A RESOLUTION ISSUING A FINAL ORDER
ON THE PLANNING COMMISSION DECISION APPROVING
A TENTATIVE PLAN FOR JACKSON OAKS SUBDIVISION, PHASES 2 & 3
Recitals
This matter camebefore the City Planning Commission ofthe City ofCentral Point, Oregon
for public hearing on December 3, 2002. The City Council reviewed City staff reports on
December 12, 2002 and at a Study Session on December 17, 2002; considered the
recommendations ofother professionals; and heard testimony and comments from effected
property owners and all persons wishing to be heard.
2. Jackson Oaks Subdivision is part of the larger Twin Creeks Master Plan and the Transit
Oriented Development (TOD) zoning which was adopted by the City of Central Point in
January 2001. The City notified affected property owners of a plan amendment and zone
change prior to this adoption and in compliance with state law.
Now, therefore;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. Criteria Annlicable to Decision. The following chapters of the Central Point
Municipal Code apply to this appeal:
A. Chapter 1.24, Public Hearing Procedures;
B. Chapter 16.10.010 et seq.; Tentative Plans
C. Chapter 17.65.010 et seq.; TOD Districts and Corridors
Section 2. Granting Approval. The City Council hereby grants applicant's request
and concurs with the decision of the Planning Commission to approve the tentative plan as follows:
A. The applicant shall comply with the conditions recommended by City staff in the
Planning Commission reports and approved by the Commission in Resolution 561.

Section 3. Findings of Pact and Conclusions of Law. The City Council hereby adopts the
following findings and conclusions of law in support of its decision in Section 2:
1. The tentative plan application submitted for Jackson Oaks Subdivision, Phases 2 & 3
meets the City's municipal code requirements for zoning and subdivision;
2. The conditions imposed by the Planning Commission and further consideration made
by the City Council during their ammal review of the pre-annexation development
agreement ensure the proper implementation of City Codes and addresses the
unwelcome effects of new development to sunounding property owners;
3. The approval of the tentative plan was made in the interest of health, safety and
general welfare of the citizens of Central Point and was confinned by other agencies
and public safety officials;
4. Ample opportunity was given for public hearing and comment from affected parties
within the City limits and the Urban Growth Boundary (UGB).
5. The evidence presented was carefully considered in arriving at the City's
conclusions.
