AN ORDINANCE AMENDING SECTION VI OF ORDINANCE NO. 1221
TO EXCLUDE PREMIUM TELEVISION SERVICE RECEIPTS IN COM-
PUTING THE FRANCHISE FEE PAYABLE TO THE CITY OF CENTRAL
POINT BY SOUTHERN OREGON BROADCASTING COMPANY DOING
BUSINESS AS SOUTHERN OREGON CABLE TV.
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS:
That Section VI of Ordinance No. 1221 is amended to read as follows:
"SECTION VI. The franchise fee to be paid to the City of Central Point
shall not exceed 3 percent of the franchisee's gross local service
receipts per year from the cable television operatioarr in the community'
(including all forms of consideration, such as lump sum payments, but
excluding premium television service of three (3) percent per year.
Gross local service receipts shall not include any fees received by S 0
Cable TV for advertising.
Such payment shall be made semi annually on or before the 15th of
April and the 15th of November. S 0 Cable TV shall file with the City
of Central Point a sworn statement of the gross local service receipts
for the preceding year and at said time, April 15th, shall make paymenl, .
to the City of Central Point the balance of its share of said receipts
for said year. Said sum shall be accepted by the City of Central Point
in lieu of any other license, privilege or occupation tax or for revenue
or regulation, excepting ad valorem property taxes uniformly assessed
during the term of this franchise.
All records of S 0 Cable TV relative to said matters shall be open
to inspection by the City of Central Point or its duly authorized agents
at all reasonable times."
