AGREEMENT
Between Jackson County, a political subdivisoin of the State of Oregon, hereinafter
called ("County") and the City of Central Point, an Oregon municipal corporation, hereinafter
called ("City"):
Recitals
A. The County presently has jurisdiction over the Roads (as defined below) within
the city limits of the City. Because of the geographical location of the Roads, the costs of
maintenance and improvements to the Roads has become unduly burdensome to the County.
B. The City is involved in an ongoing street improvement program for roads and
streets within the city limits. The City wishes to exercise jurisdiction over the Roads to ensure
that the Roads aze included within the City's street improvement program.
C. ORS 373.270 permits the jurisdiction over county roads to be transferred to a city
whenever the county governing boazd deems it necessary, expedient or for the best interest of the
county to surrender jurisdiction, and the governing body of the City deems it necessary or
expedient and for the best interest of the City to acquire jurisdiction over the county roads to the
same extent as it has over other public streets and alleys of the City.
D. The Boazd of Commissioners of the County has, after satisfying the notice
requirements~stated in ORS 373.270(2), (3) and (4), adopted an Order authorizing surrender of
jurisdiction over the Roads and execution of this Agreement on behalf of the County.
E. The City Council of the City has adopted a resolution authorizing the acceptance
of jurisdiction over the Roads and execution of this Agreement on behalf of the City.
Agreement
NOW THEREFORE, the parties agree as follows:
1. Identification of Roads. This Agreement concerns portions of the following
county roads within the City:
a. Hopkins Road, from Fourth Street to Bursell Road
b. Bursell Road, from Hopkins Road to Hemlock Avenue
The roads identified above are collectively referred to in this Agreement as the
"Roads". The Roads aze shown on Exhibit A attached hereto and incorporated into this
Agreement by reference.

2. Transfer of Jurisdiction. The County hereby transfers jurisdiction over the Roads
to the City, and the City hereby assumes jurisdiction over the Roads from the County. The City
is hereby solely responsible for all construction, improvements, repair, maintenance, levying and
collection of assessments and control of access over the Roads. The City shall have the same
jurisdiction over the Roads as by its charter and the laws of the State of Oregon aze given or
granted it over any of the public streets and alleys of the City.
3. Payment By County. Within 30 days of the execution of this Agreement by both
parties, the County shall make aone-time payment to the City in the amount of $62,000.00 as a
contribution towards defraying the City's costs of constructing, improving, repairing and
maintaining the Roads. After making the payment, the County shall have no fiu-ther obligation,
financial or otherwise, with regard to~he Roads.

I, Dale Petrasek, being first duly sworn, depose and say that I am the duly appointed County
Engineer of Jackson County, Oregon; that I did on the 14th day of May, 1998, cause notices to be
posted, a copy of which is hereto attached and made a part of this affidavit, one on the official notice
bulletin boazd on the 1st floor of the County Courthouse in Jackson County, Oregon, and .at three
public places in the vicinity of the proposed portion of the roads to be transferred to-wit:
1. On COPCO pole #1206 located at the southwest side of the intersection of South 4th
Street and Hopkins Road on the south side of Hopkins Road.
2. On COPCO pole #3621 located on the west side of Bursell Road approximately 100 feet
north of Hemlock Avenue.
On Southern Oregon Cable pole #304 located west of Sandra Lane and east of Jeff
Place on the north side of Hopkins Road, approximately 15 feet west of fire hydrant
#43.
All of which was done thirty days previous to the 8th of July, 1998.

WHEREAS, the county presently has jurisdiction over portions of Hopkins and Burrell Roads that
are within the city limits of Central Point; and
WHEREAS, the City of Central Point has formally requested that Jackson County transfer
jurisdicf ion of portions of Hopkins Road (from 4th Street to Burrell Road) and Burrell Road (from Hopkins
Road to Hemlock Avenue); and
WHEREAS, Jackson County will make aone-time payment to the city in the amount $62,000 as a
contribution towards defraying the city's cost of constructing, improving, repairing, and maintaining the roads,
after which, the county will have no further obligation to said portions; and
WHEREAS, said request is consistent with county policy.
Now, therefore, the Board of County Commissioners of Jackson County ORDERS:
1. Pursuant to ORS 373.270, a public hearing be held on July 8, 1998, in the Courthouse
Auditorium, Medford, Oregoq at 9:30 a.m. for the purpose of considering objections by auy person interested
aad that notice of the hearing be given according to law.
2. Pursuant to ORS 373.270(2)(x), the Roads and Parks Services Director is directed to post
notices of the proposed transfer of jurisdiction is thret public places.

