PLANNING COMMISSION
MINUTES
AUGUST 5, 1997
I. MEETING CALLED TO ORDER AT 7:00 P.M.
11. ROLL CALL: Chuck Piland, Angela Curtis, Jan Dunlap, Candy Fish, Bob Gilkey,
Karolyne Johnson, Valerie Rapp. Also in attendance were Jim Bennett,
Planning Director, Ken Gerschler, Planning Technician, Lee Brennan, Public
Works Director, and Arlene LaRosa, Public Works Secretary.

There was no correspondence.
IV. MINUTES
Commissioner Gilkey made a motion to approve the minutes as written.
Commissioner Fish seconded the motion. ROLL CALL: Curtis, yes; Dunlap, yes;
Fish, yes; Gilkey, yes; Johnson, yes; Rapp, yes.
V. PUBLIC APPEARANCES
There were no public appearances.
Vt. BUSINESS
A. ('ontinued Public Hearing Review and decision regatdltlg a Tentative

There were no conflicts of interest or ex-parte communication.
Jim Bennett reviewed the Planning Department Staff Report.
Lee Brennan reviewed the Public Works Staff Report. Lee stated that
Item 15 on Page 32 of the Staff Report could be deleted if the new
setback ordinance, Item F on the agenda, is passed.
Wayne Christian, 2821 Bullock Road, Medford, applicant, stated there
were several issues he had concerns about:

(1) He would like permission to cut the project down to about 6 phases.
He stated that his engineers can show that there would be sufficient
water by picking up at the 12" line on Pine Street, bringing it through the
proposed subdivision to Quail Meadows and back to Donna. Because of
other items that have to be done he cannot afford the cost of putting a
water line all the way to Beall Lane. He stated he would like to work with
the City to solve the problem of filling the reservoir.
(2) Flooding and water retention on Horn Creek. Hardey Engineering has
done a study of Horn Creek.
Eric Johnson, Hardey Engineering, 1600 Skypark Circle, Medford, stated
they would be mitigating the water runoff from this subdivision by
possibly putting two retention ponds on the property.
(3) Traffic along Grant Road
Tom Holmes, Hardey Engineering, 1600 Skypark Circle, Medford,
reviewed the Traffic Study done by his firm and indicated there would be
no change in the level of service for the intersections of Beall Lane &
Grant Road, and Taylor and Grant Roads as the result of the proposed
development.
(4) Storm access to clean creek - He stated he does not feel the City
needs to be cleaning the creek. City ordinances state that the property
owner is to clean the creek.
(5) Landscaping Buffer: Mr. Christian questioned who would be
maintaining the buffer. He stated he would prefer to fence the property
that borders the right-of-way Grant Road and not install a landscape
buffer.
(6} A given set of rules: Mr. Christian stated that since the "Green Book"
is being changed gradually, he wanted the commission to pick a point
and let him design his subdivision by the rules that are current at that
time.
Lee Brennan stated that there is a cost sharing provision on page 36,
Item 10 for the needed water line. He stated that the city is not asking
Mr. Christian to mitigate all of the flood waters passing through the
property, but just his subdivision and its affect on the flooding and
surrounding properties.

lee Brennan stated that (tem 7 on Page 30 can be deleted. The traffic
study covered it and it was verified with Mr. Neimeyer of Jackson County
Road and Parks Services. Lee also stated that the city would like to add
a condition that a pedestrian access be created between Bachand Circle
and Diego Court possibly overlaying a P.U.E.
Lee Brennan stated that the City desires to maintain emergency access to
the creek for flood mitigation work, as was demonstrated on Griffin Creek
between the two storm events of the New Year's Day flood; and that the
requirement for the landscape buffer was at the discretion of the
commission and was suggested by the Public Works Department as a
buffer to the rural lands adjacent to the proposed development. He also
stated that the City would maintain the landscape buffer once it is
accepted by the City.
Christy Devilleneuve, 209 Donna Way, Central Point, stated she was a
representative of neighbors on Donna Way. She outlined a request to
designate certain lots in the subdivision as a wetlands to alleviate the
flooding problem. She stated that the development should have the 35`
setbacks that were in effect when the subdivision plans were submitted.
She gave a copy of a letter to the Commission from Russell Robe, 107
Donna Way, Central Point and it was entered into record. She also stated
that neighbors are requesting that all of the houses to be built on the lots
adjacent to Donna Way be one-story.
Commissioner Rapp stated that she was concerned about the lack of a
Water Master Plan and the commission should look at putting a
moratorium on subdivisions until the water situation is under control.
Commissioner Rapp left the meeting at 9:03 p.m.
The following came forward in opposition to the application:
Neal Whiteford, 900 Jackson Creek Drive, Central Point.
Gary Meyers, 95 Donna Way, Central Point.
Mike Williams, 34165 Hanley Road, Central Point.
Jack Slazak, 207 Donna Way, Central Point.
Stephanie Peterson, 65 Donna Way, Central Point.
Wayne Chipman, 205 Donna Way, Central Point.
Neal Whiteford, 900 Jackson Creek Drive, Central Point.
Wayne Christian, applicant, came forward in rebuttal and stated, (1? that
he was not building the houses, the Tots are 10,000 s.f. and deeper than

