HomeMy WebLinkAboutCouncil Resolution 973RESOLUTION NO Ci 13 A RESOLUTION DECLARING THE ANNEXATION OF 1.45 ACRES OF LAND LOCATED NEAR THE INTERSECTION OF TULANE AVENUE AND CARLTON AVENUE INTO THE CITY OF CENTRAL POIN`T', OREGON (Applicant: Amy VanDomelan) (37 2W 03CC; TAX LOTS IG00 and 1700) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Application has been made by the owners of certain real property for annexation into the City of Central Point, Oregon. The property consists of two tax lots and sections of road right-of--way consisting of a total of 1.45 acres. The property to be annexed is more particularly described as follows: BEGINNING at the most southerly comer of Lot 1, Block2 of "PARKVIEW SUBDIVISION as recorded in Volume 7, Page 17 of the Plat Records of Jackson County, Oregon, said corner being on the easterly right-of-way .of Carlton Avenue; thence leaving said right-of-way, North 50°50'00" East, along the southerly boundary of said Lot 1, a distance of 56.82 feet to the most southeasterly corner of said Lot 1, said corner also being the southwest corner of Lot 4 of said PARKVTEW SUBDIVISION; thence North 89°50*30" East, along the south line of said Lot 9, a distance of 125.00 -feet to the southeast corner of said Lot 4, said corner also being the southwest corner of Lot 5 of said Subdivision; thence continuing North 89°50'30" East, along the south line of said Lot 5, 60.92 feet (record 61.00 feet); thence, leaving said south line, North 00°14'10" West, " parallel with the east line of said Lot 4, a distance of 164.99 feet (record 165.01 feet) to the south right-of-way of Tulane Avenue, said south right-of-way being the north boundary of said Block 2 and.the existing Central Point City Limit; thence South 89°50'31" West (record South 69°50'30" West), along said south right-of-way and said north boundary extended and said City Limit, 431.32 feet to the intersection of the centerline of Carlton Avenue with said City Limit; thence, leaving laid City Limit, South 39°12'92" East, along said centerline, 282.79 feet;- thence North 50°97'16" East 30.00 feet to the POIN2 OF BEGINNING. The above -described property is not within the City of Central Point's Current corporate boundaries, but is contiguous to the City's existing corporate boundary and is within the Central Point Urban Growth Boundary (UGB). Section 2. The owner of the property proposed for annexation is the City of Central Point, and there is mutual consent to the annexation. Such written consent is on file at Central Point City Hall, 155 South Second Street, Central Point, Oregon. Section 3.ORS 222.125 provides that when all of the owners of land in the territory proposed for annexation and not less than 50% of the electors residing in such territory have consented in writing to the annexation of the land in the territory and file such written consent with the City Council, the property maybe annexed without the requirement for an election or a public hearin;. Section 4. Annexation of the described property is consistent with the City's ability to provide facilities and services to the real property, as required by the City's Comprehensive Plan. Section 5. Pursuant to ORS 222.125, the property described in Section I above, shall be and hereby is, annexed to and made part of the City of Central Point, Oregon. Section 6. The City Administrator, or his designee, shall transmit a copy of this resolution to the Oregon Secretary of State, and this annexation shall be effective when filed with the Oregon Secretary of State pursuant to ORS. 222.180.
