HomeMy WebLinkAboutCouncil Resolution 1030RESOLUTION No. /~i-.%~~ L% A RESOLUTION AMENDING CENTRAL POINT RESOLUTION No. 851, SYSTEMS DEVELOPMENT CHARGES Recitals The Central Point City Council hereby declares its desire to encourage the establishment of small businesses in Central Point and encourage business to locate within the Central Point Vertical Housing Development Zone. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Central Point Resolution No. 851 pertaining to Street SDCs is hereby amended so as to add the following provisions: Section 1 Definitions: Small Business: Any business: a) Comprising of 2500 gross square feet or less; and b) Which is new to the City of Central Point; and c) Which is not affiliated with, a part of, or an extension of, another business located within the State of Oregon Vertical Housing Development Zone: A defined geographical area in and around downtown Central Point, established to provide an incentive for local mixed-use development projects. Fagade Improvement: A change in the exterior appearance of a building, exclusive of any structural changes and/or safety improvements, to more closely align with the overall theme of the Downtown Business District as determined by the Central Point Community Development Director. System Development Charge (SDC): As authorized and described in Central Point Municipal Code Chapter (CPMC) 11.12 SDC Credit: As authorized and described in CPMC 11.12.110 Section 2. Small Business Adjustment. As of the effective date of this resolution, any small business, as defined in this resolution, that is subject to a Street System Development Charge (SDC) shall be entitled to a 75% reduction in said Street SDC. The Street SCD reduction is to be calculated as follows: City staff shall first calculate the street SDC under the methodology as described in CPMC 11.12.050 and Section 3, i-iv, of Central Point Resolution 851. Any eligible credits, as provided for in Central Point Mwricipal Code (CPMC) 11.12.110 and Central Point Resolution 851, shall be deducted from the calculated SDC prior to calculating the 75% Sheet SDC reduction. (SDC -SDC credits X .75 =ADJUSTMENT) Section 3. Vertical Housing Zone Adjustment. As of the effective date of this resolution, any business located within the boundaries of the City of Ceutral Point's "Vertical Housing Zone" and which, because of new construction, remodeling and/or a change of use, is subject to a Street SDC as described in CPMC 11.12 and Central Point Resolution 851, shall qualify for an allowance for moneys spent on fagade improvements towards the Street SDC obligation. The amount of money allowed as an adjustment of the Street SDC shall equal the same amount as spent on the fagade improvement. Should the amount of the fagade improvement be greater than the originally calculated Street SDC, the City will not reimburse the overage to the applicant. Any person wishing to take advantage of the Vertical Housing Zone adjustment shall apply to the Central Point Community Development Director prior to making fagade improvements. All regular Street SDC's must be paid in accordance with CPMC 11.12, and Central Point Resolution 851. Any applicable fagade improvement adjustment amount will be reimbursed to the applicant at the time of completion of the fagade improvements. To receive payment from the City, the applicant must provide the City with original receipts for expenses directly related to the approved fagade improvements. Section 4, Retroactive Eli ig bilit~ Eligibility for any applicable adjustments described in this resolution shall be made retroactive to September 1, 2003.
