AN ORDINANCE WITHDRAWING 2.30 ACRES OF LAND
LOCATED BETWEEN HANLEY ROAD AND MENDOLIA WAY FROM
JACKSON COUNTY FIRE PROTECTION DISTRICT NO. 3
(Tax Map Location: 37 2W lOC TL 4700)
Recitals
1. By Resolution No. 875 the City of Central Point annexed a 2.30 acre parcel of land located
between Hanley Road and Mendolia Way into the City. Such parcel is within the boundaries of7ackson
County Fire Protection District No. 3.
2. On June 6, 2000 the Central Point Planning Commission, pursuant to CENTRAL POINT
MiINICIPAL CODE 1.414.020, considered the withdrawal of such parcel from Fire District No. 3, and
whether such withdrawal would be in the best interest of the City.
3. On August 10, 2000 the City Council held a duly noticed hearing, pursuant to CEN IRAI,POINT
MUNICIPALCODE 1.24.020 and ORS 222.524, to consider the withdrawal, and whether such withdrawn(
would be in the best interests of the City.
Now, therefore;
THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS:
Section 1. Pursuant to ORS 222.520, the City of Central Point hereby withdraws the parcel of
real property described below from Jackson County Fire Protection District No. 3.
Beginning at 5/6 inch iron pin marking the Northwest corner of Lot 5 of
COUNTRY tiEADOWS ESTATES SUBDIVISION, UNIT NO. 1, PHASE 1, according to the
official plat thereof, now of record, in Jackson County, Oregon; thence
along the West line of that tract described in Document No. 88-22785,
Official Records of Jackson County, Oregon, North 00°03'55" East, 311.55
feet to a 5/8 inch iron pin at the most westerly Southwest corner of WEST
PINE VILLA SUBDIVISION, according to the official plat thereof, now of
record, in Jackson County, Oregon; thence along the exterior of said
SUBDIVISION, South 89°53'55" East, 18.38 feet to a 5/8 inch iron pin at an
angle point; thence South OS°36'37" East, 14.70 feet to a 5/8 inch iron pin
at an angle point; thence South B9°54'59" East, 435.19 feet (record North
89°55'95" East, 935.60 feet) to an angle point; thence South 00°03'55"
West, 144.38 feet (record South 00°04'15" West, 144.41 feet) to a 5/B inch
iron pin at the most Southerly corner of said SUBDIVISION; thence along the
Westerly line of Pine Street, along the arc of a 290.44 foot radius curve
to the left having a central angle of 04°34'41", a distance of 23.21 feet
(the long chord of which bears South 37°16'32" West, 23.20 feet) to the
South line of that tract described in Document No. 88-22785, said Official
Records; thence along said South line, WEST, 245.91 feet to the interior
ell corner of said tract; thence South 00°05'01" West, 133.50 feet to a 5/e
inch iron pin at the Northeast corner of Lot 4, said COUNTRY MEADOWS
ESTATES SUBDIVISION, UNIT NO. 1, PHASE 1; thence along the North lines of
said Lots 4 and 5, North 89°57'22" West, 194.01 feet to the point of
beginning. Containing 2.30 acres, more or less.
The City hereby assumes and agrees to pay the amount of taxes which otherwise would be
extended each year against the property hereby withdrawn forthe retirement ofbonded debt, subject to
the right of the City to obtain reimbursement therefor fi'om the owner of said property.
Section 2. The City Administrator is directed to forthwith file certified copies of the within
ordinance withthe Jackson County Assessor, the Jackson County Department ofPublic Works, and with
the governing body of Jackson County Eire Protection District No. 3.
Section 3 The property annexed and hereby withdrawn is hereby zoned in accordance with its
respective zoning designation of the City's current zoning map.
Section 4. This withdrawal being necessary for the immediate preservation ofthe pubfic health,
safety and welfare ofthe City ofCentral Point, Oregon, and based uponthe need to conclude annexation
procedures, second reading ofthis ordinance is hereby waived and an emergency is declared to exist, and
this ordinance shall be in full force and effect immediately upon its passage by the Council and approval by
the Mayor.
