and Taylor Streets and the Northeast corner radius of the intersection of Pine and Haskell Streets to accommodate a W-67 truck turning movement." Jim Bennett stated that they met with Mr. Reitmann earlier this week. He stated that the City needs 10 to 15 feet from property owners on both sides ~,uy ~i ~.cuuai rvuu Planning Commission Minutes August 19, 1997 -Page 2 of Haskell to achieve an 80 to 88 foot right-of-way for expansion of the street. A 10 foot dedication from Mr. Reitmann will be adequate. Steve Reitmann, 3697 Highway 238, Jacksonville, OR, applicant, stated that the entrance off Pine on Amy will be stay one-way in only. He stated that the Public Works conditions call for a pretty massive landscaping plan. They will be doing landscaping on this phase and he feels that is adequate. As the rest of the property is developed landscaping will be required. As they progress in the next three to five years they will establish plantings and landscaping. He stated that if they have to do all the street improvements on Haskell as required by Public Works it would make the project cost prohibitive. Jim Bennett stated that the City has to show a direct relationship between the improvements that are required and the impacts from the proposed development. The impacts from what Mr. Reitmann is proposing are minimal compared to the street improvements needed for Pine and Haskell. The City will have to find a way to work the improvement of those two streets into our Capital Improvement Program or take advantage of whatever funding is available from other sources. There will be State funding later to work specifically on the intersection area of Haskell and Pine. Commissioner Gilkey made a motion to adopt Resolution 396 approving a Site Plan Review for Quality Fence Co. 114 W. Pine St. (M-1 zone) (37 2W 10AB Tax Lots 100 through 500; 37 2W 10AA Tax Lots 5700 & 5900) (Steve Reitmann, applicant) with the conditions that the applicant enter into a Deferred Improvement Agreement with the City for curb, gutter and sidewalks along Pine and Haskell Streets, that the landscaping along Haskell and Pine Streets be deferred until further development on the property, and including all conditions of the staff reports and other staff comments. Public Hearing -Review and decision regarding a Site Plan Review and a Conditional Use Permit to allow the operation of anon-profit youth center 30 S Third St (C-2 Zone x(37 2W 03DD Tax Lot 11700)~Hope Christian Church, applicant. There were no conflicts of interest or ex-parte communications. McPhail, 747 Highland Drive, Medford, agent for the applicant, came forward and reviewed the changes to be made to the fire station. Chairman Piland closed the Public Hearing. Commissioner Curtis made a motion to adopt Resolution 397 approving a Site Plan Review and a Conditional Use Permit to allow the operation of a non-profit youth center, 30 S. Third St. (C-2 zone) (37 2W 03DD Tax Lot 11700) (Hope Christian Church, applicant) subject to the conditions of approval in the staff reports and staff comments. Motion was seconded by Commissioner Dunlap. ROLL CALL: Curtis, yes; Dunlap, yes; Gilkey, yes. Chairman Piland declared a recess at 9:54 p.m. Chairman Piland called the meeting back to order at 9:57 p.m. C. Review and recommendation regarding a Zone Map Amendment from R-1-8, Residential Single-Famil~j8 000 s f) to R-1-6 Residential Single-Family (6 000 s f) for 12 96 acres located east of North 10th Street and south of Upton Road. f37 2W 03AA Tax Lots 4000 & 4100) (Terry Buntin applicant) Jim Bennett reviewed the Planning Department Staff Report Mike LaNier, 336 W. 6th Street, Medford, OR, agent for the applicant, stated that there are approximately 58 lots but only 53 lots are buildable for this subdivision. The owner of the property, Mr. Lathrop, will keep two parcels and one 10,000 s.f. lot will be used as a detention pond area. He stated that there are errors in the Findings of Fact and he will amend these Findings of Fact and send it to the City on Friday. He reviewed the errors and changes to be made. He stated the storm drainage in the area has been studied and reviewed and there will be an additional pipe that goes around the existing embankment and connects directly to the culvert that goes under the freeway. There will be two pipes, one that goes under and one that goes around the Upton embankment. Terry Buntin, 2811 Leonard Avenue, Medford, OR., stated that the detention area is being designed as open space. Dorothy Bernhard, 1340 Vista Way, Central Point, stated that she is concerned about the traffic impact on 10th Street, flooding, and the size of the lots. Dave Komstad, 1011 Crest Drive, Central Point, wrote a letter which was entered as testimony. He also expressed a concern about the traffic on Vista. Mike