RESOLUTION NO 899
A RESOLUTION DECLARING THE ANNEXATION
OF 194 ACRES OF LAND LOCATED ON THE WEST SIDE OF PACIFIC HIGHWAY
(SR 99), NORTH OF TAYLOR ROAD AND EAST OF GRANT ROAD INTO
THE CITY OF CENTRAL POINT, OREGON

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. Application has been made by the owners of certain real property for annexation
into the City of Central Point, Oregon. The property consists of seventeen tax lots consisting of a
total of 194 acres. The property to be annexed is more particularly described as follows:
Commencing at a brass cap monumentinq the southwest corner of the southwest quarter of
Section 3, Township 37 South, Range 2 West of the Willamette Meridian, Jackson County,
Oregon; thence North 89°49'38" East, along the south line of said .southwest quarter,
1330.58 feet, to the southeast corner of the southwest quarter of the southwest quarter
of said Section 3; thence South 0°14'39" East, on the southerly projection of the east
line of said quarter-quarter, 30.00 feet, to the south right of way line of Taylor Road;
thence South 89°49'38" West, along said right of way line, 7.00 feet, to the POINT OF
BEGINNING; thence North 0°19'39" West, 60.00 feet, to the southeast corner of Parkview
Subdivision, recorded in Volume 7, Page 17 of the Plat Records of said County, also being
the southwest corner of Parcel 4, described in Instrument No. 93-93786 of the Official
Records of said County; thence North 0°19'39" West, along the east line of said Parkview
Subdivision and the west line of said Parcel 9, 398.62 feet, to the northwest corner of
said Parcel 9; thence continue North 0°19'39" West, along the west line of Parcel 7 of
said Instrument No. 93-43786, a distance of 909.17 feet, to the south line of that tract
described in Volume 207, Page 252 of the Deed Records of said County, also being on the
north line of said quarter-quarter, thence South 89°50'37" West, along the south line of
said tract and the north line of said quarter-quarter, 393.00 feet, to the northeast
corner of Parcel 3 of said Instrument No. 93-43786; thence South 0°19'39" East, parallel
with the east line of said quarter-quarter, 400.00 feet; thence South 89°50'37" West,
parallel with the north line of said quarter-quarter, 789.99 feet, to the center line of
Jackson Creek; thence North 20°20'54" West, along the center line of Jackson Creek,
319.93 feet, to a point on the easterly line of Grant Road; thence South 89°50'37" West,
parallel with the north line of said quarter-quarter, 30.00 feet, to the center line of
Grant Road and the west line of said Section 3; thence North 0°10'53" West, along said
west line, 1429.37 feet, to the southwest corner of the northwest quarter of said Section
3; thence North 0°16'57" West, along the west line of said northwest quarter, 2719.05
feet, to the center line of Scenic Road and the northwest corner of said northwest
quarter; thence South 89°98'38" East, along the north line of said northwest quarter,
396.39 feet, more or less, to the easterly right of way line of Highway No. 99; thence
South 35°09'30" East, along said easterly right of way, 9933.39 feet, more or less, to
the north line of the southwest quarter of the southeast quarter of said Section 3;
thence South 89°50'39" West, along said north line, 511.35 feet, more or less, to a 5/8
inch iron pin, monumenting the northeast corner of the southeast quarter of the southwest
quarter of said Section 3, said corner also being the northeast corner of Parcel 2,
Partition Plat No. P-31-1997 of the Records of said County and State, Index Volume B,
Page 31, Jackson County Surveyor's File No. 15340; thence South 89°50'37" West, along the
north line of said Parcel 2, 688.56 feet, to the northwest corner of said Parcel 2;
thence South 0°18'24" East, along the west line of said Parcel 2 and its southerly
projection, 1328.61 feet, to the south line of the southwest quarter of said Section 3;
thence continue South 0°18'24" East, 30.00 feet, to the south right of way line of said
Taylor Road; thence South 89°49'38" West, along said south right of way line, 649.05 feet
to the POINT OF BEGINNING.

The above -described property is not within the City of Central Point's Current corporate
boundaries, but is contiguous to the City's existing corporate boundary and is within the Central
Point Urban Growth Boundary (UGB).
Section 2. The owners of the property proposed for annexation are Bret A. Moore, Noel A.
Moore, John A. Duke, and Stephen A. Benston, and there is mutual consent to the annexation. Such
written consent is on file at Central Point City Hall, 155 South Second Street, Central Point, Oregon.
Section 3.ORS 222.125 provides that when all of the owners of land in the territory proposed
for annexation and not less than 50% of the electors residing in such territory have consented in
writing to the annexation of the land in the territory and file such written consent with the City
Council, the property may be annexed without the requirement for an election or a public hearing.
Section 4. Annexation of the described property is consistent with the City's ability to
provide facilities and services to the real property, as required by the City's Comprehensive Plan.
Section 5. Pursuant to ORS 222.125, the property described in Section 1 above, shall be and
hereby is, annexed to and made part of the City of Central Point, Oregon.
Section 6. The City Administrator, or his designee, shall transmit a copy of this resolution
to the Oregon Secretary of State, and this annexation shall be effective when filed with the Oregon
Secretary of State pursuant to ORS. 222.180.

CONSENT TO ANNEXATION
(Property Owner or Elector)
I, (we) the undersigned, being the owner(s) of real property in
Jackson County, Oregon, a legal description of which is attached as
Exhibit "A" to this document, hereby consent in writing to the
annexation of that property to the City of Central Point, Oregon
consistent with the provisions of ORS 222.111 et seq.
I hereby certify that I am the (legal owner) or (elector residing
on the premises) and that the property is currently
• Contiguous to the City Limits of the City of Central Point;
• Within the Urban Growth Boundary of the city of Central Point;
• Shown to be urbanizable land on the General Land Use Plan Map.
