AN ORDINANCE DECLARING THE COUNCIL'S INTENT TO ANNEX A CONTIGUOUS PARCEL OF PROPERTY OWNED BY INTERMOUNTAIN HOME SYSTEMS, LTD., WITHOUT AN ELECTION AND TO WITHDRAW SUCH PROPERTY FROM FIRE DISTRICT NO. 3 AND BEAR CREEK VALLEY SANITARY AUTHORITY AND TO REZONE THE SAME FROM F -R TO R -3 AND SETTING A DATE FOR PUBLIC HEARINGS THEREON WHEREAS, a petition has been filed with the City of Central Point requesting and consenting to the annexation of the following described parcel of real property contiguous to the City of Central Point, by the owner of said parcel, Intermountain Home Systems, Ltd., and WHEREAS, the Council has elected pursuant to ORS 222.120 to dispense with an election in said annexation proceeding, and to withdraw said property, if annexed, from Jackson County Fire Protection District No. 3 and the Bear Creek Valley Sanitary Authority, and WHEREAS, concurrently with the aforementioned petition for annexation, application has been made for a change of zone from county designation F -R (farm residential) to R -3 (high density multi - family), and the Planning Commission having held a hearing thereon and having made findings approving said zone change, a report of said findings having been made to the City Council, now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. Proceedings are hereby initiated for annexa- tion to the City of Central Point of the following described real property: Page 1 - Ordinance No. /2''/ Commencing at the Southeast corner of Donation Land Claim No. 56 Township 37 South, Range 2 West of the Willamette Meridian in Jackson County, Oregon; thence South 890 58' 15" West along the South boundary of said Donation Land Claim No. 56, 1936.93 feet for the true point of beginning; thence North 32° 04' 30" West 918.50 feet; thence along the southerly line of tract described in Volume 352, Page 30 Deed Records of Jackson County, Oregon to a point on the Westerly line of the East 1/2 of said Donation Land Claim; thence South along said Westerly line of said Donation Land Claim to the point of intersection between said line and the southerly boundary of said Donation Land Claim, thence North 89" 58' 15" East along said South Boundary to the true point of beginning. EXCEPTING THEREFROM that certain property described in the Deed recorded in Volume 473 at Page 495 of the Deed Records of Jackson County, Oregon, which property was heretofore conveyed by William Walkemeyer and Dorothy Walkemeyer to the State of Oregon. ALSO EXCEPTING THEREFROM that certain property described in the deed recorded as Document No. 66 -12165 of the Official Records of Jackson County, Oregon, which property was conveyed by Trevor Hare to Herman L. Handshy and Opal W. Handshy, husband and wife. The property is more generally described as a parcel of approximately 1.89 acres located west of Interstate 5, north of Hopkins Road and East of Freeman Road, adjacent to The Meadows Mobile Home Park. (Tax Lot 100, 37 2W 11A). Section 2. The public hearing on the question of annexation of the above described parcel of real property to the City of Central Point and for withdrawing said property from Jackson County Fire Protection District No. 3 and Bear Creek Valley Sanitary Authority will be held at the regular meeting of the Central Point City Council on the 1e day of � , 1980 commencing at 7:30 o'clock_ p.m., at the Central Point City Hall, at which date, time and place all interested persons may appear to be heard on the question of annexation. Page 2 - Ordinance No. 1_31/ Section 3. The City Recorder is directed to cause notice of hearing on the issues of annexation and withdrawal to be published once each week for two successive weeks prior to - the date of hearing in the Medford Mail Tribune, a newspaper of general circulation in the City of Central Point, Oregon, with the second publication to be no less than 24 hours prior to the hearing and shall cause notices of the hearing to be posted in four public places in the city for two successive weeks prior to the date of hearing. Section 4. The public hearing on the question of change of zone on the above described parcel from F -R (farm residential) to R -3 (high density multi - family) will be held at the regular meeting of the Central Point City Council on the 1p `�/ day of C� 1980 commencing at 7:30 o'clock p.m., at the Central Point City Hall, at which time all interested persons may appear to be heard on the question of said zone change. Section 5. The City Recorder is directed to cause notice of hearing on said zone change application to be published once each week for two successive weeks prior to the date of hearing in a newspaper of general circulation within the city, with the second publication to be no less than 24 hours prior to the hearing. Section 6. In addition to the foregoing, the applicant shall send notice of the public hearing regarding said zone change by registed or certified mail not less than seven days prior to the date of hearing to the owners of property situated within a 200 foot radius of the boundaries of the property which is the Page 3 - Ordinance No. subject of the application, as shown on the current assessor's tax rolls, and following such mailing shall furnish to the City Administrator a copy of the notice and a certificate certifying compliance with this ordinance and listing the name, address and tax roll information for all persons to whom notice was mailed and the date of mailing. Said certification shall also include the assessor's maps reflecting the location of the properties of persons to whom notice was mailed. Section 7. All notices required by this ordinance whether published, posted or mailed, shall include a brief des- cription of the application, including the name of the applicant and property owner, the general location of the property and the proposed change or use thereof, and the date, time and place of the public hearing.
