HomeMy WebLinkAboutCouncil Resolution 993c' RESOLUTION NO A RESOLUTION DECLARING THE ANNEXATION OE 2.16 ACRES LOCATED ON 1'HE EAS`r SIDE OE' HAMRI CK ROAD, AND NORTH OF EAST PINE STREET INTO THE CITY OF CENTRAL POINT, OREGON (Applicant(s): Elden & Edna Mackey & Royal Trust/John Batzer (37 7W O1C; TL 1000 & 1100) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Application has been made by the owners of certain real property for annexation into the City of Central Point, Oregon. The property consists of two tax lots and sections of road right-of-way consisting of a total of 2.16 acres. The property to be annexed is more particularly described as follows: Commencing at a point on the Northerly boundary of llonation Land Claim No. 56 in Township 37 South, Range 2 West of the Willamette Meridian in Iackson County, Oregon, said point being North 89°37' 14" East 30.00 feet from the Southeast corner of llonation Land Claim No. 55, said Township and Range, said point also being on the Easterly right-of way line of Hamrick Road; thence North 00°13'57" West along said right-of--way line, 120.53 feet to the Northwest corner of tract described in Instrument No. 90-06311 of the Deed Records of said Jackson County, for the POINT OF BRGINNING; thence South 89°37' 14" West 82.49 feet to a point on the Westerly right-of--way line of said Hamrick Road; thence North 02°35'07" East along said right- of-way line 120.71 feet to a point which bears South 89°3714" West 76.55 feet from the Southwest corner of tract described in blstrument No. 89-27993 of said Deed Records; thence North 89°37' 14" East 76.55 feet to a point for Southwest corner of said tract, said point being on the aforementioned Easterly right-of--way line of Hamrick Road; thence continue North 89°37' 14" East along the Southerly boundary of said tract, 341.51 feet to the Northwest corner of tract described in Instrument No. 74-00201 said Deed Records; thence continue North 89°37' 14" East along the Northerly boundary of said tract, 361.35 feet; thence South 00°10'20" East along the Easterly boundary of said tract 120.55 feet to the Northeast corner of the aforementioned tract described in Instrument No. 90-06311 said Deed Records; thence South 89°3T 14" West along the Northerly boundary of said tract, 702.73 feet to the POINT OF BEGINNING. Containing 2.16 Acres, more or less. The above described property is not within the City of Central Point's Current corporate boundaries, but is contiguous to the City's existing corporate boundary and is within the Central Point Urban Growth Boundary (UGB). Section 2. The owners of the property proposed for annexation are Elden & Edna Mackey and Royal Trust/John Batzer, and there is mutual consent to the annexation. Such written consent is on file at Centra.t Point City Hall, 155 South Second Street, Central Point, Oregon. Section 3. ORS 222.17.5 provides that when all of: the owners of land ir. the territory proposed for annexation and not less than 50~ of the electors residing in such territory have consented in writing to the annexation of the land in the territory and file such written consent with the City Council, the property may be annexed without the requirement for an election or a public hearing. Section_9. Annexation of the described property is consistent with the City's ability to provide facilities and services to the real property, as required by the City's Comprehensive Plan. Section 5. Pursuant to ORS 222.125, the property described i.n Section 1 above, shall. be and hereby is, annexed to and made part of the City of Central Point, Oregon. Section 6. The City Administrator, or his designee, shall transmit a copy of this resolution to the Oregon Secretary of State, and this annexation shall be effective when filed with the Oregon Secretary of State pursuant to ORS. 222.180.
