HomeMy WebLinkAboutCouncil Resolution 996RESOLUTION NO A RESOLUTION DECLARING THE ANNEXATION OF 27.08 ACRES OF LAND LOCATED ON THE EAST SIDE OF GEBHARD ROAD, AND SOUTH OF WILSON ROAD INTO THE CITY OF CENTRAL POINT, OREGON (Applicant(s): Gerald F. May & Wendy Coats May (3~2W 35DD; TL 1200 & 1300) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Application has been made by the owners of certain real property for annexation into the City of Central Point, Oregon. The property consists of two tax lots and road right-of-way totaling approximately27.08 acres. The propertyto be annexed is more particularly described as follows: Commencing at the Section corner commonto Sections 35 and 36 in Township 36 South, Range 2 West and Sections 1 and 2 in Township 37 South, Range 2 West, Willamette Meridian, Jackson County, Oregon; thence North 00°OS' 16" West along the Section line common to said Sections 35 and 36, a distance of 446.60 feet to a 5/8 inch iron pin for the POINT OF BEGINNING; thence South 89°50'30" West 234.80 feet to a 518 inch iron pin; theflce South 00°09'30" East 101.06 feet to a 518 inch iron pin; thence South 89°39'07" West 1068.33 feet to a 5/8 inch-iron pin; thence continue South 89°39'07" West 10.00 feet to the Easterly right-of--way line of Gebhard Road; thence continue South 89°39'07" West 20.00 feet to the centerline of Gebhard Road; thence North 00°06'52" East along said centerline, 869.61 feet to a point which beazs North 89°55'23" West 20.00 feet from the Northwest corner of Parcel 2 as described in Instrument No. 92- 35022 of Jackson County Deed Records; thence South 89°55'23" East 20.00 feet to said Northwest corner; thence along the Northerly boundary of said tract South 89°55'23" East 644.97 feet; thence North 00°00'48" East 112.00 feet; thence South 89°55'23" East 664.77 feet to a point on the aforementioned Section line, common to Sections 35 and 36; thence South 00°05'16" East along said Section line, 871.59 feet to the POINT OF BEGINNING. The above described property is not within the City of Central Point's Current corporate boundaries, but is contiguous to the City's existing corporate boundary and is within the Central Point Urban Growth Boundary (UGB). Section 2. The owners of the property proposed for annexation are Gerald and Wendy May, and there is mutual consent to the annexation. Such written consent is on file at Central Point City Hall, 155 South Second Street, Central Point, Oregon. Section 3.ORS 222.125 provides that when all of the owners of land in the territory proposed for annexation and not less than 50% of the electors residing in such territory have consented in writing to the annexation of the land in the territory and file such written consent with the City Council, the property maybe annexed without the requirement for an election or a public hearing. Section 4. Annexation of the described property is consistent with the City's ability to provide facilities and services to the real property, as required by the City's Comprehensive Plan. Section 5. Pursuant to ORS 222.125, the property described in Section 1 above, shall be and hereby is, annexed to and made part of the City of Central Point, Oregon. Section 6. The City Administrator, or his designee, shall transmit a copy of this resolution to the Oregon Secretary of State, and this annexation shall be effective when filed with the Oregon Secretary of State pursuant to ORS. 222.180.
