A RESOLUTION ORDERING CONSTRUCTION OF IMPROVEMENT1 S "1,0
SNOWY BUTTE LANE FROM 'I~IMO'I'HY STREET `I'O BE.AI,I.. LANI; I`OR ROAD
WIDENING AND PAVING AND AUTHORI7ING THE CITY TO BORROW
MONEY AND ISSUE AND SELL NOTES FOR THE PURPOSE OF PROVIDING
INTERIM FINANCING FOR THE COST OF rl'I-IE LOCAL IMPROVEMENT
WHEREAS, The City Council approved Resolution px~x~set public hearings on July 14
and August 25 to consider objections and other representations made by owners, and heard and
considered all other relevant information presented; and,
WHEREAS, The City Council has declared the formation of a local improvement district
to widen and pave Snowy Butte Lane from Timothy Street to Beall Lane in, Central Paint,
Oregon; and,
WHEREAS, the notice of such intention was duly given, a public hearing was held and it
appears to the Council that such improvements would be of benefit to the city and all properties
to be assessed.
NOW, THEREFORE; THE CITY COUNCIL OF THE CITY OF CENTRAL POINT
HEREBY RESOLVES AS FOLLOWS:
SECTION 1. A local improvement district is hereby created and shall consist of all the tax lots
described in the Section $ as the assessment area of the Snowy Butte Lane Improvement from
Timothy Street to Beall Lane. The district shall be called Snowy Butte Lane Improvement Area,
from Timothy Street to Beall Lane.
SECTION 2. The improvements shall consist of widening and paving Snowy Butte Lane from
Timothy Street to Beall Lane. Additional improvements will include the installation of a new
storm drain line, re-building a portion of a sewer line and moving utilities out of the right~of
way. The estimated cost per lot created is $7,500 or $460,000 for the entire project. A discount
of 50% is allowed for the following legal tax lots 37 2W lODD Tax Lots 2500 and 2600 and 37
2W 10 DA Tax Lot 6200.
SECTION 3. The City of Central Point is authorized to borrow money and issue anal sell notes
for the purpose of providing interim financing for the actual cost of the local improvement. The
notes may be payable from the proceeds of any bonds, issuance of additional notes or from any
other sources from which the bonds are payable. This borrowing shall be issued according to the
terms of ORS 223.235(7}.
SECTION ~. The City of Central Point expects to make expenditures Exam its available funds to
pay for the costs of the improvement project. The City reasonably expects to issue bonds or other
obligations {the "Reimbursement Bonds"} and to use the proceeds of the Reimbursement Bonds
to reimburse the City for the expenditures it makes from its available funds far the improvement
project To permit interest on the Reimbursement Bands to be excludable from gross income, the
internal Revenue Cade of the United States requires that the City declare its intent to reimburse
itself from Reirmbursement Band proceeds within 60 days after the expenditures are made. The
City expects that the principal amount of the Reimbursement Bonds will not exceed $460,000.
SECTION 5. The assessment imposed upon benefited properties will be characterized as an
assessment for local improvement pursuant to ORS 305.583{4) and Central Point Municipal
Cade 11.04.
SECTION b. The Finance Director is directed to prepare the final assessment for the respective
lots within the local improvement district and file it in the lien records of the city, upon
completion of the worlf .
SECTION 7. This resolu#ion takes effect upon signing by the Mayor.
SECTION 8. The following is a list of all properties in the improvement area, including
assessor's map description, owner, address, size of property in acres, and the es#imated
assessment for each property if the assessment is calculated on the basis of acreage.
