HomeMy WebLinkAboutCouncil Resolution 886RESOLUTION NO. n ti(d A RESOLUTION ISSUING A FINAL ORDER ON THE REVIEW OF THE PLANNING COMMISSION DECISION APPROVING A SITE PLAN REVIEW FOR CENTRAL POINT PERK (Applicants: Bazbara and Stephen Brown) (372W02CC Tax Lot 4100, Central Point Perk) Recitals This matter came before the City Council of the City of Central Point, Oregon, for hearing on August 26, 1999 and again on November 18, 1999, on Council review of the Planning Commission decision approving a Site Plan Review to add adrive- through window to applicants' business, Central Point Perk, in a C-4, Tourist and Office Professional district of the City. The City Council reviewed the findings of fact and conclusions of law and the conditions of approval adopted by the Planning Commission, and received comments from all persons wishing to be heazd on the matter. Now, therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT. OREGON, AS FOLLOWS: Section 1. Criteria Applicable to Decision.. The following chapters of the Central Point Municipal Code apply to this review: A. Chapter 1.24, Public Hearings Procedures; B. Chapter 15.40, Uniform Standazds for Public Works Construction Projects and Fees; C. Chapter 17.44, C-4, Tourist and Office Professional District; D. Chapter 17.60, General Regulations; E. Chapter 17.64, Off-Street Parking and Loading; F. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval. Section 2. Findines of Fact and Conclusions of Law. The City Council hereby adopts by reference all. findings of fact and conclusions of law set forth in Planning Commission Resolution No. 459. Section 3. Conditional Approval. The City Council hereby affirms the decision of the Planning Commission to approve the Site Plan Review for the Central Point Perk subject to the Planning Commission conditions of approval and as hereafter modified: The requirements that the applicants make improvements to adjacent public infrastructure consisting of sidewalks, driveways and alleyways aze removed. 2. The adjacent alley between 8'h St. and 9`h St. is designated one-way in the direction of 8`h St. and the applicant shall construct a curb return on the site to prevent vehicles leaving the drive-through from exiting onto 9'" St. The applicants shall construct one on-site drain to handle run-off from the drive- through. The drain shall be located at the low point near the curb return and must be constructed in accordance with the Uniform Plumbing Code. 4. The applicants shall enter into a lease agreement with the City to permit the construction of private improvements associated with the drive-through within the public right-of--way.
