LOCAL TOBACCO CO TROL ORDI ANCES ARlD REFRAI
FRO REE TIO STATDTES.
FIERE AS, the Council of the City of Central Point passed a Tobacco Ordinance
to protect its youth from the illicit sale of tobacco products:, and its non-smoking residents
from the harmful health effects of second hand smoke; and
FIEREAS, the voters of Cen#ral Point overwhelmingly affirmed the Council
decision in September, 2000, when 64% of eligible voters mailed in ballots, and 62% of
those voters supported the Ordinance; and
HEREAS, every Oregon City must have the ability to react to local needs, by
enacting Ordinances which reflect the values of its citizenry; anal
FIEREAS, State Statutes which preempt local Ordinances, by mandating a "one
size fits all" approach, serve only to inhibit local initiatives; and
FIEREAS, State Statutes which preempt local Ordinances reinforce the perception
held by many of our citizens that their votes don't count; and
FIEREAS, Preemption has been. used as a strategy by the tobacco companies
and their surrogates, to weaken local Tobacco control Ordinances by substituting weaker
statewide standards;
O , TFIEREFORE, BE IT RESOLVED that the City Council of the City of Central
Point hereby urges the Oregon State Legislature to preserve, and not preempt., the righ
of local communities to enact anal enforce tobacco related ordinances and to protect their
citizens from tobacco related illnesses.