LaNier stated that the applicant is targeting a housing market of $105,000 to $115,000. Two-thirds orthree-fourths of the traffic will be using 10th Street and Planning Commission Minutes August 19, 1997 -Page 4 a good portion will use Vista. Ernie Lathrop, 1750 Scenic Avenue, Central Point, stated that his family has owned this property since 1923. It is not swamp land. It has been farmed since 1943. Terry Buntin stated that Mr. Wilbur Eicher will keep lot 58 and Mr. Ernie Lathrop will keep lots 36 and 37. Commissioner Dunlap made a motion to recommend approval of the Zone Map Amendment from R-1-8, Residential Single-Family (8,000 s.f.) To R-1-ti, Residential Single-Family (6,000 s.f.) for 12.96 acres located east of North 10th Street and south of Upton Road. (37 2W 03AA Tax Lots 4000 & 4100) (Tent' Buntin, applicant) D. Public Hearing -Review and decision regarding a Tentative Plan for Summerfield Subdivision a 63-lot single-family residential subdivision (R-1 -6 zone) (37 2W 03AA Tax Lots 100 4000 & 4100~(Terry Buntin applicant) There was no conflict of interest or ex-parte communication Jim Bennett reviewed the Planning Department Staff Report. Jim stated that 10th and Upton has been recognized in the City Comprehensive Plan. Those two streets need to be realigned. The applicants have been working with their engineer to provide an acceptable design to the city and Jackson County to provide traffic control at both of those intersections. Paul Worth reviewed the Public Works Department Staff Report. Commissioner Dunlap made a motion to extend the Commission meeting after 10:00 p.m. Commissioner Gilkey seconded the motion. Everyone said "aye" and the motion passed. Terry Buntin stated that the ditch running through the property is wetlands and is being delineated. The new sewer pumping station will be on one corner of Lot 10 and the flow line will be 17 feet deep. He stated that they have redesigned Upton and 3rd and there will be two "T" intersections. Applicant stated that he would like to request that the improvements on 10th Street be deferred as well as those along Upton Road as stated in Item 3, second paragraph, on page 6 of the Public Works Staff Report. He stated that they will be putting a fence all along 10th and possibly Upton. There will be a minimum of a 4 to 6 foot berm along I-5 Freeway and a wooden fence on top of that. Paul stated that the Public Works Department would prefer to not defer the improvements along 10th Street. Planning Commission Minutes August 19, 1997 -Page 5 Mr. Buntin stated that they were not required to make the improvements to the intersections; they were only to provide the design for the realignment. However, the improvements all along 10th will be very expensive. He stated he would be willing to do a portion of it. When the intersections are realigned any improvements done along the road may have to be taken out. Dave Hammond, Hammond Engineering, 31 Newtown, Medford, OR, the engineer for the applicant, discussed the sewer pumping station, the storm drainage system, and the deferment of the street improvements along 10th Street. Mr. Lathrop stated that it would be logical for him to develop lots 36 and 37 at the same time that Mr. Buntin develops the subdivision, which is what he has agreed to do. Mr. Wilbur Eicher, 1340 Vista Dr., Central Point, asked who would be responsible for up-keep at the end of the storm drain the going to the creek. Jim Bennett stated that Jackson County and ODOT have jurisdiction in that area. Chairman Piland closed the Public Hearing. Commissioner Gilkey made a motion to adopt Resolution 398 approving the Tentative Plan for Summerfield Subdivision, a 58-lot single-family residential subdivision (R-1-6 zone) (37 2W 03AA Tax Lots 100, 4000 8~ 4100} (Tent' Buntin, applicant) subject to the findings of fact and conclusions of law, and including a Deferred Improvement Agreement for improvements on 10th Street and Upton Road until the streets are widened, with the provision that the City may demand construction of improvements specified on the Deferred Improvement Agreement at any time if conditions make it necessary in the opinion of City Staff, with a maximum time limit on the Agreement of 5 years. ff the Agreement needs to be extended beyond 5 years it will come back before the Planning Commission. Commissioner Dunlap seconded the motion. ROLL CALL: Curtis, yes; Dunlap, yes; Gilkey, yes. VII. MISCELLANEOUS Jim Bennett reviewed future agendas for the Planning Commission. Commissioner Gilkey stated that Wayne Christian discussed the possibility of making a park along Horn Creek on his Country Meadows subdivision. VIII. ADJOURNMENT Commissioner Dunlap made a motion to adjourn. Commissioner Gilkey seconded the motion. All said "aye" and the meeting adjourned at 11:10 p.m.
