A RESOLUTION DECLARING THE ANNEXATION
OF 5.84 ACRES OF LAND LOCATED ON THE EAST SIDE OF PACIFIC HIGHWAY,
SOUTH OF MILLER ESTATES SUBDIVISION AND WEST OF GRIFFIN CREEK INTO
THE CITY OF CENTRAL POINT, OREGON

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. Application has been made by the owners of certain real property for
annexation into the City of Central Point, Oregon. The property consists of three tax
lots and sections of road right-of-way consisting of a total of 5.84 acres. The
property to be annexed is more particularly described as follows:
Beginning at...the---Southeast corner of Lot 39 of MILLER ESTATES
SUBDIVISION, PHASE 1, according. to the official plat thereof,
now of record, in Jackson County, Oregon, said point also being
on the North line of Tract VII described in Document No. 66-
08975, Official Records of Jackson County, Oregon; thence along
said North line, North 88°99'48" East (record North 88°49'10"
East), 13.45 feet to a 5/8 inch iron pin at the Northeast corner
of said Tract VII; thence along the East lines of Tracts V, VI
and VII of the above said Document, South 00°15'29" East, 446.98
feet (record South 00°16'50" East, 947.065 feet) to a 5/8 inch
iron pin at the Southeast corner said Tract V; thence along the
South line of said Tract V, South 89°38'99" West,, 354.855 feet
(record South 89°37'40" West, 354.835 feet to a 5/8 inch iron.
pin on the Northeasterly line of North Pacific Highway No. 99;
thence along the Westerly prolongation of the South line of said
Tract V, South 89°38'49" West, 67 feet, more or less, to the
centerline of said Highway No. 99; thence along said centerline,
North 35°07'17" West, 531.5 feet, more or less, to the Westerly
prolongation of the North line of said Tract VII; thence along
said prolongation, North 88°49'48" East, 66. feet, more or less,
to the Northeasterly line of said Highway; thence along the
North line of said Tract VII,~North 88°49'48" East (record North
88°49'10"~ Eastj, 695.98 feet to the point of beginning.
Containing 5.84 acres, more or less.

The above -described property is not within the City of Central
Point's Current corporate boundaries, but is contiguous to the City's existing corporate
boundary and is within the Central Point Urban Growth Boundary (UGB).
Section 2. The owners of the property proposed for annexation are Ruth Crews
and Robert S MacLellan, and there is mutual consent to the annexation. Such written
consent is on file at Central Point City Hall, 155 South Second Street, Central Point,
Oregon.
Section 3. ORS 222.125 provides that when all of the owners of land in the
territory proposed for annexation and not less than 50% of the electors residing in
such territory have consented in writing to the annexation of the land in the territory
and file such written consent with the City Council, the property may be annexed
without the requirement for an election or a public hearing.
Section 4. Annexation of the described property is consistent with the City's
ability to provide facilities and services to the real property, as required by the City's
Comprehensive Plan.
Section 5. Pursuant to ORS 222.125, the property described in Section 1
above, shall be and hereby is, annexed to and made part of the City of Central Point,
Oregon.
Section 6. The City Administrator, or his designee, shall transmit a copy of this
resolution to the Oregon Secretary of State, and this annexation shall be effective
when filed with the Oregon Secretary of State pursuant to ORS. 222.180.