WHEREAS, the city wishes to exercise jurisdiction over the roads to ensure they are included in the
city's street improvement program. ORS 373.270 permits the jurisdiction over county roads to be transferred to
a city whenever the county governing board deems it necessary, and the governing body of the city deems it
necessary and in the best interest of the city to acquire jurisdiction over the county roads to the same extent as it
has over other public streets and alleys of the city. The city of Central Point has agreed to the transfer; and
WHEREAS, within 30 days of execution of this ag'reernent, the county shall make aone-time
payment to the city in the amount of $62,000 as a contribution towards defraying the city's costs of constructing,
improving, repairing, and maintaining the roads. After making the payment, the county shall have no further
obligation, financial or otherwise, with regard to the roads.
Now, therefore, the Board of County Commissioners of Jackson County ORDERS:
The County Administrator is hereby authorized to execute an agreement for the jurisdictional
transfer of portions of Hopkins and Burrell Roads to the City of Central Point.

NOW THEREFORE, the parties agree as follows:

a. Taylor Road, from Haskell Street to a point 220 feet west of the centerline
of Silver Creek Drive
b. Haskell Street, from a point 700 feet north of West Pine Street to Taylor
Road.
The roads identified above are collectively referred to in this Agreement as the
"Roads". The Roads are shown on Exhibit A attached hereto and incorporated into this
Agreement by reference.

2. Transfer of Jurisdiction. The County hereby transfers jurisdiction over the
Roads to the City, and the City hereby assumes jurisdiction over the Roads from the
County. The City is hereby solely responsible for all construction, improvements, repair,
maintenance, levying and collection of assessments and control of access over the
Roads. The city shall have the same jurisdiction over the Roads as by its charter and the
laws of the State of Oregon are given or granted it over any of the public streets and alleys
of the City.
3. Payment By County. Within 30 days of the execution of this Agreement by
both parties, the County shall make aone-time payment to the City in the amount of
$116,000.00 as a contribution towards defraying the City's costs of constructing,
improving, repairing and maintaining the Roads. Subject to having appropriated funds, the
county will pay 50% of the cost of engineering and construction when it is necessary to
replace the bridge over Griffin Creek. The city will allow the county to review the plans and
cost estimates for the bridge replacement. The city will make any changes to the plans
that are agreed upon by the County and City engineers. The County will budget the 50%
share of the cost in the next budget cycle after the plans and estimates has been
approved: The county will make payment to the city within 30 days for its 50% share upon
receipt of a billing show the final cost of engineering and bridge construction. After making
the $116,000 payments, the County shall have no further obligation, financial or otherwise,
with regard to the Roads, except the obligation to the bridge construction as stated herein.
4. Availability of Funds. Notwithstanding any other provision of the Agreement to
the contrary: In the event insufficient funds are appropriated for the payments under this
Agreement and the County has no other lawfully available funds, then the Parties may
terminate this Agreement with no further liability or penalty to each other. The Parties shall
deliver written notice to one another of such termination. Notice by the County shall be no
later than thirty (30) days from the determination by the County of the event of its non-
appropriation. Notice by the City of its termination of Agreement shall be no later than 30
days from receipt of County's notice. If City terminates this Agreement, City will reimburse
County for any County funds given but not spent for improvements upon the above
described Roads. Said reimbursement shall not exceed $116,0000 and "Improvements" is
not to be interpreted to include routine maintenance.

A RESOLUTION AUTHORIZING ACCEPTANCE OF JURISDICTION
OVER FREEMAN COURT AND A PORTION OF FREEMAN ROAD
WHEREAS, ORS 373.270 allows cities to accept jurisdiction
over county roads or parts thereof within a city whenever the
city's governing body deems it necessary or expedient and in the
best interests of the city to acquire jurisdiction.
NOW, THEREFORE;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. Central Point deems it necessary and expedient
and in the best interests of the City to acquire jurisdiction
over Freeman Road from East Pine Street to a point 350 feet south
of Oak Street, and Freeman Court from Freeman Road to the
southerly right-of-way line of East Pine Street, both of which
roads are within the City of Central Point.
Section 2. The Mayor is authorized and directed to sign the
original of Exhibit "A", which is an agreement between the City
of Central Point and Jackson County setting forth the terms and
conditions of the jurisdictional transfer of the roads mentioned
above. Exhibit "A" is attached hereto and by this reference
incorporated herein.

Freeman Road to the City of Central Point
Dear Deanna:
Enclosed is your fully executed copy of the Agreement transferring jurisdiction of Freeman
Court and a Portion of Freeman Road (from East Pine Street to a point 350 feet south of Oak
Street) to the City of Central Point. Per the Agreement, a warrant has been requested in the
amount of $60,000.00 and will be mailed to you direct from the Courthouse. It usually takes a
couple of weeks for them to cut the check.

