HomeMy WebLinkAboutCouncil Resolution 998RESOLUTION NO ~~ `~ A RESOLUTION DECLARING THE ANNEXATION OF 55.63 ACRES OF LAND LOCATEp ON THE SOUTH SIDE OF HAMRICK ROAD, AND WEST OF TABLE ROCK ROAD INTO THE CITY OF CENTRAL POINT, OREGON (Applicant(s): Victor Joseph, dba Modoc Orchards (37 2W 12B; TL 200) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Application has been made by the owners of certain real property for annexation into the City of Central Point, Oregon. The property consists of one tax lot and road right-of--way totaling approximately 55.63 acres. The property to be annexed is more particularly described as follows: All that certaui real property as described in Document Number 00-50801, as recorded in fhe Official Records of Jackson County, Oregon being located in the Northwest One- quarter of Section 12 and the Southwest One-quarter of Section 1, Township 37 South, Range 2 West, Willamette Meridian, Jackson County, Oregon, being more particularly described as follows: Beginning at the East-Southeast corner of Donation Land Claim No. 56, Township 37 Soirth,, Range 2 West of the Willamette Meridian in Jackson County, Oregon; thence along the southerly boundary of said claim, South 89°57`30" West, 1506.28 fcet to a point on the centerline of Bear Creek, being the most easterly corner of tract described in Instrument No. 90 22522 of the Official Records of said County; thence along said creek centerline, North 65°05'13" West, 45.16 feet; thence leaving said centerline of creek North 44°4754" East, 461.54 feet to a 5!8" rebar with red plastic cap; thence North 18°11 '12" West, 169.52 feet to a 5/8" rebar with red plastic cap;- thence North 21°09'25" West, 144.09 feet to a 5/8" rebar with red plastic cap; thence North 15°00'05" West, 149.26 feet to a 5/8" rebar with red Mastic cap; thence North 00°46'13" West, 268.23 feet to a 5/8" rebar with red plastic cap; thence North 08°32'53" West, 175.43 feet to a centerline of Ilamrick Road and the current City Limits lino of the City of Central Point; thence along said centerline and-said City Limits line, North 89°50`30" East, 2014.36 feet to centerline of Table Rock Road; thence leaving said City Limits line, and along last said centerline South 00°02`20" West, 1233.85 feet to intersect the North boundary of Donation Land Claim Na. 58 of said Township, Range and Meridian; thence along the North boundary of said Claim No. 58, North 89°51'21" West, 618.25 feet, more- or-less to the Point of Beginning. Containing 55.63 Acres, more or less. The above described property is not within the City of Central Point's Current corporate boundaries, but is contiguous to the City's existing corporate boundary and is within the Central Point Urban Growth Boundary (UGB). Section 2. The owner of the property proposed for annexation is Victor Joseph, and there is mutual consent to the annexation. Such written consent is on file at Central Point City Hall, 155 South Second Street, Central Point, Oregon. Section 3.ORS 222.125 provides that when all of the owners of land in the territory proposed for annexation and not less than 50% of the electors residing in such territory have consented in writing to the annexation of the land in the territory and file such written consentwith the City Council, the property may be annexed without the requirement for an election or a public hearing. Section 4. Annexation of the described property is consistent with the City's ability to provide facilities and services to the real property, as required by the City's Comprehensive Plan. Section 5. Pursuant to ORS 222.125, the property described in Section 1 above, shall be and hereby is, annexed to and made part of the City of Central Point, Oregon. Section 6. The City Administrator, or his designee, shall transmit a copy of this resolution to the Oregon Secretary of State, and this annexation shall be effective when filed with the Oregon Secretary of State pursuant to ORS. 222.180.