normal lots and should not be a problem of overlooking neighbors, (2) He
will check on Mr. Scott's qualifications with the board that licensed him
and with D.S.L. If he is not qualified to delineate wetlands than he will
have the project redelineated, (3) he has hired engineers and surveyors to
determine the property line in relation to the creek, (41 he agrees to the
35' setback, (5- the water pressure and availability will be checked before
any more demand will be put on the 12" line from Pine Street, (6) the
staff is competent to see that the subdivision doesn't affect the people
downstream (7) the phasing should be left to the staff, (8) the applicants
hope to make the flow in Jackson Creek better, (91 The P.U.E. is on the
subdivision's property, and the pedestrian path will have to be worked
out, (10) D.S.L will determine if the holding ponds will raise the
temperature of the creek, (11) The State Senators should be notified
about the issues concerning the schools, (12) the applicants would like to
leave Horn creek alone; what has been designed will enhance it, (13) the
applicants haven't been able to get a price on the property discussed
previously for a park.
Chairman Piland closed the public hearing.
Commissioner Fish made a motion to continue the meeting after 10:00
p.m. The motion was seconded by Commissioner Gilkey. All said "aye"
and the meeting continued.
Commissioner Fish stated that the subject property has never been zoned
as "wetlands", but has always been zoned as residential.
Jim Bennett stated that acost-sharing agreement can be developed; it is
listed in the conditions as one of the options for the city to develop a way
to share the cost for oversizing or putting additional infrastructure that
doesn't specifically just serve this development.
Commissioner Johnson made a motion to adopt Resolution 393 approving
the Tentative Plan for the Country Meadows Subdivision, Phase 1, a 38-
lot single-family residential subdivision located north of Beall Lane
between Grant Road and Hanley Road. (R-1-8 zone) l37 2W 10C Tax
Lots 4800, 4801, 4803 & 4804) (Wayne Christian, applicant) subject to
the conditions in the staff reports and requirements in the staff report on
items that were of concern to the neighborhood, i.e. the flooding and the
creek information; including a public access for pedestrians at the
southerly end of the development to Hanley; and subject to the public
works decisions on the water lines and what can be worked out with the
contractors in shared agreements; the 35' setback as was agreed upon

by Mr. Christian; and the commission requests that the builder be made
aware that the Planning Commission is in favor of a single story on lot 38
but it is not a requirement of this tentative plan. Motion was seconded

Jim Bennett reviewed the Planning Department Staff Report.
Wayne Christian came forward in favor of the application
Eric Johnson, Hardy Engineering, 1600 Skypark Circle, came forward and
discussed Item 2 on page 30.
Chairman Piland closed the public hearing.
Commissioner Fish made a motion to adopt Resolution 394 to approve a
Tentative Plan for the Country Meadows Subdivision, Phase I1, a 33-lot
single-family residential subdivision located south of Taylor Road and east
of Grant Road. (R-1-10 zone) (37 2W 1068 Tax Lot 800 and 37 2W
108C Tax Lot 1900) iWayne Christian, applicant) including aii conditions
in the Staff Reports; including a 35' setback from Horn Creek; and a
recommendation to make single story residences on the lots on the west
side of Horn Creek. Motion was seconded by Commissioner Dunlap.

Jim Bennett reviewed the Zone Text Amendment and the history of the
amendment.
Christy Devilleneuve, 209 Donna Way, Central Point, came forward 'in
opposition to the amendment.
Commissioner Johnson made a motion to recommend approval of a Zone
Text Amendment to amend CPMC Chapter 17.60 by adding provisions
relating to setbacks from floodways and creek banks. (City initiated).
Motion was seconded by Commissioner Fish. All said "aye" and the
motion passed.
VII. MISCEII_ANEOUS
There were no miscellaneous items.
VIII. ADJOURNMENT
Commissioner Gilkey made a motion to adjourn. Commissioner Dunlap
seconded the motion. All said "aye" and the meeting adjourned at 11:50 p.m.
