A RESOLUTION DECLARING THE ANNEXATION OF 4.21 ACRES OF PUBLIC RIGHT-OF-WAY KNOWN AS UNIMPROVED SEGMENTS OF FIRST AND GLADES STREETS AND LOCATED BETWEEN FREEMAN ROAD AND CUPP DRIVE INTO THE CITY OF CENTRAL POINT, OREGON (Applicant(s): City of Central Point (37 2W I1C) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Application has been made by the owners of certain real property for annexation into the City of Central Point, Oregon. The property consists of the unimproved road rights-of--way for First and Glades Streets. located north of Freeman Road and south of Cupp Drive, consisting of a total of 4.21 acres. The property to be annexed is more particularly described as follows: All that real property situated in the Northwest and Southwest One-quarters of Section. l 1, Township 37 South,. Range 2 West of the Willamette Meridian in the City of Central Point, Jackson County, Oregon, platted as FIltST STREET and GLADES STREET,. HOMESTAD ACRES EXTENSION NUMBER 1, now of record, the exterior boundaries of said streets more particulazly described as follows: Beginning at the Initial Point of said subdivision, being on the westerly right-of--way of Freeman Road, from which the southeast comer of Donation Land Claim Number 54, of said township, range and merld'tan, bears East, a distance of 1060.18 feet (1060.15 feet plat record) and South, a distance of 1 11.78 feet; thence West, a distance of ] I.43 Feet to the westerly right-of--way of said First Street, thence North 35°08'10" West, along said westerly right-of--way, a distance of 1460.68 feet (1460.60 feet plat record} to the intersection with the southerly right-of--way of said Glades Street; thence South 54°51'4T' West (South 54°51'50" West plat record) a distance of 250.00 feet to the easterly right-of--way of Pacific ffighway, US 99; thence North 35°08'10" West, along said highway, a distance of 60.00 feet to the northerly right-of--way of said Glades Street; thence North 54°51'4T' East, (North 54°51'50" East plat recerd) along said northerly tight-of--way, a distance of 250.00 to the intersection with the westerly right-of--way of said First Street;. thence North 35°OS' 10" West, along said westerly tight-of--way, a distance of 600.03 feet (600.00 feet plat record) to the southerly right-of--way of Cupp Drive; thence North. 54°51'50" East, along last said southerly right-of--way, a distance of 92.00 fee[ to the beginning of a curve to the left having a radius of 12.00 feet and a central angle of 90°00'00"; thence along. the arc of said curve a distance of 18.85 feet, the long chord of said curve bears South 6°51'50" Wes[, a distance of 16,97 feet to the easterly right-o£way of said Fitst Street; thence South 35°08'10" East, along said easterly tight-of--way, a distance of 1919.62 feet to the beginning of a curve to the left having a radius of 30.00 feet and a central angle of 114°56'35"; thence along. the azc of said curve a distance of 75.89 feet, the long chord of said curve bears North 72°23'33" East, a distance of 57.21 feet to the easterly right-of--way of Freeman Road; thence South 00°04'45" East, (South 00°04'40" East plat rewrd) along last said right-of--way, a distance of 217.98 feet (217.99 feet plat record) to the Point of Beginning. Containing 4.21 acres, more or less. Basis of beatings for this description is the north line of Donation Land Claim Number 63, from the southeast comer of Donation Land Claim Number 54, at the intersection of Beall Lane and Burrell Road, along the centerline of Beall Lane, to the northwest corner of said claim number 63. The above-described property is not within the City of Central Point's current corporate"boundaries, but is contiguous to the City's existing corporate boundary and. is within the Central Point Urban Growth Boundary (UGB). Section 2. The owner of the property proposed for annexation is Jackson County, who has entered into an agreement with the City of Central Point and there is mutual consent to the annexation. Such written consent is on file at Central Point City Hall, 155 South Second Street, Central Point, Oregon. Section 3. ORS 222.125 provides that when all of the owners of land in the territory proposed for annexation and not less that 50% of the electors residing in such territory have consented in writing to the annexation of the land in the territory and file such written consent with the City Council, the property may be annexed without the requirement for an election or a public hearing. Section 4. Annexation of the described property is consistent with the City`s ability to provide facilities and services to the real property, as required by the City's Comprehensive Plan. Section. 5. Pursuant to ORS 222.125, the property described in Section 1 above, shall be and hereby is, annexed to and made a part of the City of Central Point, Oregon. Section 6. The City Administrator, or his designee, shall. transmit a copy of this resolution to the Oregon Secretary of State, and this annexation shall be effective when filed with the Oregon Secretary of State pursuant to ORS 222..180.
