AN ORDINANCE AMENDING CPMC CHAPTER 1.5.22 PERTAINING TO SWIMMING POOL REGULATIONS THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS: The following sections of Central Point Municipal Code Chapter 15.22 pertaining to swimming pool regulations are hereby amended to read as follows: 15.22.020 Swimming pool defined. For (tire) purposes of this chapter, (a) "swimming pool" is defined as any structure: (designed and ce7n fain ei ght er —srrch e<- rr—rrc r cY 6e3- oiwater.) intended for swimming or recreational bathing and which contains water more than 24 inches deep, including in - ground, above -ground, and on -ground swimming pools, hot tubs and spas. 15.22.030 Setback reguir.ements. The following measuren:ent.s indicate the minimum setback requirements for a swimming pool: A. Setbacks shall be in accordance with the current edition of the (S-tatebf) Oregon ( ing) Residential Specialty Code (3-ppened ) and the current edition of the State of Oregon Structural Specialty Code (Apperds�c,- eiiapter . r rs—�or s _ allu tubs,) or the following, whichever is more restrictive. B. Front: No less than twenty feet from edge of water to property line contiguous with street right-of-way; C. Side: No less than five feet from edge of water to property line or twenty feet from edge of water to properly line ,.ontig ous with street right of -way; D. Rear: No less than five feet from edge of water to property line or twenty feet from edge of water to property line contiguous with street right-of-way; E. Building: No less than ten feet from edge of water to foundation line. The foregoing setbacks shall be in addition to any easements; any swimming pool decks shall not encroach into any easements. ORDINANCE NO. AG (092905) 15.22.040 Fence requirements. A fence shall be required completely surrounding a swimming pool. Said fence shall comply with the requirements contained in at least one of the following: 1. The Oregon Residential Specialty Code; 2. The swimming pool enclosures and safety devices section of the 2003 International Building Code, Fifth Edition, Section 3109; or 3. Provisions for public swimming pools as promulgated by the Department of Human Services under the authority established in ORS 448.011, reference OAR Chapter 333, "Health Division", Division 60. 15.22_050 Overhead utility lines. All overhead uti.l-i.y lines shalluc�t�r�-ic ( of water.) comply with the currently adopted version of the Electrical Specialty Code.
