AN ORDINANCE VACATING CERTAIN PORTIONS OF TAYLOR ROAD
RIGHT-OF-WAY
RECITIALS:
1. The City of Central Point ("City") completed planned public improvements to
realign and widen sections of Taylor Road earlier this year.
2. On May 25, 2006, the City. Council entertained a petition and a proposal to
vacate certain portions of Taylor Road right-of-way located between Haskell Street and
Richardson Drive and between Valley Oak Blvd and Oakley Drive. At that time the
Council set the matter for a public hearing.
3. On July 13, 2006, the City Council conducted a duly advertised public
hearing and considered arguments in favor of and opposed to the proposed vacation.
4. The City Recording Officer has fled in the Official City Record a certificate
verifying that all liens and all taxes have been paid on the lands to be vacated.
Now, therefore;
THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS
FOLLOWS:
Section 1. In accordance with ORS 271.120, the City Council makes the
following findings:
A. Notice of the proposed vacation and the public hearing thereon has been
duly given as required by ORS 271.110.
B. The owners of at least two-thirds of the area affected as computed on the
basis provided in ORS 271.080, have consented in writing to the proposed
vacation.
C. The owners of all properties abutting the area proposed to be vacated have
consented in writing to the proposed vacation.
D. The public interest will not be prejudiced by the vacation of the area in
question.
Section 2. The lands described in Exhibit "A" and Exhibit "B", attached hereto
and by this reference incorporated herein, are hereby vacated pursuant to ORS
271.120, and the ownership of said lands hereby vacated shall become vested as
provided in ORS 271.140.
Seclion 3. There is hereby reserved to the Cfty of Central Point, all applicable
public utility agencies, and contracting cable television companies, an easement over
the vacated street and alleys for purposes of installation, maintenance, repair and
replacement of utilities and cable vision facilities, including the right to access the
operty for those purposes.

Volume 3 1, Page 04 of the Plat Records of Jackson County, Oregon and filed as survey
number 18593 in the office of the Jackson County Survey; thence North 8949'32" East,
along the northerly right-of-way line of Taylor Road, 117.06 feet to the westerly right-of-
way of Haskell Street; thence South 3"951" East, along said westerly ri -of-wa line
73.24 feet to the southerly right-of-way line of said Taylor Road; thence 8 1 2" SO
69.91 feet to the proposed right-of-way of the realignedTaylor Road; thence along
s proposed right-of-way along a non tangent curve to the left having a radius of 238.00
feet, an internal angle of 2(PO5'3 I " and an arc length of 83.46 feet, (the long chord of
which bears North 6,f5255" East 83.03 feet); thence North 5�FW09" East 43.57 feet to
the existing north right-of-way line of said Taylor Road; thence North 894932" East
along said northerly right-of-way 199.88 feet to the POINT OF BEGINNING.

Beginning at the southeast corner of Lot 98 of Griffin Oaks Unit No. 2, Phase II and III in
Section 3, Town ship 37 South, Range 2 West, Willamette Meridian, City of Central
Point, Jackson County, Oregon; thence North 89'49'38" East, 38 feet north of and parallel
to the centerline of Taylor Road said centerline, being the south line of said Section 3, a
distance of 358.37 feet; thence along the arc of a curve to the left having a radius of 35.00
feet, an arc length of 55.06 feet and an internal angle of 90x08'03", (the long chord of
which bears North 4445'37" East 49.56 feet); thence North 0(Y18'24" West 0.99 feet;
thence along a curve to the right having a radius 30.00 feet; and are length of 47.19 feet
and in internal angle of 90'08'03", (the long chord of which bears South 4445'37" West
42.48 feet) to the existing northerly right-of-way line of Taylor Road; thence South
89'49'38" West 137.28 feet; thence South 00118'57" East 4.00 feet; thence South 89'49'39"
