ROLL CALL -Those present were: Chuck Piland, Jan Dunlap, Valerie Rapp, Karolyne Johnson, Bob Gilkey. Candy Fish is absent. III. CORRESPONDENCE There was no correspondence IV. MINUTES Commissioner Johnson moved to approve the April 2, 1996 Planning Commission Minutes with a change: remove Bob Gilkey's name as present. Mr. Gilkey was absent. Commissioner Rapp seconded the motion. ROLL CALL VOTE: Dunlap, yes, Johnson, yes, Rapp, yes; Gilkey, yes. Motion passed. V. PUBLIC APPEARANCES There were no public appearances. VI. BUSINESS Raviaw anri ra~nmmPnriatinn rPg r ing~omprehensive Plan Amendment/Zone Test Amendment for ~R~tY located at 37 2W 2D TL 1800 1901 2300 2400 & 37 2W 1 1 D TL 101 also known as the Pilot Project Site Susan Wilson Broadus, Public Works Director, made a presentation with the overhead projector on the issues relating to Public Works which included the looping of water lines and the sewer line access. Sue Riegel, Interim Planner, gave a short review of the Project. Wes Reynolds, Planning Consultant, reviewed the Planning Department Staff report and recommended approval subject to the conditions. Chairman Piland asked if this would provide access to all the parcels. Wes stated that it is just the first parcel but eventually it will give access to CITY OF CENTRAL POINT PLANNING COMMISSION MINUTES April 16, 1996 -Page Two all of the parcels. Dennis Hoffbuhr and Gary Hall, representatives for the applicant, came forward in favor of the application. They stated that they did not have anything to add to the Staff Report. They will have further comments as the other applications are considered. The applicant does not have any problems with the conditions as discussed. Commission Johnson moved that the Planning Commission recommend approval of the Comprehensive Plan Amendment/Zone Text Amendment for property located at 37 2W 2D TL 1800, 1901, 2300, 2400 and 37 2W 11D TL 101, also known as the Pilot Project Site subject to Planning Department condition of approval requiring extension of Peninger Road to the south of Pine Street. Commissioner Gilkey seconded the motion. ROLL CALL VOTE: Dunlap, yes; Johnson, yes; Rapp, yes, Gilkey, yes. Motion passed. B. Review and recommendation regarding Site Plan A12nlication for ~perty known as the Pilot Project 137 2W 2D TL 1800, 1901. & 2300 & 37 2W 11 D TL 1011 (Aoolicants: Hoffbuhr & Associates) Wes Reynolds, Planning Consultant, reviewed the Planning Department Staff Report. He stated that this use fits the description of the zone. The fast food restaurant is the conditional use. Susan Wilson Broadus, Public Works Director, reviewed the Public Works Staff Report which included the following attachments: 1. Reduction of Site Plan Submitted by Applicant 2. April 8, 1996 Letter from Jackson County 3. April 9, 1996 Letter from Pilot Corporation Mark Servatius, Fire Chief/Building Official, reviewed the Department of Public Safety Staff Report. Dennis Hoffbuhr, 1062 E. Jackson Street, Medford, Oregon, representative of the applicant, came forward in favor of the application. Dennis stated that there is no problem with the conditions as stated in the staff reports except for the following: 1. The specific Conditions #5 and #6, for the 6' bike lane at that CITY OF CENTRAL POINT PLANNING COMMISSION MINUTES April 16, 1996, Page Three intersection. He felt that there is a better means for providing access for bicycles at that intersection. He requested that the Planning Commission allow the applicant to present alternative methods for providing bicycle access to the staff and give the staff the flexibility to make a decision concerning the alternative means for bicycle access. 2. He also requested that the staff be directed to investigate a reimbursement plan that requires adjacent properties and future developers pay apro-rata share of the cost of the public works improvements constructed by the applicant. 3. He stated that they may have to increase the size the driveway to 36 feet to allow for 2 entrance lanes and one exit lane so that they can be guaranteed that traffic will flow through at all times. Gary Hall, 2385 Terry Drive, Medford, Oregon, representative of the applicant, came forward on behalf of the application. He stated that he concurred with Mr. Hoffbuhr's statements. Commissioner Johnson moved that the Planning Commission recommend approval of the Site Plan Application for property known as the Pilot Project (37 2W 2D TL 1800, 1901, & 2300 & 37 2W 11 D TL 101) (Applicants: Hoffbuhr & Associates) subject to Planning Department and Public Works conditions of approval with the following modifications: Modify Public Works specific conditions number 5 & 6, requiring a six foot bike lane on each side of the Peninger Road extension, to allow the applicant to present alternative methods for providing bike access to the project site subject to Public Works approval; direct staff to investigate creation of a reimbursement mechanism that requires future developers to pay apro-rate share of the cost of public works improvements constructed by the applicant; modify site plan to allow a 36' driveway width on Pine Street to accommodate fast-food restaurant traffic subject to Public Works approval. Commissioner Rapp seconded the motion. ROLL CALL VOTE: Dunlap; yes, Johnson, yes; Rapp, yes; Gilkey, yes. Motion passed. Chairman Piland declared a recess at 8:50 p.m. Chairman Piland called the meeting back to order at 9:02 p.m. CITY OF CENTRAL POINT PLANNING COMMISSION MINUTES April 16, 1996, Page Four C. Public Hearing.- Review and determination re,aq rding Application for Conditional Use Permit for fro e~rty known as the Pilot Project (1560 E. Pine Streetl. Chairman Piland opened the public hearing. Wes Reynolds, Planning Consultant, reviewed the Planning Department Staff Report. There was no conflict of interest or ex-parte communication. Dennis Hoffbuhr and Gary Hall, representatives for the applicant, came forward on behalf of the application. Commissioner Dunlap stated that the applicant should consider the large trees already on the land in the landscaping plan. Mr. Hoffbuhr and Mr. Hall stated that they haven't evaluated the existing trees but will see if they can integrate them into the landscaping plan. Chairman Piland closed the Public Hearing. Commissioner Rapp moved to approve Resolution No. 349 regarding Application for Conditional Use Permit for property known as the Pilot Project (1560 E Pine Street) subject to Planning Department and Public Works conditions of approval. The motion was seconded by Commissioner Dunlap. ROLL CALL VOTE: Dunlap, yes; Johnson, yes; Rapp, yes; Gilkey, yes. Motion Passed. Conditional Use Permit was approved. VII. MISCELLANEOUS Sue Riegel introduced Jim Bennett, the new Planning Director. Commissioner Piland thanked Sue Riegel on behalf of the Planning Commission for her work in the last few months. VIII. ADJOURNMENT Commissioner Rapp made a motion to adjourn. Commissioner Gilkey seconded the motion. All said "aye" and the meeting adjourned at 9:15 p.m.
