AN ORDINANCE VACATING A CERTAIN PORTION OF ~'~x,~,'
FIRST STREET AND GLADES STREET
Recitals
1. On February 4, 1999, the Central Point City Council adopted Resolution No. 843,
setting a public hearing and initiating proceedings to vacate that portion of First
Street between Cupp Drive and Freeman Road, along with Glades Street.
2. On March 11, 1999, the City Council conducted aduly-advertised public hearing and
considered arguments in favor of and opposed to the proposed vacation.
3. The City Administrator, being the City Recording Officer, has filed in the Official
City Record a certificate verifying that all liens and taxes have been paid on the lands
to be vacated.
Now, therefore;
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS:
Section 1. In accordance with ORS 271.130, the City Council makes the following
findings:
A. Notice of the proposed vacation and the public hearing thereon has been duly given as
required by ORS 271.110.
B. The owners of a majority of the area affected as computed on the basis provided in ORS
271.080 have not objected in writing to the proposed vacation.
C. The proposed vacation will not substantially affect the market value of the property
abutting the area to be vacated.
D. The public interest will not be prejudiced by the vacation of the area in question.
Section 2. The lands described on Exhibit "A", attached hereto and by this reference
incorporated herein, are hereby vacated pursuant to ORS 271.130. The lands vacated are:
1. A 1460 foot section of First Street running south from Cupp Drive to Freeman Road.
2. A 250 foot section of Glades Street running east from Front Street to First Street.
A map showing the street vacations is attached hereto as Exhibit "B", and by this reference
is incorporated herein.

Section 3. The lands vacated shall be replatted and ownership of said lands shall become
vested as described in Exhibit "C" attached hereto. In accordance with ORS 271.160, the proposed
vacation shall take effect only upon the consummation of such replatting and shall be conditioned
as hereby follows:
1. The uses of the replatted lands shall be limited to those permitted under the respective
zoning districts in which the lands are located, save that no stnuctures or additions to structures,
except for fences, maybe constructed within or upon the replatted lands. A 15-foot wide reciprocal
access easement shall be created east of and parallel to the centerline of the lands vacated as
described in Exhibit "C" attached hereto.
Section 4. There is hereby reserved to the City of Central Point and all applicable public
utilities agencies an easement over the vacated rights-of--way for purposes ofmaintenance, repair and
replacement of all existing utilities, including the right to access the property for those purposes.
Section 5. The City Administrator is directed to file a recorded copy of this ordinance
with the Jackson County Clerk, Jackson County Assessor, and Jackson County Surveyor, together
with maps, plats, or other records required or provided for by law, upon the effective date of this
ordinance.
Section 6. This ordinance shall become effective upon the recording of the survey of the
replatted lands as described in Exhibit "C" and the recording of the requisite documents of
ownership in compliance thereto.

RIGHT-OF-WAY ANNEXATION
Exhibit A
All that real property situated in the Northwest and Southwest One-quarters of Section 11,
Township 37 South, Range 2 West of the Willamette Meridian in the City of Central Point,
Jackson County, Oregon, platted as FIRST STREET and GLADES STREET, HOMESTAD
ACRES EXTENSION NUMBER 1, now of record, the exterior boundaries of said streets more
particularly described as follows:
Beginning at the Initial Point of said subdivision, being on the westerly right-of--way of Freeman
Road, from which the southeast corner of Donation Land Claim Number 54, of said township,
range and meridian, bears East, a distance of t060.18 feet (1060.15 feet plat record) and South, a
distance of 111.78 feet; thence West, a distance of 1 I.43 feet to the westerly right-of--way of said
First Street, thence North 35°08'10" West, along said westerly right-of--way, a distance of
1460.68 feet (1460.60 feet plat record) to the intersection with the southerly right-of--way of said
Glades Street; thence South 54°51'4T' West (South 54°51'50" West plat record) a distance of
250.00 feet to the easterly right-of--way of Pacific Highway, US 99; thence North 35°08' 10"
West, along said highway, a distance of 60.00 feet to the northerly right-of--way of said Glades
Street; thence North 54°51'4T' East, (North 54°51'50" East plat record) along said northerly
right-of--way, a distance of 250.00 to the intersection with the westerly right-of--way of said First
Street; thence North 35°08' 10" West, along said westerly right-of--way, a distance of 600.03 feet
(600.00 feet plat record) to the southerly right-of--way of Cupp Drive; thence North 54°51'50"
East, along last said southerly right-of--way, a distance of 92.00 feet to the beginning of a curve to
the left having a radius of 12.00 feet and a central angle of 90°00'00"; thence along the arc of
said curve a distance of 18.85 feet, the long chord of said auve bears South 6°51'50" West, a
distance of 16.97 feet to the easterly right-of--way of said First Street; thence South 35°08'10"
East, along said easterly right-of--way, a distance of 1919.62 feet to the beginning of a curve to
the left having a radius of 30.00 feet and a central angle of 114°56'35"; thence along the arc of
said auve a distance of 75.89 feet, the long chord of said curve bears North 72°23'33" East, a
distance of 57.21 feet to the easterly right-of--way of Freeman Road; thence South 00°04'45"
East, (South 00°04'40" East plat record) along last said right-of--way, a distance of 217.98 feet
(217.99 feet plat record) to the Point of Beginning.
Containing 4.21 acres, more or less.
Basis of bearings for this description is the north line of Donation Land Claim Number 63, from
the southeast corner of Donation Land Claim Number 54, at the intersection of Beall Lane and
Burrell Road, along the centerline of Beall Lane, to the northwest comer of said claim number 63.
