HomeMy WebLinkAboutOrdinance 1865ORDINANCE NO. n(oS AN ORDINANCE ADDING CHAPTER 2.55 TO THE CENTRAL POINT MUNICIPAL CODE PERTAINING TO THE ESTABLISHMENT OF A TRAFFIC SAFETY COMMITTEE THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS: Section 1. A new chapter, chapter 2.55, is hereby added to title 2 of the Central Point municipal code, to read as follows: CHAPTER 2.55 TRAFFIC SAFETY Committee Sections: 2.55.010 Established 2.55.020 Membership 2.55.030 Powers and duties 2.55.040 Meetings 2.55.050 Chairperson—Removal of members 2.55.060 Staff services 2.55.070 Compensation 2.55.080 Conflict of interest 2.55.010 Established: A Traffic Safety Committee is established in order to receive concerns, comments, and recommendations related to traffic regulations and public safety associated with traffic regulations from citizens, city staff, and other sources, review said concerns, comments, and recommendations for social, technical and legal standing, and develop recommendations to be forwarded to the City Council for its action. 2.55.020 Membership: The Traffic Safety Committee shall consist of three members who shall be selected through an open public process and formally appointed by the Mayor with the approval of the City Council. All members must be residents of the City of Central Point. All citizens attending Traffic Safety Committee meetings shall be entitled to express opinions or offer additional information pertaining to any matter being heard by the committee, subject only to reasonable rules to be established by the time limitations and orderly procedures for the conduct of meetings. The City Administrator or his/her designee shall appoint city staff to act in a non-voting, advisory capacity to the committee. City staff shall, at a minimum, consist of one person from Planning, one person from Public Works, and one person from the Police Department. The Mayor shall appoint one member of the City Council to attend the Traffic Safety Committee and act as liaison to the City Council. 2.55.030 Powers and Duties: A. The Traffic safety committee shall be advisory to the City Council. B. The Traffic Safety Committee shall have no power over the State Highway Committee, Motor Vehicle Laws of Oregon, or the Central Point City Council. The Traffic Safety Committee shall make recommendations to the City Council, for their consideration, with respect to traffic controls described in the Central Point Municipal Code, Section 10.04.020. 2.55.040 Meetings: A. The Traffic Safety Committee shall encourage active participation of each and every citizen at its regular meetings, which shall be held quarterly during the months of January, April, July, and October. Meetings may be canceled by the Mayor or City Administrator. B. Special meetings may be called in the case of an emergency or critical conditions which warrant the same. C. All meetings shall be duly and regularly advertised as required by law. D. A register of attendance will be made available for citizens to sign at each meeting. E. Recommendations of the Traffic Safety Committee will be formulated by a simple majority of the committee members in attendance at the meeting where the item is discussed. At the committee's discretion, the audience may be polled on any particular issue being discussed and the results of that poll may be submitted along with the committee's report or recommendation. F. Citizens may suggest agenda items for discussion by notification not less than fifteen days prior to the date of the next regular meeting. The chairperson will prepare an agenda for each meeting, which will be prominently posted at the City Hall at least one week prior to the meeting, 2.55.050 Chairperson—Removal of members : The chairperson of the Traffic safety committee shall be appointed by the Mayor with the approval of the City Council, for the term of one year, starting at the first meeting in January. The chairperson shall be a voting member of the Traffic Safety Committee. Any member of the Traffic Safety Committee, including the chairperson, may be removed by the Mayor, with the approval of the City Council, after hearing, for misconduct or nonperformance of duty. A member who is absent from three meetings without an excuse as approved by the chairperson is rebuttably presumed to be in nonperformance of duty and the chairperson shall report such absences to the Mayor and council promptly. 2.55.060 Staff services: The City Administrator shall provide such staff and consultation services to the Traffic Safety Committee as shall be appropriate. A record shall be kept of committee proceedings. 2.55.070 Compensation: Traffic Safety Committee members shall receive no compensation other than expenses as authorized by the Mayor and council. 2.55.080 Conflict of interest: A member of the Traffic Safety Committee shall not participate in any committee proceeding or action in which any of the following has a direct or substantial financial interest: the member or his/her spouse, brother, sister, child, parent, father-in-law, mother-in-law, any business in which he/she is then serving or has served within the previous two years, or any business with which he/she is negotiating for or has an arrangement or understanding concerning prospective ownership, partnership, or employment. Any actual or potential interest shall be disclosed at the meeting of the committee where the action is being taken.