CENTRAL POINT
WHEREAS, the county presently has jurisdiction over Freeman Court from Freeman
Road to the southerly right-of--way line of East Pine Street and Freeman Road from East Pine
Street to a point 350 feet South of Oak Street; and
WHEREAS, the city of Central Point has agreed to accept jurisdiction over a portion of
the roads to ensure they are included in the city's street improvement program and ORS 373.270
permits the jurisdiction over county roads to be transferred to a city; and
WHEREAS, within 30 days of execution of this agreement, the county will make aone-
timepayment to the city in the amount of $60,000; and
WHEREAS, after making said payment the county shall have no further obligation,
financial or otherwise, with regard to the road.
Now, therefore, the Board of County Commissioners of Jackson County ORDERS:
1. Approval of the jurisdictional transfer to the city of Central Point for Freeman Court
from Freeman Road to the southerly right-of--way line of East Pine Street and Freeman
Road from -East Pine Street to a point 350 feet South of Oak Street.
2. The County Administrator is authorized to sign any and all necessary documents to
effect this jurisdictional transfer.

Pursuant to ORS 373.010, the Oregon Transportation Commission is authorized and directed,.
whenever the route of any state highway passes through the corporate limits of any city, to
select or designate the streets of the city over which the state highway shall be routed, or
change such routing when in its opinion the interests of the motoring public will be better
served.
Pursuant to ORS Chapters 366.395 and 373.015, the State may transfer its interest to any of its
property not needed by it for highway purposes to any other governmental body or political
subdivision within the State of Oregon, subject to such restrictions, if any, imposed by deed or
other legal instrument or otherwise imposed by State.
Pursuant to ORS190.110 and ORS 366.775, the State may enter into any agreement with any
city for the relocation of any highway.
The M.P. 1.64 to M.P. 3.60 Section of the Rogue Valley Highway, State Highway No. 63, is no
longer needed for state highway purposes and has been eliminated by departmental resolution
_ - as a portion of the Rogue Valley Highway. The segment eliminated from the highway is
designated as Unit 1,~as more fully described below; and as sliowri on the map attached hereto
marked Exhibit A and by this reference made a part hereof. Unit 1 is needed for the service of
persons living thereon or for a community served Thereby.
The City of Central Point and the Oregon Transportation Commission entered into an
agreement on May 24, 2004, relating to the elimination, disposition, maintenance and repair of
Unit 1. Said agreement provides that the Oregon Transportation Commission shall, by

resolution, formally eliminate Unit 1 as a portion of the Rogue Valley Highway and the state
highway system; that all right, title, and interest of the State of Oregon in Unit 1 shall be
conveyed to the City; and that the Unit shall be maintained by the City as a portion gf its city
street system as long as needed for the service of persons living thereon or for a community
served thereby.
THEREFORE, IT HAS BEEN RESOLVED BY THE OREGON TRANSPORTATION
COMMISSION AS FOLLOWS:
1. The M.P. 1.64 to M.P. 3.60 Section of`the Rogue Valley Highway, State Highway No. __,
-. - ~ - - : 63; in,, Jackson County, Oregon, is no longer needed by the State of Oregon-•as a portion
of the state highway system. Said portion hereinafter referred to as Unit 1 has been duly
eliminated as a portion of the Rogue Valley Highway and the state highway system. All
right, title, and interest of the -State of Oregon in Unit 1 hereby passes to and vests in
the City of Central Point as a portion of its city street system as long as needed for the
service of persons living thereon or a community served thereby.
Any right-of-way being conveyed in which state has any title shall be vested. in City only
so long as used for public road purposes. If said right-of-way is no longer used for public
road purposes, it shall automatically revert to State. Unit 1 is described as follows:
Unit 1
All land within the right of way boundaries of the Rogue Valley
Highway, State Highway No. 63 as presently located from
Engineering Station 526+44 (MP 1.64) running southeasterly to
Engineering Station 630+01 (MP 3.60), excluding Bridge No.
01935A and lying in Section(s) 3, 10 and 11, Township 36S,
Range 2W, Willamette Meridian, Jackson County, Oregon.
2. State shall retain ownership of Bridge No. 01935A, located at approximately Engineering
- ~ - - Station 555+14-until such atime-that"the structure is replaced or alte~ed`fo -adequately
allow the passage of a 50 year storm and designed fora 50 year life. State shall-also
retain responsibility for scour protection, flooding and major structural repairs of said
bridge.
3. State shall also retain ownership and control of the traffic control devices located at the
intersection of Rogue Valley Highway with Scenic Avenue and Beall Lane, as these
signals are outside of the boundaries of Unit 1.
4. In recognition of the benefits to the motoring public, Unit 1 will retain the State Route OR
99 designation.

