FOR CONSTRUCTION OF A SKATEBOARD PARK Rec~.tals ~.. The City of Central Point, through its City Council as its Contract Review Board, is authorized under Oregon law to exempt certain public contracts from the competitive bidding process. 2. The City Cauncil desires to exempt the public contract for construction of a skateboard park from the competitive bidding rules and to enter into a contract with Todd Construction, Tnc. for construction of a skateboard park. Now, therefore, the City Council of the City of Central Point, Oregon, hereby resolves as follows: Section 1. The City hereby exempts from the rules pertaining to competitive bidding the contract for construction of a skateboard park in the City of Central Point. In exempting that contract, the City Cauncil finds as follows: A. It is unlikely that the exemption wi11 encourage favoritism ixa the awarding of public contracts or substantially diminish competition for public contracts; B. The awarding of a public contract pursuant to this exemption will result in substantial cost savings to the City of Central Point; and C. DATE: 3/I7/2~05 RECOMMENDED MOTION: Staff recommends the passage of the attached resolution. SUBJECT: Approving a Resolution allowing for the exemption of the public letting process and selecting TODD Construction, Inc. to proceed with construction. SUMMARY: Oregon Revised Statute 279.235 requires the contracting agency (City of Central Point} to submit the Local Contract Review Board {Central Point City Council} with written findings establishing justification far exempting a public improvement contract from public letting requirements. The following findings are to be provided to the City Council. 1. It is unlikely that the exemption will encourage favoritism in the awarding of the public improvement contracts or substantially diminish competition for public improvement contracts. A. Circumstances which have led to the need for exempting the Skate Board Park public improvement project contract continue to be beyond the control of the City. The grant which funds a significant portion of this project was unexpected, and contains time restraints which do not allocate a sufficient length of time for the project schedule to include a publicly let project. Furthermore, publicly exempting the Skate Park contract will nat result in favoritism, or substantially diminish competition for the following reasons; local construction knowledge and experience is not adequate for the proposed project; contract prices will reflect local market value; and where passible the General Contractor will use local contractors wherever passible. 755 Soufh Second Streef Cenfral Poinf, OR 87502 ~ 547.664.3327 Fax 541.664.6384 2. The awarding of the public improvement contract under the exemption will result in substantially cost savings to contracting agency. A. The City of Central Paint will benefit financially in a multitude of areas if the Skate Park contract is exempt from public letting. Without a public bidding exemption the City will be unable to complete the Skate Park construction within the allotted time required by the grant funding opportunity. 1=urthermore, with TODD Construction Inc., currently constructing the City Hall/Jackson County Library Facilities, mobilization and project supervision associated costs will be reduced. Oregon Revised Statutes require the City Council to allow public comment, during a hearing, prior to finalizing an exemption of a public improvement contract.
