A RESOLUTION DECLARING THE ANNEXATION
OF 12.4 ACRES OF LAND LOCATED ON THE WEST SIDE OF HANLEY ROAD,
SOUTH OF DIEGO COURT AND EAST OF GRANT ROAD INTO
THE CITY OF CENTRAL POINT, OREGON

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. Application has been made by the owners of certain real property for
annexation into the City of Central Point, Oregon. The property consists of two tax
lots and sections of road right-of-way consisting of a total of 12.4 acres. The
property to be annexed is more particularly described as follows:
Commencing at the northwest conger of Donation Land Claim Nnmber 66 of said
township, range, and meridian; thence North 89°52'46" West, a distance of 84.68
feet to a point on the centerline of Hanky Road; thence NoHh 03°49'32", East along
said centerline, a distance of 1317.34 feet to the northeast turner that Tract of brad
described in Volume 243, Page 176, of the Deed Records of Jadcsoo County,
Oregon; thence abng the erterior boundary of said Volume 243, Page 176 the
following rnnrses: South 80°59'32^ West, a distance of 30.77 feet to the westerly
right-of--way line of said Hanley Road, a public road, and the True Point of
Beginning; leaving said westerly right-otway South 80°59'32" West, a distance o[
105.64 fat; South 03°49'32" West, a distance of 309.62 feet; North 79°57'32° East,
a distance of 106.10 feet to the westerly right otway of IIanky Road; thence leaving
last said ezterior boundary Sonth 03°49'32° West along said right-olway, a
distance of 443.62 feet to the north tine of that Tract described in Volume 229, Page
446 of the Deed Records of Jackson County, Oregon; thence abng last said north
Gne South S9°55'02"West, a distance of 488.82 feet to the easterly right-of--way of
Grant Road, a public road; thence abng last said right-of--way North 14°44'20°
West, a distance of 660.16 feet to a found 5/8-inch diameter iron pin with an orange
plastic cap marked "HARDEY ENG. & ASSOC." on the southerly line of
COUNTRY MEADOW ESTATES SUBDIVISION, recorded December 17,1998 in
Volume 24 of Plats at Page 48 of Records of Jackson County, Oregon, 51ed as
Survey Number 15979, in the office of the Jackson County Surveyor, thence abng
the southerly boundary of said COUNTRY MEADOW ESTATES SUBDIVLSION
the following courses: North 80°59'32" East, abng the southern line of the Tract
described fn Document Number SS-22262 of the Official Records of Jackson Connty,
Oregon, a distance of 305.74 feet to a found 5/8-inch diameter iron pin with an
orange plastic eap marked "IIARDEY ENG. & ASSOC."; North 00°03'36" East a
distance of 297.39 feet; South 89°55'53" East, a distance of 42A.19 feet to the
westerly right-of--way of said IIanky Road; thence leaving said southerly boundary,
along last said right-of--way, South 03°44'32" West, a distance of 233.21 feet to the
true Point of Beginning.
TOGETHER WITH the westerly portion of IIanky Road, a Jackson County Road,
being a30.00-toot wide strip of land frosting that certain real property described
hereinabove, being approximately 985 feet in length.
ALSO TOGETHER WITII the easterly portbn of Grant Road, a Jackson County -
Road, being a 25.00-foot wide strip of bod fronting that certain real property
described hereinabove, being approximately 660 fcet in length.
The above described property is not within the City of Central
Point's Current corporate boundaries, but is contiguous to the City's existing corporate
boundary and is within the Central Point Urban Growth Boundary (UGB).
Section 2. The owners of the property proposed for annexation are Michael &
Cheri Williams and Randall & Allan Nielsen, and there is mutual consent to the
annexation. Such written consent is on file at Central Point City Hall, 155 South
Second Street, Central Point, Oregon.
Section 3. ORS 222.125 provides that when all of the owners of land in the
territory proposed for annexation and not less than 50% of the electors residing in
such territory have consented in writing to the annexation of the land in the territory
and file such written consent with the City Council, the property may be annexed
without the requirement for an election or a public hearing.
Section 4. Annexation of the described property is consistent with the City's
ability to provide facilities and services to the real property, as required by the City's
Comprehensive Plan.
Section 5. Pursuant to ORS 222.125, the property described in Section 1
above, shall be and hereby is, annexed to and made part of the City of Central Point,
Oregon.
Section 6. The City Administrator, or his designee, shall transmit a copy of this
resolution to the Oregon Secretary of State, and this annexation shall be effective
when filed with the Oregon Secretary of State pursuant to ORS. 222.180.
