A RESOLUTION DECLARING THE ANNEXATION
OF 0.45 ACRES OF LAND LOCATED AT THE END OF ARNWOOD STREET
AND EAST OF MERRIMAN ROAD
INTO THE CITY OF CENTRAL POINT, OREGON

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. Application has been made by the owners of certain real property for
annexation into the City of Central Point, Oregon. The property consists of one tax lot and
road right-of-way totaling approximately 0.45 acres. The property to be annexed is more
particularly described as follows:
Beginning at the most Southerly corner of Lot 44 of GREEN PARK VILLAGE
SUBDIVISION, UNIT N0. 1, according to the official plat thereof, now of
record, in Jackson County, Oregon; thence along the Southeasterly line of
said Lot 44, North 58°06'46" East, 225.99 feet to the Southwest corner of
that tract described in Document No. 93-91771, Official Records of Jackson
County, Oregon; thence along the West line thereof, North 04°22`55" East,
16.90 feet to the Southerly line of Arnwood Street; thence along said
Southerly line, along the arc of a 50.00 foot radius curve to the left having
a central angle of 22°23'28", a distance of 19.54 feet (the long chord of
which bears North 69°19'39" East, 19.41 feet); thence continue along said
Southerly line, North 58°08'00" East, 40.87 feet to the Westerly line of
MORNINGSIDE SUBDIVISION, UNIT N0. 1, according to the official plat thereof,
now of record, in Jackson County, Oregon; thence along said Westerly line,
North 32°24'90" West, 50.00 feet to an angle point; thence leaving said
Westerly line, South 58°09'06" West, 220.03 feet to the interior ell corner
of said Lot 94; thence along the Northwesterly line of said Lot 94, South
58°07'36" West, 75.35 feet to the most Westerly Northwest corner thereof;
thence along the Southwesterly prolongation of said Northwesterly line, South
58°07'36" West, 90.00 feet to the center of Merriman Road; thence along the
centerline of Merriman Road, South 31°52'24" East, 60.01 feet to the
Southwesterly prolongation of the Southeasterly line of said Lot 49; thence
along said prolongation, North 58'06'46" East, 40.00 feet to the point of
beginning. Containing 19435 square feet or 0.946 acre, more or less.
The above described property is not within the City of Central Point's
Current corporate boundary, but is contiguous to the City's existing corporate boundary
and is within the Central Point Urban Growth Boundary (UGB).
Section 2. The owners of the property proposed for annexation are Bradley and
Carrie Fuss, and there is imiitUal COiiSeiit to tihe ani exation. SUCK written G(OnSent IS On flle
at Central Point City Hall, 155 South Second Street, Central Point, Oregon.
Section 3. ORS 222.125 provides that when all of the owners of land in the territory
proposed for annexation and not less than 50% of the electors residing in such territory
have consented in writing to the annexation of the land in the territory and file such written
consent with the City Council, the property may be annexed without the requirement for an
election or a public hearing.
Section 4. Annexation of the described property is consistent with the City's ability
to provide facilities and services to the real property, as required by the City's
Comprehensive Plan.
Section 5. Pursuant to ORS 222.125, the property described in Section 1 above,
shall be and hereby is, annexed to and made part of the City of Central Point, Oregon.
Section 6. The City Administrator, or his designee, shall transmit a copy of this
resolution to the Oregon Secretary of State, and this annexation shall be effective when
filed with the Oregon Secretary of State pursuant to ORS. 222.180.

ANNEXATION PI';'TI'I'ION
The undersigned hereby request and consent to the annexation to the City ofCcnn~al Point,
Oregon, of real property contiguous thereto described in Exhibit "A" attached hereto and by Chis reference
made a part of the within petition.
Sy their signature hereto, [hc undersigned certify that they are either "owners" of the land in Che
territory proposed to be annexed as described in Exhibit "A", or are "electors" registered in the territory
proposed to be annexed as described h~ Exhibit "A".
This petition, containing the request and consent to said annexation, must be filed with the Cennal
Point City Council on or before the date ofthe public hearing to be held upou the proposed annexation
pursuant to ORS 222.120.
"Owners" is defined by ORS 222.120 as meaning the legal o~+nter of record or, where there is a
recorded land contract which is in force, the pmnhaser there under. If there is multiple ownership in a
parcel of land, each consenting owner shall be counted as a Suction of the same extent as the interest of the
owner in the land bears in relation to the interest of the other owners, and the same fiaction shall be applied
to the parcel's land mass for purposes of the consent petition. If a corporation owns land in a territory
proposed to be annexed, the corporation shall be considered to be the individual owner of that land.
"Elector" is defined in said stature as an individual qualified to vote under Article R, Section 2 of
the Oregon Constitution, which in turn requires that the individual be 18 years of age or older, a resident of
the area i.n question, and registered to vote as required by applicable state law. Furthermore, ORS
222.170(2) requires Chat electors petitioning for annexation be registered in the territory proposed to be
annexed.