5. The property above described is transferred subject to the rights of any utilities located
within said property and further subject to the rights of the owners of said existing
facilities if any there be, to operate, reconstruct, and maintain their utility fac~ities
presently located within said property.
Under the authority delegated by the Oregon Transportation Commission to the Director in
Delegation Order No. 2 dated June 13, 2003, the Resolution Eliminating a Section of
Highway from the State Highway System and Minor Amendment to the Oregon Highway Plan
for Jurisdictional Transfer No. 746 was approved on January 6, 2005.

AGREEMENT
BETWEEN: JACKSON COUNTY, a political subdivision
of the State of Oregon ("County")
AND: CITY OF CENTRAL POINT, an Oregon municipal corporation ("City")

Recitals
A. The County presently has jurisdiction over the Road (as defined below) within the
city limits of the City. Because of the geographical location of the Road, the costs of
maintenance and improvements to the Road has become unduly burdensome to the County.
B. The City is involved in an ongoing street improvement program for roads and
streets within the city limits. The City wishes to exercise jurisdiction over the Road to ensure
that the Road is included within the City's street improvement program.
C. ORS 373.270 permits the jurisdiction over county roads to be transferred to a city
whenever the county governing board deems it necessary, expedient or for the best interest of the
county to surrender jurisdiction, and the governing body of the city deems it necessary or
expedient and for the best interest of the city to acquire jurisdiction over the county roads to the
same extent as it has over other public streets and alleys of the city.
D. The Board of Commissioners of the County has, after satisfying the notice
requirements stated in ORS 373.270(2), (3) and (4), adopted an order authorizing surrender of
jurisdiction over the Road and execution of this Agreement on behalf of the County.
E. The City Council of the City has adopted a resolution authorizing the acceptance
of jurisdiction over the Road and execution of this Agreement on behalf of the City.
Agreement
NOW THEREFORE, the parties agree as follows:
1. Identification of Roads. This Agreement concerns portions of the following
County road within the City:
a. Scenic Avenue from Highway 99 to the center of Bridge #176 over Griffin
Creek.
The road identified above is referred to in this Agreement as the "Road". The
Road is shown on Exhibit A attached hereto and incorporated into this Agreement by reference.

2. Transfer of Jurisdiction. The County hereby transfers jurisdiction over the Road
to the City, and the City hereby assumes jurisdiction over the Road from the County. The City is
hereby solely responsible for all construction, improvements, repair, maintenance, levying and
collection of assessments and control of access over the Road. The City shall have the same
jurisdiction over the Road as by its charter and the laws of the State of Oregon are given or
granted it over any of the public streets and alleys of the City.
3. Payment By County. Within 30 days of the execution of this Agreement by both
parties, the County shall make aone-time payment to the City in the amount of $112,000.00 as a
contribution towards defraying the City's costs of constructing, improving, repairing and
maintaining the Road. After making the payment, the County shall have no further obligation,
financial or otherwise, with regard to the Road.

WHEREAS, the county has determined that a portion of Scenic Avenue, from Highway 99 to the
center of bridge # 176 over Griffm Creek, has become too burdensome and not cost effective for the county to
maintain.; and
WHEREAS, the city of Central Point has determined that it is in the best interest of the city to
accept the jurisdictional transfer of this portion of Scenic Avenue; and
WHEREAS, Oregon Revised Statute 373.270 permits the jurisdiction over county roads to be
transferred to a city whenever the county governing boazd deems it necessary, expedient, or for the best
interest of the county to surrender jurisdiction, and the governing body of the city deems it necessary or
expedient for the best interest of the city to acquire jurisdiction ;and
WHEREAS, the Jackson County Boazd of Commissioners desires to schedule a public hearing to
receive comments concerning the jurisdictional transfer.
Now, therefore,
The Board of County Commissioners of Jackson County ORDERS:
1. A public hearing is scheduled for December 9, 1998, at 9:30 a.m. in the Courthouses
Auditorium to heaz comments and input on this jurisdictional transfer.

Central Paint Municipal Cnde Section 1.7.46.020; now, therefore,

Section 1. The Planning Commission finds that shopping centers
and multi-use buildings exist ar are created within the C-5 zone as a

Section 2. The Planning Commission finds that barber shops,
beauty salons, and manicure salons are similar and compatible with other
permitted uses in the C-5 zone if they can be located with~.n a shopping
center, multi-use buildings, and/or hotel or motel lobbies and that said
uses are not permitted in any other planning zane within the City under
these particular circumstances.
Section 3. Barber snaps, beauty salons, and manicure snaps are
hereby ruled to be a permitted use in a C-5 Thoroughfare Commercial zone,
