AN ORDINANCE AMENDING CPMC TITLES I2, l5, & 17
IMPLEMENTING THE TELECOMMUNICATIONS ORDINANCE
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS I'OLLOWS:
Section 1. Chapter 12.40 of the Central Point Municipal Code is hereby amended as follows:
Section 12.40 Telecommunications Infrastructure
Section 12.40.050 Location of Telecommunications Facilities.
Section 24. Location of Facilities: Placement of telecommtrrzicatiorz
,facilities within the City shall be dictated by zoning, Chapter 17. All
facilities located within the public right of way ...
Section 2. Chapter 15.24 of the Central Point Municipal Code is hereby amended as follows:
Section 15.24.600 Signs along fi•eeways -Restrictions. Notwithstanding any other provision
contained in this code, a conditional use permits sha}I maybe granted for
fire ereetiorrBf-any sign to be erected within the C-4, commercial tourist
zone, where such signs:
A. Are silty (60) feet or-higher and are placed in such a mam~er that the
highest point of the sign is not higher than eighty (80) feet above the
ground level upon which the sign is placed; and
B. Contain not over three hundred (300) square feet of advertizing
surface.
Section 3. Chapter 17.08 of the Central Point Municipal Code is hereby amended as follows:

Section 17.08.057 Antenna - a device, dish or array used to transmit or receive signals for
telecomrnunication purposes.
Section 17.08.247 Height -the distance from the base of a strrrchme, object, etc. at grade to
the top of the structure of combination ofstructurer.
Section 4. Chapter 17.44 of the Central Point Municipal Code is hereby amended as follows:
Section 17.44 C-4, Tourist and Office-Professional District
Section 17.44.020 Permitted uses. The following uses are permitted in the C-4 district:

structures that comply with dze nracinnnn height regulations described in
Chapter 17.44.040.
Section 17.44.030 Conditional uses. The following uses are permitted in the C-4 district
when authorized in accordance with Chapter 17.76:
C Telecomnrunication antenna support struchn•es and other antenna
sh-trctrres that exceed t/ae maxirmmt height regulations described in
Chapter 17.49.040. Said structures nre subject to the conditional use
permit requirements of Chapter 17.76.010 and variance regrrirenrents of
Chapter 17.80.010 if the requested height of the structure exceeds eighty
(80) feet.
Section 17.44.040 Height regulations. No building or structure shall exceed sixty feet in
height in the C-4 district ea:cept when authorized for telecomrrrzrrzication
antenna szrpport structures, other atrlenna structures or signs defined by
this Chapter.
Section 17.44.050 Area, width and yard reuuirements.
F. Rear Yard. The rear yard shall be a minimum often feet. In cases
where the rear property line abuts any residential (R) district or any
unincorporated lands, the rear yard shall be increased by one-half foot for
each foot by which the structure or building exceeds twenty feet.
Section 17.44.090 Antenna standards. Antenna standards and associated general
information are illustrated in similarly named attachment.
Section 5. Chapter 17.76 of the Central Point Municipal Code is hereby amended as follows:
Section ] 7.76. Conditional Use Permits
Section 17.76.040 Findings and conditions. The planning commission in granting a
conditional use permit shall find as follows:
C. That the proposed use ... or the permitted use thereof. In making this
determination ..setbacks; height of buildings and structures; walls and
fences; landscaping; outdoor lighting; and signs;
li. That any conditions required for approval ... may include:
7. Requiring fences, berns, walls, landscaping or other devices of
organic or artificial composition to eliminate or reduce the effects of
noise, vibrations, odors, visual incompatibility or other undesirable effects
on surrounding properties.

Ordinance
® Structures 60 feet or less in height are a permitted use in
the C-4, Commercial District.
Application required: Site Plan
® Structures 61 feet to 80 feet in height aze a conditional use
and aze subject to recommended conditions of approval.

® Structures exceeding 81 feet in height aze a conditional use
contingent upon approval of a variance from the maximum
height for the zoning district.

GENERAL INFORMATION :..
a) Antennas and similaz stretctnres adjacent to residentially zoned properties are subject fo additional
setback requirements designed to protect against collapse.
b) Antennas and similaz structures shall be painted an unobtrusive color.
c) Lighting on the structure is prohibited unless required by the Federal Aircraft Administration.
d) The City of Central Point encourages co-location of facilities.
e) Conditional use pemut applications for antennas and similar structures may have additional
conditions of approval assigned by the City of Central Point to mitigate the visual impact on
surrounding properties, .
