J e ORDINANCE N0. 15 6 8 AN ORDINANCE DECLARING THE ASSESSMENT OF PROPERTY BENEFITTED WITHIN THE LOCAL IMPROVEMENT DISTRICT ALONG PITTVIEW AVENUE AND DECLARING AN EMERGENCY WHEREAS, the City Council authorized and ordered the construction of a water system along Pittview Avenue within the City of Central Point, Oregon, by Ordinance No. 1566, and, WHEREAS, by Ordinance 1566, the City Council proposed to make assessments for the costs of construction of a water system along Pittview Avenue within the City of Central Point, Oregon, and directed the City Administrator to serve notice of the proposed assessments by mailing notices to the owners of each parcel of property proposed to be assessed, and set June 19, 1986, as the date before which objections to such proposed assessments should be filed with the City Administrator. WHEREAS, the City Administrator did provide notices in the manner set forth in said Ordinance to each of the owners of parcels of property proposed to be assessed, and the public hearing was held there- after in accordance with such notice, and after hearing all testimony, whether for or against such improvements or proposed assessments of the cost thereof to the adjacent benefitted properties, the City Council deems that such improvement is of material benefit to the City and that all property to be assessed will be benefitted to the extent of the probable value of the' respective assessments to be levied for the costs thereof; now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. The actual cost of the water system along Pittview Avenue within the City~of Central Point, Oregon is hereby determined to Ordinance No. 1 568 -1 ,,, . ~.. be the sum of $42,006.93. ,.Said sum to be assessed against benefitted property owners. Section 2. These assessments are hereby declared due and payable and the owners of the parcels of the property herein assessed are required to pay said assessments to the City or file a Bancroft application within ten days after notice of such assessments is published. The City Administrator is hereby directed to enter a statement of said assessments in the docket of the City liens of said Ordinance No . 15 6 8 -3 .,,, .~:: ;.~. .. ty ' :'_ ,'...; City. Property owners electing to file Bancroft applications shall pay assessments in twenty (20) equal semiannual installments including interest thereon at a rate per annum equal to the net effective rate of interest to be paid by the City on the sale of its improvement bonds rounded to the next highest one-tenth (1/10th) percent on all of said assessments which have not been paid, said interest to be payable semiannually at the time each installment is paid. Section 4. The City Administrator is hereby directed to serve notice of the foregoing assessments by publishing a Notice of Assessment in a newspaper of general circulation within the City of Central Point. Section 5. This Ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, based upon the need for securing Bancroft Bonding at a time when interest rates are low, second reading is waived and an emergency is hereby declared to exist and this Ordinance shall be in full force' and effect immediately upon its passage by the Council and approval by the Mayor.
