HomeMy WebLinkAboutOrdinance 1385ORDINANCE NO. 11,39,5 AN ORDINANCE PROVIDING THE TIME, MANNER AND MEANS FOR HOLDING A SPECIAL ELECTION RELATING TO RECALL OF COUNCIL MEMBERS JIM CORLISS, RICHARD HALLEY, LLOYD MANN AND CANDY RAYBURN WHEREAS, petitions seeking the recall of council members Jim Corliss, Richard Halley; L1: >yd Mann and Candy Rayburn have ueen filed with the t -ounty Clerk of Jackson County, Oregon, and tL, COUnty Clerk has i:>sueu a .artifiCat'_o,l of the reuall petitions in each case, and WHEREAS, Article II Section 18 of the Constitution of the State of Oregon provides that in the event a public officer does not resign within five days after the filing of a petition for recall, a special election shall be ordered within twenty days in his electoral district to determine whether the people will recall said officer, and the ballot for said election shall set forth in not more than 200 woods t3-e reasons for d =.manding the recall of said officer as set forth in the recall petition, and the officer's justification of his course, likewise in not more than 200 words, and WHEREAS, Article IV Section 14 of the Charter of the City of Central Point., Oregon provides that the City Council shall provide the time, manner and means for holding any special election, and WHEREAS, the County Clerk has specified that all of the voters in the city may vote on the recall of the Councilmembers at large, Jim Corliss and Candy Rayburn, and that in addition thereto, voters in Ward 2 may vote on the recall of Councilmember Page 1 - Ordinance No. 13,f'3- Lloyd Mann, and that in addition thereto voters in Ward 3 may vote on the recall of Councilmember Richard Halley, now, therefore THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. It is hereby ordered that there be a special election on the 7th day of May, 1980 in the City of Central Point, Oregon, to determine whether the legal voters of the City of Central Point will recall. the following counril members: (1) Jim Corliss, ?2) Richard Halley,- (3• Lloyd Mann, and (4) Candy Rayburn. Section 2. The ballot title for said city wide recall election is adopted as hereinafter set forth; and the following are the sponsers' and officers' statements, the number, ballot title and form in which the foregoing measures will appear upon the ballot: SPECIAL RECALL ELECTION CITY OF CENTRA_I. JIM CORLISS SPONSOR'S STATEMENT: Central Point Citizens for Fair Government James Wegs, Treasurer 830 N. 10th Central Point, Oregon 97502 Reasons for recall: (a) As a duly elected member of the City Council of Central Point, Page 2 - Ordinance No. -/-? JIM CORLI.SS' STATEMENT; (a) Ordinance 1369 Treasurer and Recorder Some of the duties of above two positions have been taken away from them due to an overload of work. For the past several years Central Point has lost interest money due to bookkeeping problems and investments. The State Treasurer, Norma Paulus, requested that this be corrected or Central Point would lose all State money. This was corrected by the hiring of the Finance Director, and the results have been very satisfying to the State, and monetary wise for the City, (b) line Ci.ty Hall was first iia tigated by McBee and Council in the early 70's. I have worked for this building all the way, as long as it °,vas not a ta,( hordes. on t`xx people of Central Point. The monies used were mostly Federal and State grants, and had to be used by a certain time or they would be taken away. (c) The maintenance contract in question was fully scrutinized by the Council and the city attorney and found to be in order. (c) The granting of a three year maintenance contract in violation of a one year bid specification and the City Charter. CANDY RAYBURN'S STATEMENT: A. Ordinance #1369 was iiut into effect to alleviate the problem of two bookeeping systems, which did not agree, and non - investment of many thousands of tax . dollars and put a stop to many continued years of adverse audits. B. A poll through the City water bill stated the citizens wanted a new City Hall but didn't want to pay for it. The additional dollars needed for the construction of two fire stations and a nicer City Hall was defeated. We went ahead with the original idea of Jim McBee's Council to build City Hall without additional taxes. C. There isn't any such specification in the City Charter as stated in the recall petition. The city's been doing business with the company in question for more than ten years. I've donated my time to the citizens of Central Point for more than five years. LLOYD MANN'S STATEMENT: (a) Ordinance No. 1369 was passed to correct the poor handling of the city funds and costing the taxpayers thousands of dollars each year. The city books did not balance and this did not meet State requirements. City Charter Article 6, Section 2 states the Town Council, shall by ordinance, prescribe the duties of appointed: and elected officers of the City of Central Point. (b) A survey of the people of Central Point showed they were in favor of a new city hall, but were not in favor of additional tax burden. The city hall being built is a scaled down model from the first proposal and with funds on hand without selling bonds and causing additional tax burden. (c) There is nothing in the charter setting the length of a contract. RICHARD HALLEY'S STATEMENT: (a) Reasons for approving Ordinance No. iL369 My decision on this issue was base$ :.,n several years of adverse audit reports and comments from our atate officials concerning this issue. Some duties and respunsbili ties of the Treasurer and Recorder are now the responsibility .5f the Finance Director, but at the same time more important duties and responsibilities were assigned to the Treasurer and Recorder. (b) The City Hall project was started under the McBee administration. I was in favor of it then and as long as it can be done without burdening the taxpayer with additional tax bonds outside of the city's budget I will still be in favor of it. (c) Maintenance contract I feel that we followed the charter and the State laws concerning this issue under the advisement of our city attorney's inter- Page 7 - Ordinance No. /39S� pretation of these laws and guidelines. My decisions were never based on personal animosities, but on the facts presented to me. I ask you at this time to retain me as your representative for Ward 3. I will continue to do my job in an honest and unbiased manner. Thank you for your support. 54. SHALL CENTRAL POINT CITY COUNCILMAN RTCHARD HALLPY BE .RECALLED? YES /-7 NO /-7 Section 5. The special election hereby called for the purpose of submitting the question of recall of the above named . council members shall be held on the 7th day of May, 1980, ar.d 6nal'l. begin at the hour of 8:00 o'clock a.m. on said day and continue until the hour of 8:00 o'clock p.m. on said day. The voting placee. for said election shall be Crater High School, 4410 Rogue Valley Blvd., Central Point, Oregon and Central Point Elementary School, 450 S. 4th, Central Point, Oregon. The officers for said election shall be designated by the Jackson County Clerk pursuant to law. Section 6.
