HomeMy WebLinkAboutCouncil Resolution 546RESOLUTION N0. 546 A RESOLUTION GRANTING CONCURRENT APPROVAL OF THE PRELIMINARY AND FINAL SUBDIVISION PLATS FOR THE MEADOWS. PHASE IV WHEREAS, N. L., INC, and Neil Scheuneman, hereinafter referred to as Subdivider, have submitted for approval preliminary and final plats for The Meadows subdivision Phase IV and planned unit development located within the City, more particularly described in Exhibit A, attached hereto and by this reference incorporated into the within resolution, and WHEREAS, the Planning Commission of the City has reviewed said concurrent application and by Planning Commission resolution has recommended approval of said preliminary and final plats, subject to the conditions set forth in the staff report, which conditions are set forth in Exhibit B, attached hereto and by this reference incorporated into the within resolution, and WHEREAS, the City Council held public hearings upon said application for approval of preliminary and final plats on May 17, 1990, and received and reviewed the City staff report, the Planning Commission report. and resolution, and public hearing evidence, and finds: (a) The same have been submitted in timely fashion; (b) The final plat is in conformity with the preliminary plat as submitted; RESOLUTION NO. 546 _ 1 (MEADOWS.REV - 051890) (c) The submissions are in the form and contain all of the information required by Central Point Municipal Code and all applicable statutes; (d) The Director of Public Works has examined the same and finds them to be technically correct; (e) The Subdivider has entered into a subdivision agreement assuring construction of improvements in accordance with said plats and conditions thereon, and providing for reimbursement to the City of costs of inspection and compliance in all respects with the City's ordinances; (f) The subdivider has submitted a cash deposit to secure performance of said agreement, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. Based upon the staff report, Planning Commission report and resolution, and evidence relating to said applications, the City Council hereby finds that said applications meet the requirements for preliminary and final plat applications, that said preliminary plat and final plat as proposed are in compliance with the City's Comprehensive Plan and Zoning Code, and if the conditions set forth hereinafter are met, meet the City's subdivision requirements. Section 2. The City Council hereby grants approval to the preliminary and final plats submitted by Subdivider for The Meadows subdivision, subject to the conditions set forth in Exhibit B, attached hereto, and subject to execution of a subdivision agreement by Subdivider agreeing to completion of said conditions. Section 3. The Mayor is hereby authorized and directed to execute said subdivision agreement and all other documents on behalf of the City in connection with the within preliminary and final plat approvals.
